City Council Present: Mayor Wyn John, Karen Johnston, Steve DeLapp, Rita Conlin, Lee Hunt. City Staff: Ann Terwedo, Mary Kueffner. Others: Sue Dunn, Tim Mandel, Gloria Knoblach. 3M/Imation Representatives: Don Jordan, Miles Lindberg, Darrel Wiegshad. Mayor John opened the meeting. Don Jordan, 3M representative, discussed the regional perspective behind the 3M/Imation land in Lake Elmo and Oakdale. There are 195 acres of 3M land in Lake Elmo on the north and south side of Highway 5. In Oakdale, there are 300 acres of land which could be broken into 2 acre lots..,., Mr. Jordan spoke about water quality in relation to development on the Imation property in Oakdale and the future development of the 3M property in Oakdale in relation to the storm water run-off which goes into Lake Elmo. Specifically, the storm water run-off in the Imation site could be held in the existing, and future ponds. The 3M land in Lake Elmo will need additional ponding areas which the 3M land in Lake Elmo may accommodate. Mr. Jordan presented a bubble diagram of current and two new buildings, detailed a series of ponds and more of a campus setting. Mr. Jordan stated that Imation can keep the water "on site"however, Imation may join in a comprehensive watershed plan if an appropriate one can be devised. Mr. Jordan said that 3M/Imation wants the support of the City of Lake Elmo and the long .jerm benefit for the city would be: 1.) green acres setback from Highway 5 2.) appropriate "buffer" areas next to residential areas 3.) creation of "water amenities" 4.) walking paths which would tie into the Lake Elmo comprehensive plan and Washington County trail system Three concept land use alternatives were presented for the 120 acres of 3M land on the north side of Highway 5. These included: 1. A cluster, business park option 30% impervious 2. A residential open space option 3. A standard 6 per 20 residential subdivision All options incorporated ponding areas for the run-off from 3M land in Oakdale. Mary Kueffner questioned if a sewer extension would be feasible for the business park option. Steve DeLapp questioned the ponding issue and its impacts on Lake Elmo; volume/rate of run-off; the rate of run-off cannot increase over time. Karen Johnston questioned where the water in the ponds would come from and asked for information on ponding planned for 3M land in Oakdale. Don Jordan stated that the majority would come from the 3M land north of the Imation property. Imation may or may not become part of an overall plan. Lee Hunt questioned the water quality issue related to the water entering Lake Elmo. Mayor John recognized 3m/Imation was requesting of a "current" council and when they ask for a grading permit later, things could change. Don Jordan responded by stating that water quality is important to both Oakdale and Lake Elmo. Sue Dunn mentioned the Olson Lake Estate prob;em and its impacts on Lake Elmo. Karen Johnston asked when the grading on the Imation site would need to be completed. The group discussed the outlet pond on the property. The group discussed volume and rate issues related to water. The volume of run-off in Lake Elmo cannot increase more that 10%. Wyn John stated that he believes Oakdale will benefit by the taxes generated by the Imation project and Lake Elmo would benefit by having wetlands. Lee Hunt complimented the presentation of the three scenarios. Would like to see buffering from adjacent land uses. Rita Conlin questioned the size of the holding ponds on the 3M land in Lake Elmo. What are the real future land uses? She feels that the zoning should reflect the future land uses. Don Jordan stated that the grading needs to be done in a timely manner. Perhaps as soon as early 1997. Ann Terwedo stated that a grading/excavating permit would need to be issued and reviewed by our engineer and a process would need to be followed. Mary Kueffner wants the city engineer to comment on the feasiblity of this plan working at full development. The group discussed a bullet point review needs to be prepared as to what was discussed and the city council should respond to the workshop. Lee Hunt felt that the neighbors should be notified, when appropriate. 3M/Imation will, in a timely fashion, schedule further meetings. A joint powers agreement should be drafted between the two communities which would define the project and the water issues which will be addressed as part of the future of the Imation/3M land in Oakdale and Lake Elmo. Wyn John supports a meeting with LE/ 3M/Imation/Oakdale. Wyn John closed the meeting at 7:00 PM. Agreement with SBA, Inc. for placement of antenna on City Water Tower At the June 4, 1996 Council meeting, the Council reviewed the amendment to the agreement with Dale Howey, SBA, to place an antenna on the City's water tower, Mr. Howey was asked to submit a site plan to Larry Bohrer and bring back the agreement in final form for Council authorization. Dale Howey, SBA, Inc., presented at the June 18th meeting an amended agreement and site plan. M/S/P Hunt/DeLapp - to postpone consideration on agreement with SBA in order for the City Attorney to review the amendments to the agreement with Dale Howey and then place on agenda as Item 6F. for discussion. Maintenance Building Update Dean Johnson, TKDA, presented three alternative plans for the proposed maintenance facility, (1 C, 10,660 SF, 2A. 10, 600 SF, 3A, 10,536 SF) and requested direction from the Council if they supported one building or two buildings. The MAC and Council had reviewed the needs and growth of the City presented by the Planner. M/S/P Hunt/DeLapp - to support concept 1C, as presented at the meeting, with a modification of placing one dump plow vehicle into a bay (wash or maintenance) with the 106' building dimension turned back such that the remaining equipment can fit in the building envelope and direct the architect to proceed ahead with the remaining portion of the project. (Motion passed 4-0). LAKE ELMO CITY COUNCIL MINUTES JUNE 18, 1996 3 D. Request by Peter Halden 8312 Deer Pond Trail N,. Peter Halden, 8312 Deer Pond Trail N., requested the City to put in a curb to resolve the runoff onto his property which is causing erosion. He was told by a staff member that he would be on this Council agenda. Mr. Halden was asked to contact the City Administrator in order for this request to be placed on the July 2 City Council meeting with a recommendation. E. Request by Rehbein Excavating The City received a request from Rehbein Excavating to work on Saturdays in the Washington County Landfill based upon the unusual amount of rain this year, as well as the mutual benefit to all in seeing that this project is completed as quickly as possible. The City Administrator drafted an amendment to the existing noise ordinance which would allow the contractors to workoorm 7 a.m. to 8 p.m, on weekdays and from 9 a.m. to 5 p.m. on weekends and state and federal holidays. Currently, a special permit can be requested if certain criterion is met (emergency situations or determination of a substantial economic loss). M/S/P Hunt/Johnston - to direct the staff to call a public hearing on ordinance amending Section 1507.030 expanding the permitted hours of operation of construction equipment between the hours of 7 a.m. and 8 p.m. on weekdays and from 9 a.m. to 5 p.m. on Saturdays, Sundays, and state and federal holidays and bulk mail notice to all residents. (Motion passed 5-0). M/S/F Hunt/John - to authorize the City Administrator to issue a permit for Saturday extended hours to work on the Washington County Landfill cleanup provided there is a showing of financial hardship. (Motion failed 2-3:Conlin, Johnston, DeLapp) Attorney Filla pointed out the Council asked Rehbein two weeks ago for information to be submitted demonstrating substantial economic loss. Council member Johnston felt the recommendation remains inconsistent with the ordinance and the direction received from the City Attorney --a special permit can be requested if there is an emergency situation or determination of a substantial economic loss and City has not received any information from Rehbein. Niles Fellows, MPCA, responded that in the agreement it states the City shall not allow others to take any action to interfere with the environmental response action. He will consider his option and contact his attorney. M/S/P Hunt/John - to reconsider motion. (Motion passed 4-1:Johnston) M/S/P Conlin/Hunt - to reconsider motion contingent upon information provided to the City Administrator by applicant which should include cost of increasing the workforce on the site during regular work hours and demonstrated that increasing the workforce is going to cost more than working overtime on Saturday. (Motion passed 3-2:DeLapp, Johnston) F. Agreement with SBA for Request for antenna on water tower Attorney Filla pointed out the City has to amend the code to accomplish a permitted antenna over 65' in height. There was discussion on if an antenna is an incidental use or could it be considered a normal accessory use to a water tower. If the City is going to require a 65' height limitation, an amendment is required to the code in order to place an antenna on the Cimarron water tower which is more than 65' in height. The City will have to treat the City water tower the same. LAKE ELMO CITY COUNCIL MINUTES JUNE 18, 1996 4 M/S/P Hunt/John - to call a public hearing for July 2, 1996 for modifying requirements of antenna towers not to exceed 65' in height for placement on existing water towers within the City (Motion passed 5-0). Attorney Filla reviewed the changes in the draft agreement with SBA, and Mr. Howey will be bringing this agreement to his attorney for review. Larry Bohrer will review the site plan, which was received by their office at the end of day, with Dan Olinger. M/S/P Hunt/Conlin - to approve PCS site agreement with the City and Sprint Spectrum concerning placement of PCS antennas on City water towers contingent upon the City successfully amending its code to allow antennas on water towers of suitable height. (Motion passed 5-0). Councilman Hunt suggested securing a copy of the League of Minnesota Cities antenna ordinance and ask the Planning Commission to work on where in the City should we accept antennas and free standing towers. M/S/P HunttJohn - to direct the staff to contact the League concerning placement of free standing PCS towers and get their model ordinance and direct the PZ to begin discussions as per policy on the zones where antennas are permitted, and have the proposed ordinance be placed on the first PZ meeting of July and request a recommendation back to the Council at their second July meeting. (Motion passed 5- 0). 7. CITY ENGINEER'S R REPORT: A. PUBLIC HEARING: CSAH 13 Reconstruction Project The Public Hearing was published in the June 5, 1996 Stillwater Gazette Extra and the June 3, 1996 Stillwater Gazette. All benefiting property owners were notified. Washington County has ordered the improvement of CSAH 13 (Inwood Avenue) from CSAH 6 (Stillwater Blvd.) to CSAH 10. In accordance with County cost participation policy, a portion of the cost is chargeable to the City. This street improvement provides a benefit to those properties which front on Inwood Avenue. Larry Bohrer explained the policy states that the abutting property shall be assessed based on zoning category. The Council set the appropriate rate for each zoning category for the 1996 Reconstruction Projects. Mayor John opened up the public hearing at 8:06 p.m. in the Council Chambers Mary Siedow, 2796 Inwood Avenue N., felt he was not going to benefit $1200 by this road reconstruction and was told at a meeting by Chris from Washington County that the property owners would not have to pay. The shopping mall in Woodbury is the one benefiting and should be crucified for this. Paul Eberhard, 2298 Inwood Avenue N. agreed the County did not mention any cost assessed to residents, asked if there will be interest charged on his 3 lots where the assessments are being deferred. This is a hearing for ordering the improvement and assessments will be discussed at a future assessment roll hearing. Mayor John closed the public hearing at 8:22 p.m Councilman DeLapp questioned the County has a driveway off of Inwood Avenue and use it for dog and horse trials. It is not a City approved driveway, but do they have an obligation to be assessed for this access. When the road project is being done, they should be upgrading the driveway to City standards. The staff will check with the County on blacktopping the driveway to City regulations. LAKE ELMO CITY COUNCIL MINUTES JUNE 18, 1996 M/S/P Hunt/Johnston - to adopt Resolution No. 96-12, A Resolution ordering the Improvement of CSAH 13 (Inwood Avenue) from CSAH 6 (Stillwater Blvd.) to CSAH 10 in accordance with plans as presented by the Washington County Public Works Dept. (Motion passed 5-0). 6. PLANNING/LAND USE & ZONING: A. Case No. V/96-14, Variance to lot width: Mike Severin, 8012 50th St. (Continued) As directed by Council, the staff has reviewed additional background regarding the Meier property and the Severin property. On June 6, 1989, the Council postponed consideration to deny a variance request to lot size and frontage for Mrs. Meier's property. It was also stated that a building would be a disruption to the adjoining property owners. City Planner Terwedo reported the south parcel should not be considered a buildable lot, but it does seem reasonable to allow an accessory structure on the lot. A restrictive convenant should be placed on this south parcel which would only allow an accessory structure and would tie the two parcels together. Terwedo recommended that Bennett Street not be vacated at this time. Mrs. Meier was invited to meet with the City Planner and Administrator to discuss what could be done with her lot. PUBLIC HEARING: Cased No. WGP/96-19: Request for Wind Generator Permit Applicant:George Dege The Public hearing notice was published in the Stillwater Gazette and the property owners within 350' were notified. George Dege, 5193 Keats Avenue N., is requesting approval of a Wind Generator Permit in order to place a wind generator, 85 feet in height, on a parcel over 40 aces. The setbacks meet the requirements for the district. No fencing or lighting is proposed. The wind generator is gray in color and has a red light on the top. The area is not in the airport safety zone and no other wind generator is located within 1000 feet. Mr. Dege corrected the dimension from 380' to 280' from the adjacent property as shown on Figure 5. Mayor John opened up the public hearing at 8:50 p.m. There was no one to speak for or against the Wind Generator Permit request Mayor John closed the public hearing at 8:53 p.m.. M/S/P Johnston/DeLapp - to approve the Wind Generator Permit for George Dege, 5193 Keats Avenue N., subject to 1. PUBLIC HEARING: Case No. GRADE/96-13: Excavating & Grading Permit Applicant: William McCully/Glen Rehbein Excavating William McCully, who works for Glen Rehbein Co., presented project for a 40 acre parcel located north of Highway 5 and west of Beaut Crest. It is the intent of this grading and excavating permit to create a man- made lake which will be a natural amenity and attract future residents to the development. Mayor John opened up the public hearing at 9:00 p.m. in the Council chambers. Dale Tobin, 37th St. asked if 36th or 37th Street would be continued into the new development. Only 35th Street will be continued. Mayor John closed the public hearing at 9:15 p.m City Planner Terwedo provided the Council with a copy of a DRAFT grading permit which included 16 conditions. William McCully indicated Glen Rehbein & Co. has agreed to the conditions of the permit except for Conditions 10 and 16. The Council discussed the following conditions of the permit: 4. The hours of operation shall be limited to 8 a.m. to 5 p.m. Monday through Friday. Rehbein requests longer hours because project has been shortened from 3 years to 2 years. They would abide by the current City ordinance which states 7 a.m. to 6 p.m. 5. The permitted shall promptly clean any spilled fill material which may be deposited on any City street. Rehbein agrees to cleaning any spill if they actually caused the spill. 6. All general grading notes on the grading, drainage and erosion plan submitted to the City of Lake Elmo with the exception of No. 10 shall be met. (Bohrer: The ability to substantially modify the plan up to the applicant was getting way too far from the actual approval process. Recommendation is that any changes in the grading plan would come back to the City Council.) 8. The applicant shall submit a letter of credit in the amount of . (Bohrer recommends $10,000). 9. A 60 foot right-of-way for an extension of 35th Street shall be shown on the final grading plan. Rehbein Co. agrees to a 60' r-o-w from the E propertyline where 35th St. goes North. (Bohrer:A 60' r-o-w going immediately N. of 35th St. along the E propertyline would make a right angle turn. When Beaut Crest was approved, it was RR property. 35th Street was extended, both the r-o-w and constructed road, all the way to the W property line for the possible connection. Normally, if there is a connecting road, Bohrer would use a minimum 200' radius curve to allow up to 20 mph, negotiated. The Council should discuss whether a right angle, very short radius curve, is going to be acceptable) 10. A 75 foot buffer will be maintained along the south and along the east property line. All mature trees over 5 inches in diameter/3 feet from the base shall be preserved. Rebhetn Co. finds this condition difficult to accept. The 76' buffer would be unattractive and they propose to plant a variety of trees that would be more attractive. This buffer would have as significant impact on the volume of the pond. By reducing the pond volume, Rehbein is less able to address the storm water runoff problems that the VBWD might have in this area. Rehbein Co. requests this condition of approval be deleted. (Bohrer:The reason this was requested was to maintain the mature trees along the highway side, primarily the SE corner of the site. According to the applicant, he can't build his berm and preserve the trees. The berming provides part of the screening and part of the volume capacity of the pond. Also, they have done quite a bit of coordination with the VBWD--it appears to him (Bohrer) that the pond may develop into something of a more regional significance than just for Lake Elmo Hamlet Estates. The Council needs to decide which is preferable, berming or saving the mature trees.) LAKE ELMO CITY COUNCIL MINUTES JUNE 18, 1996 7 11. Access to the site is limited to the west entrance on Highway 5. Rehbein agrees to this for the vehicle or the trucks coming from the W to E. (Bohrer:when the City first heard of this inquiry, the intent was the material was to be used for the landfill project. The fill was going to be going E and the empty trucks coming back would use the existing field entrance. Bohrer thought the need for that is gone now. He has no objections to using that existing field entrance on the E.) 14. A future pathway shall be developed around the pond as part of the development of the Lake Elmo Hamlet Estates. Rehbein agrees to a future trail. 16. The Washington County Soil and Water Conservation District shall review the wetland creation plan and make periodic inspections of the site. Rehbein Co. foresees that this pond will have wetland characteristics, however this is not a wetland banking site. Rehbein requests this condition be deleted. (Bohrer:The Planner felt this water amenity should be more of a wetland and it's clear to him that its intended to be used as more of a storage pond. A wetland would have varied depths to get different types of vegetation and there would be some areas of open water. Regardless if the Intent is to create a wetland or a water holding pond, either one would need a controlled outlet. ). M/S/P Johnston/Hunt - to continue this item until such time the applicant and City staff discuss conditions and come to an agreement on conditions and for the staff, Rehbein Co. and related expertise to identify wetland creation. (Motion passed 5-0). E. Recommendation from Planning Commission on request of antennas At the June 17 meeting, the Planning Commission discussed the request to place switching antennas on the water towers. There was not a concern of the placement on existing structures. However, the Commission is definitely against the proposal of placement of free standing towers in public parks. F. Olson Lake Estates Outlet Project: Larry Bohrer reported it was brought to his attention by Randy Peterson that there is a concern of trees very close to the south edge of the road. Mr. Peterson would like to take down the three oaks that are dead, but there is one living oak that has branches overhanging. The machine may break off the branches and the sandy nature of the soil would undermine the tree which could fall over. They are asking for permission to remove the trees which are on the right-of-way. Bohrer suggested talking to the property owner of 8241 Lake Jane Trail whose property is adjacent to the tree. M/S/P John/Hunt - to direct the person, Randy Peterson or the contractor, who is taking the trees down in the r-o-w located by 8241 Lake Jane Trail contact the residents in the tree vicinity (adjacent and across the street) and this tree be replaced by a hardwood tree, 2-21/2 N in diameter, in location to be determined at later date. (Motion passed 5-0). 8. PARKS/MAINTENANCE/FIRE DEPARTMENT/MAINTENANCE ADVISORY: A. Parks Commission Recommendation on Kleis Park Infield Installation and shrub removal around playground oak trees The Parks Commission walked through Kleis Park on June 4 and discussed installing an Ag-lime infield, and clearing the brush around the oak trees by the playground equipment. The Commission discussed the improvements, suggested at the walk-through, are going to be very noticeable and did not want the improved infield to create a noise problem to the neighbors so it will be kept small. The Commission recommended the Council accept their intent to improve the infield for 1st, 2nd and 3rd grade age kids with erg -lime in Kliegs Park. The Commission also recommended the Council accept their intent to remove one dead oak tree and remove all the brush under and around the oak trees by the playground equipment in Kleis Park. Playground equipment recommendation for Kleis and Pebble Park At their June 17, 1996 meeting, the Parks Commission recommended the Council accept the bid submitted by Gametime for Kleis and Pebble Parks based on it will be consistent with the other playground equipment purchased so far, easier installation, and the commission is impressed with their proposal, and also recommended Mike Bouthilet negotiate for an upgrade to the powerscape equipment (slightly more durable/beefy) for Pebble Park for the same price for a total price of $35,000 for both sets M/S/P Johnston/Hunt - to accept the Parks Commission recommendation on accepting the bid submitted by Gametime for playground equipment at Pebble Park and ask Mike Bouthilet to negotiate for an upgrade to the powerscape equipment for the same price for a total price of $35,000 for both sets. Parks Recommendation on placement of antenna in Pebble Park The Parks Commission discussed the proposal by SBA to place an antenna tower in Pebble Park and recommended the Council deny the request of SBA to construct an antenna tower in Pebble Park, or in any public park, for safety and aesthetic reasons. Kes Tautvydas, Parks Commission Chair, explained the Commission is strongly opposed to antenna towers in any park because people should be able to enjoy nature without having to view constraints and a tower would detract from the park. VFW BALLFIELD: Administrator Kueffner talked to Barb Haacke who was going to get back to her on the donation from the Lake Elmo Jaycees. The Administrator will contact the Realtor about the (bottom line) selling price of the ballfield. D. Annual Report by Fire Department, Minor By -Law Changes Fire Chief Richard Sachs presented the 1995 Fire Department Annual Report. M/S/P Johnston/Del-app - to accept the 1995 Fire Department's Annual Report. (Motion passed 5-0) Chief Sachs explained the Department has made a change to its by-laws. They have changed the rate of pay for probationary members and members that are not currently at the level of First Responder. M/S/P Johnston/Conlin - to approve the change to Article VI -Compensation of the Lake Elmo Fire Department By -Laws. (Motion passed 5-0). 9. CITY ATTORNEY'S REPORT The City received a letter from Bannigan & Kelly, P.A., who represent a group of Lake Elmo residents concerned with certain land use matters currently pending before the Council. Attorney Filla will respond directly to Attorney Hanton in more detail: Section 301.060E. of the City code does not apply to requests for legislative changes submitted by property owners, disagrees Section 15.99 of the State Statute refers to anything other than zoning matters relating to development and doesn't apply to the facts of this particular case M/S/P John/Johnston - to direct Attorney Filla to prepare a response to this letter as described at the meeting. (Motion passed 5-0). 10. UNFINISHED BUSINESS: LAKE ELMO CITY COUNCIL MINUTES JUNE 18, 1996 11. CITY COUNCIL REPORTS Councilman DeLapp asked if the City has received applications and should act on filling the vacancy on the Planning Commission. He also asked when variances were going to be discussed by the Planning Commission. This change is in the new code and upon adoption of the recodification that will be the new procedure. The City Administrator was directed to split up the recodification so the Council can check it with the old code and set up meetings or procedure for review. Councilman Hunt suggested a committee work on a computer plan for the City and identify where the City is deficient. The City Planner is looking at how to download information from the County. The Committee will come up with a computer plan so it can be a budgeted item. 12. CITY ADMINISTRATOR'S REPORT: A. Microphones for Council Chamber Mike Bouthilet received a response from Dave Currence, Government Television Network Channel 16 to the city's request for information regarding new equipment for the Council Chambers. If lapel microphones are added for each of the council members, they will replace the table top microphones we now have. The leveller microphone may provide some improvement in sound quality, but they are very susceptible to damage. Cost estimates were included and there would be no problem adding this equipment to our system. M/S/P John/Conlin - to direct the staff to investigate other options further, such as wireless microphones or microphones from the ceiling, before a decision is made and request comments on how effective they are with microphones. (Motion passed 5-0). B. Certification of Local Performance Measures The Finance Director received information regarding certification of local performance measures for local performance aid payable in 1997. In order to quality for the new aid, called Local Performance Aid, the City must have a system of performance measures for services provided by the City and must regularly compile and present these measures to the Council at lest one per year. If there is currently no system of performance measures in place, the City may still qualify for this aid if it Is in the process of developing and implementing a system of performance measures. All cities should be able to qualify to receive LPA in the first year of the aid program. If Lake Elmo wishes to participate in the distribution of this aid for calendar year 1997, the City must fill out the certification. M/S/P DeLapp/Hunt - to request the Mayor and Vice Mayor Conlin sign the Certification of Local Performance Measures for Local Performance Aid Payable in 1997. (Motion passed 5-0). 3M Property: Jim Blackford, 9765 45th St. N., commented that certain avenues are still open for a maintenance site. He has talked to 3M about their property, and they don't want to sell, but their goal is to keep their property in open space. There may be some opportunities to work with them for a maintenance facility and asked the Council to consider this option. Several Council members have talked to 3M representatives who were very specific not being interested in selling their property. The Council has made their decision on the Berschen site for the new maintenance facility. M/S/P Hunt/Conlin -to adjourn the Council meeting at 12:18 (Motion passed 5-0).
