5. CONSENT AGENDA: None
6. CITY ENGINEER'S REPORT:
A. Proposed Traffic Signal at CSAH 13 (Ideal Avenue) and TH. 5 (INFORMATIONAL)
City Engineer Tom Prow provided a review on the Signal Justification Report for the proposed
installation of traffic signals at the intersection of Ideal Avenue and TH.5. The report concludes
that with existing conditions at that Intersection signals are justified, although the warrants for that
signal are very borderline. As the Imation Business Park grows in size, both signals and turn
lanes will become more warranted. Lake Elmo will not be asked to share in the cost because
none of the roads at that Intersection are under our jurisdiction. Prew was not sure if
Washington County will participate in the cost either since improvements at that intersection do
not even appear on their capitol Improvements Plan. It appears that Imation is planning to
construct these improvements this summer.

8. PLANNING, LAND USE & ZONING:
A. Case No. ZAM/97-6 Rezone from RR to OP: Herzfeld Property (Continued from 2-4-97)
This rezoning, with the consent of the applicant, was continued from the February 4, 1997 City
Council meeting. The request is to rezone a 100 acre parcel of land from Rural Residential to
Open Space Development District. This parcel of land has been identified on the Future Land
Use Map as an open space development area. At its January 27,1997 meeting, the Planning
Commission recommended approval of the rezoning.
M/S/P Conlin/Dunn - to adopt Ordinance No. 8153, An Ordinance amending Section 301.070 C
"Zoning District Map" of the Lake Elmo Municipal Code changing the land use designation from
Rural Residential to Open Space Development Area, Case No. ZAM/97-6 based on the findings
listed in the City Planner's report dated February 18, 1997. (Motion passed 5-0).
B. Case No. ZAW97-10 Rezone from RR to Ag: Applicant: Elzabeth Miner; Property located
at the NW corner of 10th St. and Cty Rd. 19
Elzabeth Miner is requesting to rezone a 45 acre parcel from Rural Residential to Agricultural to
allow a stable business for the boarding and training of horses. The property is generally located
on the Northwest corner of 10th Street and County Road 19. There is one wetland on the site
and will need to be delineated as part of this proposal. The proposal meets the goals for
agricultural uses in the Comprehensive Plan. At its February 10, 1997 meeting, the Planning
Commission recommended approval conditional upon an amendment to the Future Land Use
Map of the City's Comprehensive Plan changing the designation of this parcel from OP to RAD
from the Metropolitan Council. The applicant requested that approval of the rezoning be
contingent upon them receiving their Conditional Use Permit.
M/S/P Hunt/Dunn - to adopt Ordinance No. 8154, An Ordinance amending Section 301.070 C
"Zoning District Map" of the Lake Elmo Municipal Code; conditional upon an amendment to the
Future Land Use Map of the City's Comprehensive Plan changing the designation of this parcel
from OP to RAD and the Metropolitan Council approval based on the Findings of Fact stated in
the City Planner's Report dated February 18, 1997 and recommendation for approval by the
Planning Commission. (Motion passed 5-0).

C. Case No. CUP/97-12 C.U.P. for Horse Stable; Applicant: Elzabeth Miner
Elzabeth Miner is requesting a Conditional Use Permit for a business for the boarding and
stabling of horses. At its February 10, 1997 meeting, the Planning Commission recommended
approval of the C.U.P. with amendments to the conditions. The Council reviewed the draft C.U.P.
and made changes to the conditions.
M/S/P HunUDunn - to adopt Resolution No. 97-5, as amended, granting a Conditional Use Permit
to Elzabeth Miner, Arbor Hill Farm, for the operation of a horse stable and an equestrian boarding
and training center conditioned upon the city and the applicant executing an agreement to
provide the city with an easement across the back part of the property giving access from E to W
of the property and approval of an amendment to the Comprehensive Plan based on the Findings
listed in the City Planner's report dated February 18, 1997. (Motion passed 5-0).
Administrator Kueffner pointed out that the Planning Commission decided there was no need for
a minor subdivision. Therefore, the applicant at the Planning Commission meeting formally
withdrew the application for a Minor Subdivision.
M/S/P Conlin/Dunn - to approve the Planning Commission's recommendation acknowledging the
fact that there is no reason for Elzabeth Miner to apply for a minor subdivision and the applicant
withdrew her application. (Motion passed 5-0).
D. Case No. SUB/97-9 Preliminary Plat & Plan, The Homestead; Applicant:Jack Buxell
City Planner Tenvedo explained Jack Buxell is requesting preliminary plat and plan approval of
19 units ranging in size from .75 to 1 acre lots on a 20 acre parcel located at 1381 Lake Elmo
Avenue N.. The project is proposed to be completed in one stage.
Jack Buxell presented the preliminary plat for The Homestead and reported on the drainage,
private open space uses and Land Trust easements, pathway system and the possibility of the
homeowner's association putting a tree farm and use part of the parkland. Buxell asked for an
18' road around the perimeter which allows parking on one side and that "no parking" signs not
be put on the road.
Mark Beattie, 3M Real Estate Dept., submitted a letter indicating the 3M Engineering Department
reviewed the proposed plan and has found that two primary changes must be made - The
Homestead Pond 1 cannot drain directly onto 3M property or into 3M Pond B-2, but must either
be revised to accommodate all drainage on site or drain into The Homestead Pond 2; and the
culvert from The Homestead Pond 2 onto 3M property must be relocated to the east to drain
directly into 3M Pond A at a rate not to exceed the present rate. They have reached an
agreement with the Developers to the above changes and conditions for drainage onto 3M
property.
Attorney Filla has reviewed the Association By -Laws and Declarations, but has a concern on
more definition of the relationship between the City and the Association in terms of maintenance,
and has not seen the language the Land Trust is proposing. The City reserves the right to
determine the designation of the various open space categories and have those Issues resolved
before the City starts final approval stage.
M/S/P DeLapp/Hunt - to approve Case No. SUB/97-9, A Preliminary Plat and Plan, "The
Homestead" and direct the staff to prepare a development agreement in accordance with the
conditions of approval 1-8 provided by the City Planner and amended at this meeting, the 3
additional conditions of approval from the Planning Commission and additional condition of the
City Attorney's that all documentation for easements, declarations, association by-laws,

maintenance agreements, and development contract be submitted for review prior to application
of final approval. (Motion passed 5-0).
E. Case No. ZAW96-32 Rezone from RR to OP; 11825 50th St. N.,
Applicant:Bob Engstrom
Ann Terwedo reported the legal description for 11825 50th Street N., was not part of the rezoning
for the Engstrom/Klatt property. This Is a verification of that rezoning. The Planning Commission
recommended approval at its February 10, 1997 meeting.
M/S/P Hunt/Dunn - to adopt Ordinance No. 8155 rezoning a 25 acre parcel of land from (RR)
Rural Residential to (OP) Open Space Development Area. (Motion passed 5-0).
F. Case No. SUB/97-13 Preliminary Plat & Plan, The Field of St. Croix
Applicant: Bob Engstrom
City Planner Terwedo reported this is a Preliminary Plat and Plan called The Fields of St. Croix
on a 126 acre parcel located west of Highway 5, North of Manning Avenue. The development
consists of a 46 unit, mixed residential use subdivision and preservation of approximately 81.48
acres buildable land of which 49.81 acres will remain in agricultural use. A variance is requested
to Section 700 of the Lake Elmo Municipal Code. The design flow for this treatment system will
be over 1500 gallons per day. The system will be a wetland treatment system designed by HRD
Engineering. The applicant has submitted a description plan for the CSA Farm, but has not
included information regarding that business. The applicant has not submitted details on the
townhouses and will need to be reviewed at a later date.
Bob Engstrom provided a site plan for the The Fields of St. Croix, and the plan proposes the first
phase (146 acres) of a two stage plan on a 246 acre site. Scott Wallace gave a presentation on
the wetland treatment system. The Council questioned the definition of a hardship for the
variance to the 1500 gallons per day design flow, and asked is there a backup system and will
the homeowners assoc. be responsible for this backup system. Mr. Engstrom and Attorney Filla
pointed out the City did adopt an amendment to the development standards which does permit
the Council, by 4 affirmative votes, to allow a modification of those standards without following a
variance process. Filla suggested the applicant come back with an explanation of what is
required for the modification to the septic standards at a future date.
There was discussion on the proposed improvement of 50th Street which is on the City's overall
thoroughfare plan and special assessments for this improvements or possible impact fees under
the impact ordinance.
M/S/P Hunt/John - to direct the staff to review the City's assessment policy in relationship to
Open Space Zoning development, specifically, as to how the City assesses land in common
ownership or single ownership and individual lots which may abut against the improved roadway
(Motion passed 5-0).
M/S/P Hunt/Dunn - to approve Case No. SUB197-13 Preliminary Plat and Plan, The Fields of St.
Croix, with the conditions of approval listed in the City Planner's report as amended, with
recognition that the condition of the consistency of this proposal with our Open Space
Preservation District was given by staff's report and that all documentation for easements,
declarations, association by-laws, maintenance agreements, and development contracts be
submitted for review prior to application for final approval. (Motion passed 5-0).

M/S/P Hunt/John - to continue the request of Bob Engstrom for a variance to Section 700 Septic
Ordinance to a future meeting to be determined by the City staff and the applicant. (Motion
passed 5-0).
G. Case No. CUP/97-18 C.U.P. for CSA Farm & Wayside Stand
Planner Terwedo requested the C.U.P. be continued until detailed information has been
submitted.
M/S/P Del-app/Conlin - to accept the request of the applicant, Bob Engstrom, for a continuation
of the C.U.P. and waive the 60 days for a C.U.P. for CSA Farm , Wayside Stand and
Townhouses. (Motion passed 5-0).
H. Ordinance Adopting Recodification
Administrator Kueffner provided an ordinance and a summary ordinance which adopts the 1997
Lake Elmo Municipal Code prepared by the City Attorney. Kueffner would like to add, possibly in
platting, the City reserves the right to a 10-day review to determine if an application is complete.
M/S/P John/Del-app - to adopt Ordinance No. 9701, An Ordinance Adopting the 1997 Lake Elmo
Municipal Code. (Motion passed 5-0).
M/S/P Hunt/DeLapp - to adopt and publish the Ordinance Summary of Ordinance No. 9701.
(Motion passed 5-0).
Policy Direction for Rezoning of Kleis Property
Planner Terwedo reported Florence Kleis, 9241 60th St. N., has requested a rezoning of a 2.5
acre parcel from Rural Residential (RR) to Single Family Residential (R-1). This parcel is
located adjacent to Fox Fire Estates which is zoned R-1. There is a policy in the Comprehensive
Plan which states there will be no more R-1 zoning (1.5 acres per house) allowed in the City.
The Council Indicated they felt it would be appropriate to rezone this parcel R-1 because its
adjacent to R-1 Zoning.
9. CITY ATTORNEY'S REPORT: EXECUTIVE SESSION on Hammes Litigation
10. UNFINISHED BUSINESS:None
11. CITY COUNCIL REPORTS:
Mayor John received a request from the Board of Directors of the Community Volunteer
Service for a donation of $1,000 which the Council voted to approve in their 1997 Budget. A line
item of $5,000 was approved for charitable donations, but with no specific designation.
M/S/P HunUJohn - to honor the request of the Community Volunteer Service for a $1,000
donation and inform them the City has no policy on charitable giving and will not continue until
this policy is inplace. (Motion passed 4-1:Dunn:The City Should not be making charitable
donations.).
M/S/P Conlin/Hunt - to enlist volunteers to draft a policy on charitable giving for Council review
with very rigid criteria so the City can be consistent every year. (Motion passed 4-1).
The Council felt the question, would residents like to use tax dollars for charitable contributions,
be a worthy question on the survey.

Councilor DeLapp reported he was appointed to the Washington County Planning Advisory
Board which meets the 4th Tuesday of every month.
Council member Dunn suggested a joint meeting with the Planning Commission to review the
Open Space Ordinance. The Planning Commission and Council will be meeting in September.
Council member Hunt attended Troop 162 Cub Scouts Blue and Gold Dinner. He will be
looking at a new printer and laptop computer. The City could have a web page in 6-12 months,
but would need consulting work to keep it up. Councilor DeLapp suggested a 4-person
committee to help work on the Web. The Finance Director is looking into a Fund Accounting
Program and in a few weeks will have a recommendation.
12. CITY ADMINISTRATOR'S REPORT:
A. General Liability Annual Premium: League of Minnesota Cities
The Council reviewed the renewal premium and summary from the League of Minnesota Cities
through our insurance agency, Zignego Agency Inc. The City has never opted to take the
"excess liability" insurance, but chose to include the "open meeting law defense" coverage at the
rate of $500 per year. Administrator Kueffner will request a comparison of premium figures for
the last ten years.
M/S/P DeLapp/Hunt - to approve the 1997/1998 insurance rates as outlined in the proposal from
Zignego Insurance which shall include Open Meeting Law Coverage and exclude Excess Liability
Coverage.
B. Request for funding from Graffiti Center
The City received a letter from Tom Schwietz, Director of the Graffiti Teen Center located in
Stillwater. Mr. Schweltz has requested a $1000 donation from the City to h help with operating
funds and programs offered by the Center. This request was not budgeted for 1997.
M/S/P Dunn/DeLapp - to deny the request on behalf of the Graffiti Teen Center for a $1000
donation. (Motion passed 4-1: Conlin)
C. Accident Data for County Roads 10 & 19
The City received a letter from Joe Lux, Washington County Public Works Department regarding
the accident data collected by the County for approx. the past 7 years. Although the majority of
accidents has occurred during daylight hours, he believes that installation of a street light at this
intersection would improve safety considerably. If a street light is installed, the City will be
expected to pick up the monthly electric charge for the light, based on the County's policy on
cost -sharing. The County will pay for the installation of the light and the pole, if necessary.
D. District 2 Citizen Advisory Committee Vacancies
The City received a press release announcing vacancies on the Washington County Parks and
Open Space Commission and the Planning Advisory Commission.
The Council adjourned the meeting at 11:20 p.m. and convened the Executive Session.

Wagner Family
For a number of years, the family of Rand and Linda Wagner has been very
active in providing local community support through the Lake Elmo Jaycees.
So much so that they were nominated to compete for recognition as Jaycee
Family of the Year.
I was asked to provide a letter supporting this nomination, and I gladly did so.
I was delighted to learn that they were successful in being declared Family of
the Year for their region. Later they became Family of the Year for the State.
They now go on to compete for the National Championship. I am sure that
everyone here in Lake Elmo will wish them continued success and good luck
in the National competition.
Mayor's Report February 18,1997
On February 5, Ms Kueffner and I met with Ginny Holden' and discussed the
format of the proposed Lake Elmo television show. This is covered in the
hand out that I have passed to you this evening. We will meet with the GTN
the Government Television Network in the very near future to confirm our
needs and to set up a schedule for our first broadcast.
On February 14, 1 chaired the Elected Officials Communication Meeting for
School District 622. You have received copies of the draft minutes this
evening.
February 15, I attended the Annual Meeting of the East Metro Development
Partnership. Bill Hargis, Mayor of Woodbury was one of the outgoing Chairs,
and Craig Waldron, City Administrator for Oakdale and Doug Hanson of 3M
were elected to be chairs for 1997. The presentations summarized the many
successful businesses that had been attracted to Douglas, Ramsey and
Washington Counties in the past year, the new jobs created and the
improvement in the related tax bases.
Last night Councilor Hunt and I attended the Early Childhood Family
Education event at the new Tri School District Valley Crossing school. This
was an opportunity for the 3 to 5 year olds to be introduced to the role of
government in their young lives. This may seem like extra early learning, but
the children responded well to exposure to Fire Fighters, Parks and
Recreation, Roads and Maintenance, State and National Symbols.
The League of Minnesotan Cities will be holding its Annual Conference at St.
Cloud on June 10 - 13. Reserve the dates in your calendars.
