Mayor John called the council meeting to order at 7:00 p.m. in the council chambers. PRESENT: Dunn,
John, Conlin, DeLapp (departed 8:55 p.m.), City Attorney Filla, City Engineer Prew, Administrator

M/S/P DeLapp/Dunn — to approve the May 20,1997 Claims #5892 through #5942, as presented. (Motion
passed 4-0).
M/S/P Conlin/Dunn — to ask Finance Director Marilyn Banister to prepare a year-to-date budget update for
the next council meeting. (Motion passed 4-0)
4. PUBLIC INFORMATIONAL/INOUIRIES:
A. Letter of appreciation to City from Capt. Scott Sinks, Civil Air Patrol
The City received a letter of appreciation from the Civil Air Patrol thanking the City for use of Sunfish
Lake Park for an April 26-27, 1997 Civil Air Patr01/U. S. Air Force search and rescue exercise. The Lake
Elmo staff was extremely helpful and the mission was successful.
B. Tri-Lakes Assoc. request to have water ski show on Lake Jane on August 9s':Joe Kiesling
Jim Dillon, Tri-Lakes President and Joe Kiesling requested permission to have a water ski show, similar to
the ski show they held in 1995, in front of Joe Kiesling's home. They have contacted Washington County
and received their conditions for such an event. The City will look into what was required two years ago
when this request came in and if there were a record of complaints or concerns.
M/S/P DeLapp/Dunn — to request the staff to work with the Tri-Lakes Assoc, with information requested
and come back to Council if appropriate at the next meeting. (Motion passed 4-0).
C. Entrance signs to Torre Pines:Mike Black
Mike Black, Royal Oaks Realty, Inc. is requesting a neighborhood identification monument of Kasota stone
with Torre Pines identified as a Lake Elmo Community located on the comer of Inwood Avenue and 21".
St. N. The definition of Sign, Neighborhood/Sector may be in conflict with this proposal for an entrance
sign for Tone Pines. Staff is asking for direction regarding Mike Black's proposal: (1) Clarify the
definition of Sign, Neighborhood/Sector and direct staff to work with Mr. Black to process the application
or (2) The definition of Sign,Neighborhood/Sector is appropriate and indicates large sectors of the City
such as the Tri-Lakes area and therefore a sign for Torre Pines would not be appropriate. Council member
Conlin felt entrance signs (Neighborhood/Sector signs) were already allowed by the sign ordinance subject
to a Conditional Use Permit. Council member Dunn liked the idea of an entrance sign as long as it was
tastefully done. Mayor John felt that an entrance sign identifies a neighborhood without necessarily
separating that neighborhood from another area. Councilor DeLapp was strongly opposed --the Council
made a motion six years ago which was passed unanimously to not allow subdivision signs after The Forest
went in, If we are going to have a neighborhood sign, it should be Meehan not Tone Pines. The City does
not need to introduce the city to a cast system. DeLapp did support the interpretation of the sign ordinance
which was provided ---the Council did eliminate the motion from 1992.
Mike Black, Royal Oaks Realty, will proceed with the process and apply for a Conditional Use Permit for
the sign. He will also check into the light that flickers on and off at the entrance to Torre Pines which was
brought up during this discussion..

6. CITY ENGINEER'S REPORT:
A. PUBLIC HEARING: Grading Permit:McGough Construction
The public hearing notice was published in the May 9, 1997 Stillwater Gazette and property owners within
350' were notified.
Paul Danielson and Miles Lindberg, BRW, presented the request of McGough Construction for a permit to
construct a swale and storm water detention pond to reduce the peak discharge from the site. According to
the application, this request is so compliance can be met with the joining powers agreement between the
City of Oakdale, the City of Lake Elmo, and the Valley Branch Watershed District dated December 3,1997.

Tom Prow has reviewed the plans and the plan meets the intent of our agreement with Oakdale and Imation
for a stormwater outlet.
A third building is being built on the Imation campus in Oakdale, a series of holding ponds need to be built
to accommodate for lost drainage area. Because the natural flow for this water goes from the Oakdale
Imation property to another property the company owns across County Road 13 in Lake Ehno,
representatives requested that the City approve an extension of the drainage. This is one pond planned as
part of a pond network. Danielson explained it's the first step in setting up a framework for future
developments. None of the Imation representatives could say exactly what this future development would
be. They speculated that it could be a further expansion of the Imation campus or even a cluster -housing
development.
Mayor John opened up the public hearing at 7:50 p.m.
Helen Fisher, 8139 38s' St. N., complained that she had not been adequately notified of the proposed
change and was wary of any construction. Danielson explained that Imation currently bas no expansion
plans beyond building one pond, but that plans for more ponds, or even more constriction is not certain.
The pond will be filled with nor more than six inches of water on a dry day.
Marlies Jackle, 8420 39" St. N., voiced her concerns about runoff from the hnation site contaminating her
well. Danielson gave assurances that such contamination would not happen. Mayor John added that the
City would never pass an agreement that it thought would be harmful to Lake Elmo residents
Mayor John closed the public hearing at 8:10 p.m.
M/S/P DeLapp/Conlin - to approve the grading permit for construction of a swale and storm water
detention pond to reduce the peak discharge from the 3M site based on the recommendation of the city
Engineer in his memo dated May 5, 1997 in accordance with the Joint Powers Agreement, City of Oakdale,
Lake Elmo, and VBWD as stated in letter of April 23'1 from Paul Danielson, Project Manager, including
the condition that working hours shall be limited to those in our code. Paul Danielson stated that the work
should be done by the end of June. (Motion passed 4-0).
B, Response form Oakdale on 40 Street - INFORMATIONAL
At a previous Council meeting, the City Administrator was directed to contact City of Oakdale regarding
their future plans for the improvement of 40th Street. The City received a letter form Craig Waldron, May
15, 1997, stating the Oakdale City Council has directed him to investigate short term improvement options
including converting it to a gravel road or grinding it up and installing a thin overlay. Mr. Bachmeier asked
if Lake Elmo had any interest in assisting them in this mutually beneficial project to contact him. There
was no motion by the Council to do so.

A. Final Plat, HERITAGE FARM, Herzfeld Inc.
The City Council approved the Preliminary Plat and Plan for Heritage Farm on April 1, 1997. A
Resolution approving the Final Plat was provided for Council review,
M/S/P Dunn/DeLapp - to approve Resolution No. 97-22, as amended (PZ recommended approval, place in
chronological order), A Resolution Approving the Final Plat of Heritage Farm subject to the 11 conditions.
(Motion passed 4-0).
Councilman DeLapp left the meeting at 8:55 p.m.

Attorney Fills submitted a DRAFT (Figures were submitted by Mr. Freeman to Tom Prow this afternoon)
Developer's Agreement and explained the Council could approve the contract as presented or approve it
subject to changes, or require them to come back with an updated form. The developer was reminded that
work may not begin until final plat, development contract and letter of credit in place before any work can
be done on the property.
Tim Freeman, Folz, Freeman and Dupay, Assoc., asked that the City leave the assessment figure for 30s`
Street out of the Development Agreement because he feels that 30'h street is a separate project and has not
been ordered yet. Bob Herzfeld stated he didn't bring this up sooner because he thought this could be
discussed at the Assessment Hearing scheduled for October. Attorney Fills explained that this section has
been inserted because in the way this property is being developed will preclude the City assessing any of
that land for improvements to 3& Street unless the City does it right now —that is because it will never
show a special benefit to any of the other properties in that project. This project definitely benefits from
the improvement of 30a' Street.
M/S/P Conlin/Dunn - to approve the Developer's Agreement for Heritage Farm as stipulated by the City
Attorney (Paragraph 4.01 B include completion date of August 30, 1998, 4.01F include a completion date
of November 30, 1997, 4.01G include a completion date of August 30, 1998, estimated costs of
Improvements/Administrative fees in section 4.03: grading $155,000, landscaping $93,000, storm sewer
$60,000, streets $134, 750; street signs $500, water main $99,300; pathway $2,000, Section 4.09
prepayment of special assessments for 30a' Street in the amount of $9,492.00; if the improvements to 301h
Street are not constructed on or before 5 years, the prepaid assessment amount shall be returned with
accrued interest thereon to the developer). (Motion passed 3-0).
B. Modification to Preliminary Plat and Plan, FIELDS OF ST. CROIX:Bob Engstrom
Bob Engstrom, developer of the Fields of St. Croix, agreed to a postponement of the proposed
modifications until there was a full council in attendance or until the next meeting. Mr. Engstom asked the
Council to proceed with Final Plat approval on the preliminary plat approved by the City Council on
February 18,1997.
C. Conditional Use Permit, CSA Farm, Bob Engstrom
The Fields of St. Croix includes the development of a CSA Farm/Wayside Stand. The proposal includes
the sale of produce grown on the farm in this development and other farms in the area. The site plan
indicates two small green houses and a small way side stand where the produce will be sold. The site is
located directly east of the main access road to the Fields of St. Croix. The Planning Commission
recommended approval with conditions on May 12,1997.
M/S/P Dunn/Conlin — to adopt Resolution No. 97-24, A resolution granting a Conditional use Permit to
Robert Engstrom, Fields of St. Croix for a Community Support Agricultural Farm/Wayside Stand in the
Open Space Preservation Zoning District. (Motion passed 3-0).
D. Final Plat, FIELDS OF ST. CROIX, Phase I:Bob Engstrom
The Council did not look at the modifications proposed by Bob Engstrom as he requested, but did proceed
with final plat approval on the preliminary plat approved by the City Council on February 18,1997.
Administrator Kueffner provided a history of the original concept plan, rezoning, preliminary plat and plan
approval in her report in the Request for Council Action. .
M/S/P Dunn/Conlin — to approve the preliminary plat and plan for the Fields of St. Croix, printing date of
plat May 20,1997. 17:43.05, identical to the preliminary plat and plan approved on February 18, 1997.
(Motion passed 3-0).

Attorney Filla pointed out that the Klatts will not be part of the Development Agreement, and the City has
no authority to authorize ghost platting. The Klatt property is already zoned OP and in the future when a
minor subdivision is submitted, the resulting lots have to satisfy the lot requirements. Filla also explained
that the City does not have the authority to transfer density, but would have to adopt special legislation
revising the Open Space Zoning District Ordinance for a density transfer. The developer was reminded that
work may not begin until the final plans, agreements, and financial security have all been approved by the
City.
M/S/P Dunn/Conlin — to approve Resolution No. 97-23, with the modifications, approving the final plat of
The Fields of St. Croix based on its consistency with the preliminary plat approved by the City Council on
February 18,1997, a favorable recommendation of the Planning Commission and the findings stated in the
planner's report. (Motion passed 3-0)..
M/S/P Conlin/Dunn — to approve the Development Agreement for THE FIELDS OF ST. CROIX, as
amended by the City Attorney on May 20, 1997, Footer #C11150966.002. (Motion passed 3-0).
E. Ordinance amending Section on Moving Buildings
City Planner Terwedo explained in her report that Keith Hagberg, who lives in the Old Village, 10807 32" d
Street North, would like to move a garage to his property. The garage is presently located at 3686 Layton
Avenue North approximately 5 blocks from his home, Presently, the City code requires a performance
bond of $100,000 insurance liability coverage of $200,000 and property damage coverage of $20,000. The
code was probably written for those who are moving large houses so this requirement seems quite extreme.
Terwedo would like the staff to have some flexibility regarding the requirements for performance bonds,
insurance liability coverage and property damage coverage for those who wish to move buildings within
the City. A DRAFT ordinance amending the section relating to moving of buildings was provided for
Council review.
M/S/P Conlin/Dunn - to adopt Ordinance No. 9706, amending Section 505.05 SUBD 1 A and B of the
Lake Elmo Municipal Code relating to moving of buildings. (Motion passed 3-0).
F. Ordinance amending Section on Building Permits
M/S/P Conlin/John - to adopt Ordinance No. 9707, as amended, An Ordinance amending Section 400.03
SUED 4 `Building Pemrits" and adding Section 400.03 SURD. 4A. B. C. and D. to the Lake Elmo
Municipal Code. (Motion passed 3-0).
The Council felt it should be their decision as to the number of model homes allowed in each individual
development.
M/S/P Conlin/John - to amend the Development Agreement for Heritage Faun to allow up to (6) model
homes with the consent of the developer. (Motion passed 3-0).
M/S/P John/Dunn — to amend the Development Agreement for Fields of St. Croix to allow (4) model
homes with the consent of the developer. (Motion passed 3-0).
M/S/P Conlin/John — to direct the Planning Commission to make a recommendation on number of the
model homes allowed in each individual development. (Motion passed 3-0).
G. Informational: Letter from Jon Whitcomb regarding TAMARACK FARM
The City received a letter form Jon Whitcomb, May 12,1997, requesting a delay on the hearing date for
Tamarack Farm until the June 3rd meeting because he is still compiling information that will help in the
development of the property.

11. CITY COUNCIL REPORTS:
Mayor John met with Mr. Robert Ballintine, Compass Development, to discuss the conflicts and understand
the proposed project for the St. Croix Valley Sports Complex.
Council member DeLapp and Mayor John attended a joint meeting of St. Croix County and Washington
County at the Phipps Center and discussed preserving the rural atmosphere.
Council member Dunn, Mayor John, and 12 residents walked the proposed development, the Hamlet, and
heard their safety concerns.
12. CITY ADMINISTRATOR'S REPORT:

Administrator Kueffner reported the Departments do not have equipment to loan to Cities Helping Cities.
There was $5,000 designated for donations, $1,000 was designated to the Community Volunteers, leaving
$4,000 in the budget..
M/S/P Conlin/John — to approve a donation of $2,000 out of budget, line item for donations, to Cities
Helping Cities in Red River Valley and flood areas. (Motion passed 3-1:Dunn: the money should stay
within Lake Elmo, personal contributions are fine, help is given from the state, federal, not necessary to
come out of city funds.).
The Council adjourned the meeting at 11:10 p.m.
