Mayor John called the council meeting to order at 7:00 p.m. in the council chambers. PRESENT: Hunt,
Dunn, John, Conlin (arrived at 7:10 p.m.), DeLapp, City Attorney Filla, City Engineer Prew, City Planner
Terwedo and Administrator Kueffner.

passed 5-0).

5. CITY ENGINEER'S REPORT:
A. Road Striping
Tom Prew reported he received a bid and road striping will start next week which includes Lake Jane Trail
A member from the Uniform Traffic Control Advisors committee informed Prew that there is a change in
the policy on striping local roads. The standard skip stripe doesn't meet a passing zone warrant and
shouldn't be striped that way. There are a number of roads that has this skipped stripe. In the future all
roads which are striped should be done in strict conformance with passing/no-passing zone requirements.
This means that most local streets in Lake Elmo which now have a single skip stripe will need to have a
solid double yellow stripe instead.
6. PARKS/MAINTENANCE DEPARTMENT/FIRE DEPARTMENT:
A. Stonegate Trail: Parks Commission recommendation on Phase III of Stonegate
Planner Terwedo reported the Parks Commission recommended accepting $17,000 and trail grading of
Phase II as stated in original Developer's Agreement. The commission did not want to take land instead of
money because they did not see any advantage of taking land --only if they were going to do a nature center.
The land has been under water for weeks and once all the houses are in the runoff with the fertilizer off the
lawns will go into the lake and the City will have no control over that.
M/S/P DeLapp/Conlin — to accept the $17,000 and trail grading of Phase II as stated in original developer's
agreement. (Motion passed 5-0).
B. Stonegate Park Grading: Parks Recommendation
It was the consensus of the Parks Commission that the bids submitted for Stonegate Park grading were
unacceptable. The bids were twice the estimated amount submitted by the City Engineer. Due to the high
bids, it is not feasible to accomplish all phases in the development of Stonegate Park this year.
Commission members agreed having the site graded is a priority. The Parks Supervisor felt if the site was
graded the Parks and Public Works employees could complete the remaining phases and he was requested
to obtain price quotes without going through a bidding process on site grading only. Once cost estimates
are presented and reviewed by the Parks Commission, the Commission will then make a recommendation
to the City Council.
M/S/P DeLapp/Hunt — to reject the bids for grading Stonegate Park because they were exceptionally high
and double the City Engineers estimate. (Motion passed 5-0).
Councilor DeLapp stated that since we have 20'r-o-w he suggested the path meander and be made more
interesting. This suggestion will be brought to Mike Bouthilet's attention by the City Planner.
M/S/P Dunn/Hunt — to amend the agenda and add discussion of water problem on Legion Avenue because
residents on Legion Avenue were in attendance to voice concern over the additional runoff they
experienced that day. (Motion passed 5-0).
PUBLIC INQUIRIES:
Tim Welsh, 2995 Legion Avenue, reported the drainpipe from the Heritage Farms development drains
water into his yard and down Legion Avenue.
City Engineer, Tom Prew explained a heavy rain caused minor flooding to some of the yards on the north
end of Legion Avenue. The developer had graded their plat in accordance with the approved grading plan.
However, the City had not reconstructed 301h Street as planned, and therefore the storm sewers, which
could have carried this additional area, were not in place. The public works dept. can put in a culvert to
drain water under 30`" Street and into Reid Park. Mayor John stated the City never intended to drain water
down Legion Avenue and if we don't get an adequate solution we have to find a means of protection.

M/S/P Hunt/Dunn — to direct the City Engineer and Maintenance crew investigate the water problem on
Legion Avenue with all possible speed to implement the solution and resolve the problem as soon as
possible. (Motion passed 5-0).
Al Henning, 2921 Legion Avenue, asked who sets the grades? Now the house behind him in the Heritage
Development is 6' above grade. Prew will check the grading plan to make sure they are following the
submitted plan. Also there is a new stake 20' west into his property and would like that checked out. Jim
McNamara, Building Official, stated he does not check on the grades when he makes inspections.
Molly Winkels stated this is a delicate area and asked if Legion Pond has been evaluated as to how much
water the pond could hold. Prew responded the Herzfeld property does not increase water to Legion Pond,
but should go to Reid Park.
The City Engineer will send residents in area a letter of the progress resolving the problem.
7. PLANNING, LAND USE & ZONING:
A. (1). Minor Subdivision: Richard Wicka/Frauenshuh Companies and the Northland Properties c/o
United Properties (George Burkards).
This is a request by Richard Wicka/Frauenshuh Companies and Northland Properties/United Properties for
a minor subdivision of a 102.29 acre parcel of land into two parcels of approximately 91.84 acres and 10.45
acres. The property is located on the southeast corner of Inwood Avenue and Hudson Blvd, in the BP,
Business Park Zoning District.
Attorney Filla recommended the Council take action on the minor subdivision and set aside a process for
coming to some reasonable conclusion with the developer on a park dedication fee for this property. It
would be better to take the entire project into consideration and take a look of what they are providing on
site that would fit into the recreational dedication provision so that the credit apply uniformly throughout
the development instead of looking at a parcel by parcel basis. If you look at the overall site, the City may
want a combination of land and money that is a reasonable dedication. This will have to be resolved before
the City can record the resolution.
George Burkards explained when he talked to the City staff they talked about a park and park trail system
where there is a stream through the property and into the culvert, but we have not gone into detail.
M/S/P Hunt/DeLapp — to adopt Resolution No. 97-49, A Resolution granting a minor subdivision to
Richard Wicka/Frauenshuh Companies and the Northland Properties c/o: United Properties (George
Burkards); conditioned upon a park dedication fee of 3% (maximum) of the value of land or cash or
combination to be negotiated by City staff with the Developer/Landowner and agreement approved by the
City Council, a utility easement conveyed to City prior to construction of building based on the Findings in
the City Planner's report and the recommendation for approval by the Planning Commission. (Motion
passed 5-0).
(2) Site and plan Review: East Metro Health, 60,000 sq.ft. medical office building
Richard Wicka, Fruenshuh Company, provided a plan for a medical office building that will contain
various medical offices and clinic uses. The proposal includes a 60,000 sq.ft. medical office building with
248 parking spaces to serve the structure. The building materials include brick with tinted glass. The
proposal is Phase I of a two phase project. Phase II will have an additional 220 spaces. Two signs are
proposed for the site; an entrance sign along Hudson Blvd. (9' in height with a total sign area of 20.5 sq.ft.)
and a wall sign will be placed on the south elevation of the structure (case letters will be 3' in height with a
total sign area of 60 sq.ft.). A lighting plan has been submitted and all lighting distribution will be
contained on site.

Tom Prew pointed out the agreement with Oakdale for water is a temporary agreement. The City should be
aware of this as we develop the I-94 area and should look for a well site in the area. In his opinion, the City
cannot go back and assess this developer for water.
Richard Wicka indicated it is not anticipated for the medical building to be a 24-hr. operation. He is
looking for approval of a Phase I and Phase II operation. Planner Terwedo stated the site is large enough to
accommodate Phase II.
Councilor Conlin would like to have more landscape islands and pointed out the code requires 10% of the
interior of the lot be landscaped and did not feel the proposal met this requirement. Councilor DeLapp
agreed and felt the proposal according to the code was short by 7% of landscape. The City Planner felt the
proposal did meet that requirement.
M/S/P Hunt/John — to approve Case No. SP/97-53 Site and Plan Review for East Metro Health medical
office building and concept approval of Phase II, direct staff to prepare a developers agreement based on
the 8 conditions of approval listed in the City Planner's report with the added conditions: 9. Developer will
meet with the City Planner to determine the feasibility of additional internal landscape islands for parking
lot, 10. Final review and approval by City Engineer for plans and specs, based on the findings stated in the
City Planner's review and on the recommendation of approval by the Planning Commission, (Motion
passed 5-0).
B. Veterinary Clinic Use in General Business, 3417 Lake Elmo Avenue, Zoning Use Determination
Dr. John Baillie, practices at Cedar Lake Pet Clinic in Minneapolis, but lives in Washington County,
explained he had approached the City Planner about an existing building at 3417 Lake Elmo Avenue to
locate a veterinary clinic. A kennel use is allowed by a conditional use permit under the General Business
zoning regulations, but a veterinary clinic is not listed as a permitted or conditionally permitted use in GB.
The proposal has no plans for outdoor kennels and the parking is to be located along the north side of the
site. The Council felt a Veterinary Clinic use in GB for this area was a compatible use and suggested the
Planning Commission and Village Commission looks into amending the GB Ordinance to include this use.
The Council received a letter from Suzanne Kelly, Lake Elmo Mill & Horse Emporium indicated Dr.
Baillie's veterinary clinic which would administer medicine to wildlife and exotic species, which cannot
receive medical attention at most clinics, would be a great asset to this community.
M/S/P Conlin/Hunt— to direct the staff to present this request for a veterinary clinic in General Business at
3417 Lake Elmo Avenue to the Planning Commission and the Village Commission to look into amending
the ordinance to allow a veterinary clinic by CUP in GB and discuss this particular application at this
location. (Motion passed 5-0).
C. Final Plat, Tamarack Farm: Jon Whitcomb
Jon Whitcomb provided a final plat for Tamarack Farm Estates for Council review and approval.
The development agreement will be submitted at the next council meeting for approval. Tom Prew
approved the wetland treatment design. hi the development agreement the barn will be preserved.
M/S/P Hunt/Conlin — to adopt Resolution No. 97-50, A Resolution approving the Final Plat of Tamarack
Farm Estates conditioned upon the development agreement approved by the City Council and a park
dedication fee of $12,740. (Motion passed 5-0).
D. Final Plat, the Hamlet of Sunfish Lake: Toby Schifsky
Jack Buxell, Buxell Architecture, submitted a Final Plat for The Hamlet of Sunfish Lake for 41 single
family lots, a DRAFT developer's agreement and a letter from the DNR approving the project subject to
conditions.

Kos Tautvydas, Chair of Parks, voiced his concern on high cost of putting in trail (Base class 5), how long
and wide the trail is and is $45,000 enough. Attorney Filla asked if privately maintaining public trails is
going to be City policy and would there be indemnification. Filla will contact the League of MN Cities to
get their opinion.
M/S/P Hunt/DeLapp — to adopt Resolution No. 97-51, A Resolution approving the Final Plat of the Hamlet
of Sunfish Lake, as amended #4. Outlets A, B, C, D, G, H, K, and J shall be held by a conservation
easement to a qualified Land Trust, #5. Outlet F, G, H J, K shall have an open easement to the City of Lake
Elmo. Outlets E & I dedicated to the City based on the consistency to OP ordinance and Comprehensive
Plan. (Motion passed 4-1:Dunn: Concerned about a dense residential development in a wildlife area, the
close proximity of the development to the lake will damage the surrounding environment, the trail issue is
not resolved. The project will be a beautiful development, but is not appropriate for this specific
environmental area.)
E. Use of Jamaca Avenue by Shafer Mining
The City has received complaints on Shafer Mining belly trucks driving on shoulders and leaving dirt on
Jamaca Avenue. City Engineer, Tom Prew, explained there is a single lift asphalt on shoulder, but the road
has double lift of asphalt —this could reduce useful life of road. Jim McNamara, Building Official, stated
the City has received a couple of complaints this year and last year and suggested added language that the
street needs to be cleaned every day that the pit is used. Any change to the CUP would require a public
hearing. Mayor John and Council member DeLapp also have received complaints and the few complaints
to City Hall were not indicative of the irritation people feel when they drive that roadway.
Scott Spisak, Shafer Mining, said the trucks are hauling clay that is very sticky and gets caught in the
truck's tire treads and then tracks the road. They have tried to use a different traffic pattern in the pit, swept
every night this week and will continue to sweep daily to show the City Shafer Mining can be a good
neighbor. He would meet with staff to add language to the CUP.
Councilor DeLapp's concern is for health, safety, and welfare of the residents. You cannot ride your bike
on the side of the road because the bumpy condition of the road makes it unsafe. Now, you have to go into
the middle of the road. Mayor John added if Shafer Mining is able to make a goodwill effort for the rest of
the season then that is something the Council could look at.
F. Omission from code of driveway restriction in RE zoning district
It had been brought to staff's attention that the change made to the width of driveways was not included in
the recodification. The change specifically related to the width of driveways in the RE Zoning District,
Section 1405 of the Code, can be amended without a public hearing. Since this was an oversight, the
Administrator recommended that the draft ordinance be adopted.
M/S/P Hunt/DeLapp - to adopt Ordinance 9718 amending Section 1405.07 Subd. 1. Of the Lake Elmo
Municipal Code relating to the width of driveways in the Residential Estates (RE) Zoning District. (Motion
passed 5-0).
G. Zoning Text Amendment, Shoreland Ordinance
A public hearing was held at the September 8,1997 Planning Commission meeting. The Commission
recommended the Council approve the amended ordinance.
M/S/P DeLapp/Conlin — to adopt Ordinance No. 9716 an Ordinance amending Section 325.05 Shoreland
Classifications Subd. 2. LAND USE REGULATIONS MATRIX; Section 325.06 Shoreland Standards
Subd 2A. MINIMUM LOT AREA CLASSIFICATOINS and 325.06 Subd 3. Lot Width — No Sewer.
(Motion passed 5-0).

H. Zoning Text Amendment, Lighting Ordinance
As directed by the City Council, a subcommittee was established, consisting of Ed Stevens, Margaret
Carlson, Tom Armstrong, to study and prepare a lighting ordinance for the City. Ed Stevens contacted the
International Dark Association who provided the City with information. The Committee also used a model
ordinance from the City of Northfield. The DRAFT ordinance regulates lighting in the City, specifically,
free-standing light fixtures. The New England Light Pollution Advisory Group and the International Dark
Sky Association will be included with each building permit application. At the September 8th meeting, the
Planning Commission held a public hearing and recommended the Council approved the amended
ordinance.
M/S/P DeLapp/Hunt — to adopt Ordinance No. 9717, An Ordinance amending Section 1350 of the 1997
Municipal Code relating to lighting, glare control and exterior lighting standards including the guide to
"Good Neighbor Outdoor Lighting, May 1995" and the building official will review residential for lighting
compliance. (Motion passed 5-0).
I. Update on discussion with Jane Harper
Planner Terwedo discussed transfer of development rights with Jane Harper, Washington County, and she
will find out how to start the process.
8. UNFINISHED BUSINESS:
9. CITY COUNCIL REPORTS:
Mayor John attended the reception for Superintendent Macy, S.A.H.S, and talked to two school board
members (one was Melva Radtke) who did not support dense housing across from the high school.
The Administrator, Planner and Mayor met with the Community Development Committee of the Met.
Council on the proposed annexation of 235 acres of Baytown Township by Oak Park Heights and felt the
committee wasn't sympathetic toward Lake Elmo and Baytown and would recommend that the area be
annexed to Oak Park Heights.
Councilor Hunt asked that the City Administrator set a workshop with the Maintenance Dept. and City
Council to discuss issues and concerns. A public meeting on I-94 will be held on November 3rd. Hunt
suggested a workshop to discuss how to implement and prepare for public discussions and extend an
invitation to our neighbors for this meeting.
Councilor Dunn indicated she didn't know the water agreement between Lake Elmo and Oakdale for along
I-94 was temporary and after 5 years Oakdale has to give Lake Elmo a one-year notice.
Councilor DeLapp pointed out the sign for Metro Health is seven times smaller than Torre Pines sign.
10. CITY ATTORNEY'S REPORT:

11. CITY ADMINISTRATOR'S REPORT:
A. Follow-up to 1998 Budget Workshop
Prosecution services:
M/S/F Conlin/DeLapp —to direct the staff to prepare a R.F.P. for prosecution services. (Motion failed 1-
4:John, Dunn, DeLapp didn't know the City didn't have an RFP existing, thought we did this every year,
Hunt felt it will take time to prepare an RFP, he likes the continuity of having Attorney Filla for seven
years.)

Animal Control:
M/S/P Hunt/DeLapp to direct the staff to review policy for animal control and recommend any changes.
(Motion passed 5-0).
Recycling:
Administrator Kueffner explained the City could bill residents for recycling because Cindy now has
everyone on-line or the hauler could bill accordingly. The Administrator will research and get back to the
Council. DeLapp reminded the Council that this is a service the residents do get.
B. Reimbursement for Fire Department runs to Lake Elmo Park Reserve
M/S/P DeLapp/Hunt — to direct the staff to bill Washington County for Fire Department services in the
Lake Elmo Park Reserve for 1995, 1996 to cover the costs of the Fire Department. (Motion passed 5-0).
Do we get a cut from county tickets in the Lake Elmo Parks Reserve. Administrator Kueffner will look
into the tickets the Deputies write in the park and feels this is similar to the Fire Department.
Councilor Dunn reported the alarm keeps going off from one to two times a week on the off -site septic
system in her area and asked for a list of people who she can call in an emergency.
