Mayor John called the Council meeting to order at 7:00 p.m. in the Council chambers. PRESENT: Hunt,

4. PUBLIC INOUHUES/INFORMATIONAL:
A, Public Inquiries
John Oldendorf, 5418 Lake Ehno Avenue N., explained County Road 17 is a dangerous road in that cars
are going 70 mph. He has yet to see a Sheriff stop a vehicle in the 5 years he has been living there. If the
road is redone, he suggested the paved shoulders be designated as bike trail lanes so cars do not use them
for passing. There is not a school zone sign on CSAH17 by the Lake Elmo Elementary School.
Administrator Kueffner responded she could add to the next agenda the number of tickets issued by
Washington County Deputies on CSAH17.
The Council received a letter from Donald Wisniewski, Washington County Public Works, explaining the
project information and alternatives for the 1998 Preservation Project on County State Aid Highway 17.
The entire project would be completed in four weeks or less and is now scheduled for May 5, 1998. In
1994, a letter was received from a resident requesting the County consider paving CSAH 17 shoulders "to
encourage alternate transportation methods to reduce the use of cars". The preservation project includes
the paving of the existing eight -foot gravel shoulders. The speed limit will remain 55 mph. The
construction of a separate pedestrian/bicycle trail can be considered in the future. Right-of-way will be
needed. County policy requires City acquisition of right-of-way and fmancing of 75% of the project cost.
The County is willing to remove this project from their 1998 program if the Council so requests.
M/S/P Hunt/John — to direct the staff to forward a letter to Washington County requesting a meeting
between Lake Elmo and the Washington County Public Works to discuss postponement of the CSAH17
overlay until 1999 to give the City time to complete the work on the Village Plan and to study options for a
pathway system. (Motion passed 4-0).
B. Washington County Juvenile Curfew Ordinance: Washington County Attorney's Office
Washington County is attempting to impose a Countywide Juvenile Curfew Ordinance. Richard Hodson,
County Attorney's office, represented the County in this effort. He has to report back to the Board by the
end of April. The City already has adopted a Juvenile Curfew Ordinance, based on input from the Deputies
that included a particular request for regulation of 17-year olds. Attorney Filla pointed out it would make
sense for all Washington County's contract cities have the same regulations.
M/S/P Hunt/Johnston —to direct staff to contact Washington County Deputies assigned to Lake Elmo to
solicit input for possible reconciliation between the Lake Elmo and Washington County's curfew ordinance
and have a representative appear at the next meeting for direction on how to proceed. (Ask Washington
County to clarify age limits and adult accompaniment from legal standpoint, include defense section from
County ordinance into the City's ordinance). (Motion passed 4-0).
C. Landfill Update: Nile Fellows, MPCA
Nile Fellows, MPCA, submitted the 1997 Annual Report of the Washington County Sanitary Landfill SW-
001 and gave a landfill update. Councilor DeLapp stated the landfill area is a very visible site. He asked if
we could do something with the land, such as, tying the Gateway trail into our City Park and the Regional
Park. Mr. Fellows responded they would work with the City, look at uses, and get ideas from City for a
park or provide habitat for wildlife when deemed feasible.

M/S/P Hunt/DeLapp — to direct the staff to send an official letter to the Nile Fellows, MPCA, offering to
work with them on alternate land uses and the land reclamation project for the Lake Jane landfill area.
(Motion passe 4-0).
D. Arbor Day Proclamation
MAYOR JOHN PROCLAIMED APRIL 24, 1998 AS ARBOR DAY IN THE CITY OF LAKE ELMO
AND URGED ALL CITIZENS TO CELEBRATE ARBOR DAY AND TO SUPPORT EFFORTS TO
PROTECT OUR TREES AND WOODLANDS, AND URGED ALL CITIZENS TO PLANT TREES TO
GLADDEN THE HEART AND PROMOTE THE WELL-BEING OF THIS AND FUTURE
GENERATIONS.
E. Ramsey/Washington Cable Commission update: Cable Rep. Ginny Holder
Ginny Holder, Cable Representative, updated the Council on the progress of the franchise renewal, referred
to the Annual Audit Report, and gave background on area cable TV ownership. The Cable Commission has
asked the City to adopt the submitted ordinance amending the franchise term.
M/S/P Hunt/Johnston — to support actions of the Ramsey/Washington Cable Commission to become
involved in non -local investing of funds. (Motion passed 4-0).
M/S/P Hunt/Johnston — to adopt Ordinance No. 9727, An Ordinance amending Cable Franchise Ordinance,
Article 4, Section 4.04 Franchise Term. (Motion passed 4-0).

Tom Prew distributed the Feasibility Report for the proposed 1998 Street Overlays.

Jamley Avenue and to call a public hearing on said improvement for May 5, 1998 at 7:00 p.m. (Motion
passed 4-0).
M/S/P Hunt/DeLapp — to adopt Resolution No. 98-19, receiving the Feasibility Report for the Overlay of
Lake Jane Court and to call a public hearing on said improvement for May 5, 1998 at 7i00 p.m. (Motion

7. MAINTENANCE/PARKS/FIRE:
A. Ordinance amending Section 600 of Lake Elmo Code; Conversion from Touch Pads to Radio

Administrator Kueffner reported that the Finance Director was not aware of the December 2, 1997 proposal
made by Ed Wiegert and asked for postponement. The Council received a DRAFT revision to Section 600
of the Lake Elmo Municipal Code relating to Water
M/S/P Johnston/DeLapp — to direct the staff to prepare the appropriate ordinance reflecting changes to
Section 600 of the Lake Elmo Municipal Code. (Motion passed 4-0).
8. PLANNING, LAND USE AND ZONING:
A. PUBLIC HEARING: (After -the fact) Grading Permit: Boris Beckert, 3036 Inwood Avenue N.
City Planner Terwedo reported the grading application, as submitted, indicated that Boris Beckert, 3036
Inwood Avenue N., has moved 450 cubic yards of fill to create a berm along the south property line and to
the north of the entrance drive. As viewed from a home in Beau -Haven, the berms are a steep shelf, which
have impacted the view of the north and are a harsh visual impact to the area. The City Engineer has
reviewed the plan and commented on the drainage issue in his memo dated March 5,1998.
Mayor John opened up the public hearing at 8:30 p.m. in the Council chambers.
Boris Beckert, with the help of architect, Todd Drescher, explained the project is not complete and is being
worked on in a step -like fashion. The berms would be broken down, would not cause any drainage
problems or ponding on the adjacent property to the South. Yardmaster provided a landscape diagram
showing where they would plant prairie seed mix and wildflowers. This would look like a rolling prairie lot
and would increase property values. According to the way he interprets the Code, a public hearing was not
necessary because they were only moving 450 cubic yards over a 4.3-acre site.
Burt Price, 8384 Stillwater Blvd., (adjacent property owner to the South), indicated Mr. Beckert
constricted the berms without a permit, the beans were very abrubt, ugly, and changed the natural flow of
water and forced water to stay on his property. This would decrease his property value. He could not see
any purpose served by the berms and asked to have them removed.
Brad Krank, 3082 Inwood Avenue N., stated, as a neighbor, he had no objections to the project and no
problem with the berms.
Mayor John closed the public hearing at 9:10 p.m.
Mr. Beckert and Mr. Price indicated they would work toward an agreement requiring the berms to be cut
down, the natural drainage not blocked by the berms, and no pending on the adjacent property to the south.
M/S/P Hunt/DeLapp — to postpone consideration of a grading permit for Boris Beckert, 3036 Inwood
Avenue N., until such time the City Administrator arrange a meeting with staff and interested parties to
settle the differences and come up with an amicable agreement and then bring back to the Council.
(Motion passed 4-0).
B. Grading Permit for Wildflower Shores: Rehbein
City Planner Terwedo reported the City approved the preliminary plat and plan for Wildflower Shores on
March 2, 1998. An element of the plan is the creation of a pond area located on the southwest portion of
the site. This pond will be both a stormwater detention area and eventually a wetland. Attorney Filla stated

if Imation is going to allow more water than what the City agreed to, Lake Elmo should be notified. The
City cannot unilaterally make any changes to the agreement we have with 3M and Oakdale. Mr. McCulley
voiced his concern if the City of Lake Elmo would approve an amendment to the Joint Powers Agreement
for Oakdale, 3M, to purchase storage capacity, the Association would not be involved. The City has a
formal agreement with Oakdale and VBWD stating that runoff from Imation land and entering 3M property
in Lake Elmo will not leave that property without meeting our rate and volume requirements. Filla
responded that this is private property and didn't think that Imation, VBWD, or the City can respectively
use this for a public purpose without acquiring some additional rights from the owner —so the Association
would have to be involved. Filla voiced concern of having the VBWD added to this discussion because the
City has not been made aware of VBWD's plans in using this property.
M/S/P Hunt/Johnston - to approve the grading permit requested by Glen Rehbein Excavating, Inc. for
Wildflower Shores, based on the grading plans prepared by Glen Rehbein Excavating, dated March 10,
1998, and made part of this permit, based on the recommendation of the City Engineer, to include the 15
conditions, as amended. (Motion passed 4 —0).
C. Ordinance declaring moratorium in PF zoning districts
Planner Terwedo reported the Council directed the staff to prepare an ordinance establishing a
Development Moratorium in the PF Zoning District. The Planning Commission has reviewed the PF
ordinance and recommended modifications as outlined in the PZ minutes of March 23, 1998. The Planning
Commission discussed the 15-acre parcel of land along 1 Oh Street and recommended that the long-range
plan for the area be directed as Open Space Development Area due to adjacent land uses.
M/S/P DeLapp/Hunt — to adopt Ordinance No. 9728, An Interim Ordinance Placing a Development
Moratorium on Property Located Within the Public Facility (PF) Zoning District of the City. (Motion
passed 4-0).
M/S/P DeLapp/Hunt - to adopt Summary of Ordinance No. 9728 establishing a Development Moratorium
in the (PF) Zoning District. (Motion passed 4-0).
D. Extension of filing of Final Plat: Meehan Family
Torre Pines was given preliminary plat approval in July 1998, and final plat approval for all but the three
lots in September 1995. The City was informed at that time that Mr. Meehan would continue to live in the
existing home on the 10 acres, and that the final plat for these four lots would not be done at this time. The
Meehan's are requesting another one-year extension. Our Code allows for this extension, but requires
Council approval on a yearly basis. The staff had no concerns and supported the request.
MIS/P DeLapp/Hunt — to grant the Meehan's a one-year extension of the final plat of Torre Pines,
specifically, the parcel now shown as Lot 15. (Motion passed 4-0).
E. Direction of Enforcement
Administrator Kueffner asked the Council if it wants staff to come on weekends and enforce the current
sign ordinance and remove the temporary "flip" signs out of the right-of-way. Councilor DeLapp
explained, several years ago, Dakota County had a $10 fine for each sign. Temporary signs in the right-of-
way are against MSA regulations. These people would be guilty of a misdemeanor. Attorney Filla
suggested attaching a notice stating placement of the sign is against the following sign ordinance, and the
signs will be removed and taken to City Hall. Councilor Hunt suggested having a policy requiring the
Maintenance crew look out for these signs during normal work hours, tagging them, and notifying the
developer by letter. The Council suggested the staff thinks about this and come back with a method of
enforcement and find out how Dakota County enforces their regulations. Administrator will check with the
County if picking up these signs in the County right-of-way would be considered stealing by the City.

program for enforcement of these temporary signs. (Motion passed 4-0).
F. Letter from Doherty, Rumble & Butler
The Council received a letter dated April 7, 1998 from David Sellergren, Doherty, Rumble and Butler with
a request for sewer and water signed by owners of property located within the I-94 Corridor Study Area.
Attorney Filla told the Council that the request was not an official legal petition, but the Council should not
ignore the request. The Council suggested waiting until after the I-94 Task Force meeting on Wednesday,
April 8, to see if a decision is made about whether it is going to try to accommodate this request in some
manner. Then the Council will schedule time for discussion at a regular Council meeting and decide if we
are going to meet with our neighbors.
9. CITY ATTORNEY'S REPORT:
Attorney Filla reported that on February 18' the Municipal Board made a preliminary decision on
annexation of 240 acres. The Board asked Attorney Magnuson to prepare a legal description, which
included Kern Center and Kern Center II. The response we made to the Municipal Board was it included
Kem Center, Kern Center II, and Stillwater Motors. Attorney Vierling, OPH, responded to the Board he
thought they mistakenly excluded the Ag zoned Buberl property. Filla responded it was intended to include
Kern Center, Kern Center II and Stillwater Motors, not the Buberl property. This was scheduled to be
resolved on April 3`d, but has been continued to April 17`h. On March 2nd, Lake Elmo received a letter from
the Community Development Division of the Metropolitan Council, stating if this property goes to Lake
Elmo as the Board has preliminary decided, it can be developed; either connected by sewer or at a rate of
one unit per 40 acres. The Screatons have now requested the Hearing be reopened and argue that they have
no use of their property because this property can only be one unit per 40 acres or included in the MUSA.
On April 17d, the Municipal Board will take up the issue of the legal description and come to a conclusion
whether to allow the hearing to be reopened to accept additional information on this issue. If they decide to
allow the Hearing to be reopened, another date will be scheduled.
M/S/P Hunt/Johnston — to direct Attorney Filla to respond to Attorney Scott McDonald's motion of April
3'd, before the deadline of April 10, 1998 asking for background for this letter, why and when was it written
and who decided to do this. (Motion passed 4-0)
10. UNFINSIHED BUSINESS:
11. CITY COUNCIL REPORTS:
Councilor Hunt will be meeting with the Human Rights Commission.
Councilor Johnston attended the General Government Subcommittee that had a discussion on how to
combine the Boards. Baytown would have a representative through the ward system. The next meeting is
scheduled for April 20th, 7 p.m., at the Civil Air Patrol Hanger.
12. CITYADMINISTRATOR'S REPORT:
A. League of Minnesota Cities Annual Conference
Mayor John and Councilor Hunt indicated they would be attending the League Conference on June 16-19
in Duluth. Councilor Johnston will not attend the conference and Councilors Dunn and DeLapp will call
the staff if they decide to attend.
B. Budget and Payroll (postponed until April 21, 1998)

C. Letter of Resignation from City Planner
The City received a letter of resignation from City Planner, Ann Terwedo, and effective April 30, 1998.
She has accepted a position with Washington County, but offered to continue working in a professional
capacity with the transition for completion of the I-94 Corridor and the Village Plan. Mayor John stated
Ms. Terwedo would be missed because of the tremendous amount of effort she gave the City. She has been
a major asset to the City as it has developed.
M/S/P Johnston/DeLapp — to direct the City Administrator to advertise for a City Planner position as
discussed (Change salary to "up to $37,000 depending on qualifications."). (Motion passed 4-0).

The Lake Elmo City Council held the local Board of Review from 4 until 6 p.m. in the City Council
Chambers. PRESENT: CITY COUNCIL:John, Hunt, DeLapp, Dunn; LAKE ELMO TAX ASSESSOR:
Frank Langer ABSENT: Councilor Johnston.
