LAKE ELMO CITY COUNCIL MINUTES MAY 5, 1998
Mayor John called the Council meeting to order at 7:00 p.m. in the Council Chambers. PRESENT: Hunt,
Dunn, John, DeLapp, City Attorney Filla, City Engineer Prew, Building Official, Jim McNamara and
Administrator Kueffner. ABSENT: Councilor Johnston

4. PUBLIC INQUIRIES/INFORMATIONAL:
A. PUBLIC INQUIRIES
Mayor John acknowledged and will respond to a letter from Eric Hills, 4455 Olson Lake Trail, and
requesting consideration of a bike path separate from the road to join the State Trail because Olson Lake
Trail is very curvy with a high speed limit. He likes to go on bike rides, but his mom is scared a car might
hit him. Mayor John will write a letter to Washington County Public Works Dept. requesting a meeting to
discuss options to improve road safety.
B. Juvenile Curfew Ordinance (WCSD)
M/S/P Hunt/DeLapp - to postpone consideration until Captain Johnson is in attendance. (Motion passed 4-
0).
C. Heritage Farm Homeowner's Assoc.
Board members of the Heritage Farm Homeowner's Assoc. were introduced and reported the association
had an organizational meeting, has put out a monthly newsletter, and looks forward to working with the
City in the future. Bob Herzfeld pointed out the support for the quality of the Open Space developments
the City has put together and spoke of the great interest he has received for purchasing lots.

6. CITY ENGINEER'S REPORT:
A. PUBLIC HEARINGS: 1998 Overlays: The public hearing notice was published in the April 21,
1998 Stillwater Gazette and the April 29, 1998 Stillwater Gazette Extra. All affected property
owners were notified. The 1998 Overlay public hearings help the engineer understand what
construction concerns the property owners may have about the project.
Tom Prew, City Engineer, reported the City staff evaluates the condition of the City streets and
recommends to the Council the streets, which need a bituminous overlay. A bituminous overlay will
generally extend the life of a street about 15 years. In 1995, the City adopted a uniform assessment policy.
Under this policy each parcel along a street receiving a major maintenance or complete reconstruction
receives the same assessment. This assessment amount is equal for all assessed parcels in any given year.
The assessment amount is adjusted for inflation each year. The proposed 1998-assessment rate is $1,071
per unit for an R-1 lot, $1,285 for a RE lot, and $1,500 for a RR lot.

(1) Stillwater Lane
This street is currently concrete surfaced over a majority of its length and is in poor condition. As a test
project, the City overlaid a three hundred -foot section of it two years ago. To date, the bituminous has
shown no sign of premature break up. Prew is recommending a 1 %:-inch bituminous leveling mix for
2500-foot length of this street and 1 %a -inch bituminous wear course over the entire street, excluding the test
project section. Gravel shoulders would also be constructed.
Mayor John opened the public hearing at 7:30 p.m. in the Council chambers
Bob Taverna, 10174 Stillwater Lane, explained from Kelvin to the west, the shoulders are blacktop to the
end of his driveway. The water comes down onto his driveway because it is the low point and asked if the
engineer could take a look at it.
Miriam Bergmark, 10032 Stillwater Lane, asked how does the City assess. City Engineer Tom Prew
explained the assessment policy. (Copies of the assessment policy were made available to residents.)
Pat Dean, 8028 Hill Trail N., asked what if sewer comes in, how would the City assess the residents.
Would assessments be different for overlays? Does this start a precedent? Administrator responded there
are no plans for sewer. The City can only assess the cost of project to the extent of the benefit received.

(2) 10fl' Street Lane
This street is currently in very poor condition. Instead of an overlay, Prew recommended cold milling the
existing surface and recycling it in place as gavel based. Additional gavel would be added as necessary. A
2-inch thick 22-foot wide bituminous surface would be constructed over its 800-foot length. Gravel
shoulder would also be constructed.

(3) Jamley Avenue N.
Jamley Avenue is approximately 1800-feet long and about 20-feet wide. There is significant cracking
along the entire length, and it has reached the stage where it is in need of an overlay. A 2-inch thick
overlay is proposed. Earth shoulders would also be constructed.
Mayor John opened the public hearing at 7:47 p.m. in the Council chambers
Russ Loetscher, 3053 Jamley Avenue N., explained he has a problem with runoff and drainage. The ditch
is real high and his property takes on water and ends up with a large lake in his front yard.
Elizabeth Arco, 2809 Jamley Avenue N., asked why does Jamley Avenue have to be repaired now. She
understands the road was never done properly. Prow responded it is time for an overlay now and doesn't
want to wait for the street to become in worse shape.

(4) Jane Court N.
This street has reached the stage where it is in need of an overlay. There is significant cracking on the
eastern 700-feet of the street. The street is about 24-feet wide. A 1 %a -inch overlay is proposed on the
western 800-feet of the road, up to Jane Circle. West of Jane Circle, a 2 %-inch overlay is proposed. Each
shoulder will also be constructed. The two catch basins near the curve will be rebuilt, with new flumes
constructed around them. They will pave a small area off the side of the road for children to wait for the
school buses.
Mayor John opened the public hearing at 7:54 p.m. in the Council chambers.
Charles Altstatt, 9330 Jane Court N., explained on the hill that goes down there is a sinkhole. The drainage
comes into his front lot and asked if the City could put a black top ditch or culvert to divert the water to a
proper area. Would he be assessed for Outlet B, which is an unbuildable lot? Prew responded that an
unbuildable lot is not assessed. If it is used as a recreational lot, it may be assessed.

(5) 33rd Street Lane
At one time this street had a bituminous surface. However, the old surface was milled up because of its
very poor condition. The street has remained gravel since then. A 3-inch thick, 22-foot wide street is
proposed. The street is about 900-feet long. Earth shoulders would also be constructed.
Mayor John opened the public hearing at 7:57 p.m. in the Council Chambers.
John Heroff, 10925 33 d Street Lane N., currently seven residents use this street, but there is actually 5
residents that have 33`d Street Lane as their addresses, how would they be assessed? Prew responded he
goes off of the addresses they use.

(6) Hill Trail N.
This street has reached the stage when an overlay is necessary. A 2-inch thick overlay is proposed. Earth
shoulders would also be constructed. As part of this project, the City Staff has recommend that right-of-
way survey be conducted to determine the exact location of the street within the right-of-way.
Mayor John opened the public hearing at 8:01 p.m. in the Council Chambers.
Rodney Harvey, 7949 Hill Trail Court N., felt that he should not be assessed because he did not have
frontage on Hill Trail. Hill Trail Court N. is a dirt track. His mailbox sits on Hill Trail N.
Norm Purrington, 8000 Hill Trail N., questioned if an overlay is necessary because he does not see the
deterioration. He moved to this area for the rural nature and does not want the improvement. He would not
want to see the lawns, decorative planting, stone walls, that have been placed in the right-of-way be
disrupted. Cars would be parking along his property that cannot fit into the lake access parking. Concern of
widening the road would increase speed. It needs a speed limit change to 15 mph. Why should the
residents pay for a new survey if the road was put in wrong twenty years ago. Tom Prew responded he
would like the overlay before the road looses its structural integrity. The survey will be paid by the City
and not by the project.
George Taylor, 7925 Hill Trail N., wonders if it is really necessary to improve the road, He knows the road
is not in the proper location. How is the City gong to straighten the road out. The drainage on the hill
towards Purrington's is terrible. The shoulders are being washed away on both sides of the road in front of
his house.

Pat Dean, 8028 Hill Trail N., stated his driveway takes up the brunt of the water and asked this to be looked
at. He felt the Hill Trail N. residents were paying more to compensate for some other project in the City.
Prew responded that individual streets are lumped together so to bid them collectively so everyone gains.
Everyone drives on all the roads in Lake Elmo --You just don't drive on your road.
Ken Isaccson, 8190 Hill Trail N., asked if he would be assessed for his recreational lot. Also, he has a
buildable lot across of the road. He has a concern on speeding. He has a bad erosion problem because the
resident living at 7851 50th Street has blocked the drainage. The ditch has been filled and water goes into
his boat launch. He asked the City Engineer and Maintenance Foreman look to see what can be done about
it and look at the activities of the property owner at 7851 50" Street
Allen Siedle, 7951 Hill Trail Court N., felt improving the street is premature and unwarranted. He is
particularly concerned on the issue of shoulders. Everyone has lawns to the street, and he prefers to see it
rural. He should not be assessed because he lives on Hill Trail Court. The City should save money for a
survey until its needed rather than to satisfy curiosity.
Daniel Lindstrom, 7959 Hill Trail Court N., stated he couldn't believe the City would assess Hill Trail
Court N. Prew responded the Council determines if Hill Trail Court N. will be assessed when the Proposed
Assessment Hearing is called and the property owners will be notified.
Councilor DeLapp felt another issue needed to be addressed and that is why are we allowing Hill Trail
Court North to exist as a dirt road serving four residents when we have a paved road serving five residents?
Why wouldn't Hill Trail Court N. be the first part of the project?
(7) 33`d Street and Laverne Avenue N
These streets are in poor condition. Because these streets are on the City's Municipal State -Aid Street
system, Prew is recommending that a 1 %z-inch of bituminous level mix and wear course be performed to
delay the need for a total reconstruction. This project is not proposed to be assessed. Funding will come
from the City's MSA Maintenance account.
(8) Fire Station and Parks Department's Lot
The fire station parking lot is in poor condition, as is the parks department's. At the Fire Station, it is
proposed to cold mill and salvage the existing bituminous and base in the parking lot. The parking lot
would then be subcut and 9-inches of gravel base constructed. 1 '/2-inches of bituminous base and wear
courses would be constructed. Striping of the lot would then be done. At the parks building, the front
parking lot and the west driveway would be overlaid with 1 %a -inches of bituminous striping of the lot
would then be done. The project is not proposed to be assessed. Funds would come from each
department's budget.
When Mayor John asked if paving the parking lots would be under the Moratorium for the Village Study
Area, Prew felt the Ordinance specifically allowed paving of parking lots. If need be, he could wait until
August when the Moratorium is scheduled to be lifted.
M/S/P Hunt/DeLapp -- to approve the 1998 Overlay project with the option of the Hill Trail portion of the
project be bid as an additional alternate and to direct the City Engineer to visit with the residents (Dean,
Isaccson, Purrington) with drainage problems. (Motion passed 4-0).
Tom Prew requested approval of plans and specifications and order the advertisement for bids for the
combined 30d' Street Reconstruction, 1998 Overlay Project and the Janero Avenue Improvements. To
reduce costs, he is bidding all three projects under one contract. All of these plans are complete and are
ready to be bid.

of Plans and Approving Plans and Specifications and Ordering Advertisement for Bids for the 1998
Overlay Project. (Motion passed 4-0).
M/S/P Hunt/DeLapp - to approve Resolution No. 98-29, A Resolution Approving Plans and Specifications
and Ordering Advertisement for Bids for 30`s Street from Lake Elmo Avenue (CSAH 17) and Manning
Avenue (CSAH15). (Motion passed 4-0).
M/S/P Hunt/DeLapp — to approve Resolution No. 98-30, A Resolution Approving Plans and Specifications
and Ordering Advertisement for Bids for Janero Avenue North. (Motion passed 4-0).
Tom Prow reported he would open bids on May 29 and award the 3& Street and the Overlay Project on
Tuesday, June 2, 1998. For Janero Avenue, he plans on holding the assessment hearing before awarding
that portion of the contract. This will allow the property owners on Janero Avenue an opportunity to
comment on the assessable cost, prior to the Council awarding a contract.
M/S/P Hunt/DeLapp - to approve Resolution No. 98-31, A Resolution for Hearing on Proposed Assessment
for Janero Avenue. (Motion passed 4-0).
B. Resolution declaring 501" Street as MSA Street
The City wanted to add 50 Street, from CSAH 17 to TH5, to our State Aid System, but a portion of the
right-of-way was in Baytown. The annexation issue with Baytown and Oak Park Heights is now resolved.
Tom Prow has received preliminary approval of this route from MN/DOT. Final approval is subject to the
final annexation paperwork being submitted. On March 2nd, the Council postponed consideration of
designation of 501° Street to our State Aid System.
M/S/P Hunt/Dunn — to postpone until May when the staff can invite new residents and allow Baytown
Township time to react to adding 50th Street as an MSA Street. (Motion passed 4-0).
7. MAINTENANCE/PARKS/FIRE/BUILDING:
A. Hiring of Summer Help
Mike Bouthilet has advertised for summer help. He would like Council approval to hire Danny Olinger, to
start immediately, and Bill Leary, at $7.00 per hour and bring back a third recommendation to the Council
at its next meeting.
M/S/P Hunt/DeLapp, to approve hiring of Bill Leary and Danny Olinger as part-time workers in the Parks
Department at a wage of $7.00 per hour based on the recommendation of the Parks Supervisor,
acknowledging they have worked for the City before in this capacity and authorize the Parks Supervisor
hiring a third part-time employee when suitable. (Motion passed 4-0).
B. Set workshop with MAC:Lee Hunt
M/S/P Hunt/DeLapp — to direct the staff to arrange a workshop date in June between the Maintenance
Dept, MAC, City Council, Facilities Study Committee, City Engineer to discuss the Capital Improvement
Program, a road replacement program, and status of new building. (Motion passed 4-0).
8. PLANNING, LAND USE, AND ZONING:
A. PUBLIC HEARING: Street Vacation: 7978 Hill Trail N., Applicant: James Tierney
A public hearing has been called to consider the request of James and Debbie Tierney for the vacation of a
portion of Hill Trail N. (the city right-of-way). The notice of the public hearing has been published in the
April 22, 1998 Stillwater Gazette and the affected property owners were notified. The Tierney's, who
recently purchased the house at 7978 Hill Trail, need this area to replace the existing septic system.

There was no one to speak against the requested vacation.
Mayor John closed the public hearing at 9:10 p.m
In letter dated April 24, Tom Prew recommended approval of this request with the following conditions: 1.
The applicant shall provide a legal description of the property to be annexed, 2. The applicant shall have
property corners placed on the vacated property.
Attorney Filla suggested adding a third condition: 3. If the survey were to indicate the road is actually
located in the area that is being vacated, the City would retain an easement over the portion necessary for
the road. The City engineer will measure right-of-way when the surveyor puts in new irons.
M/S/P Hunt/DeLapp - to adopt Resolution No. 98-32, A Resolution Vacating that portion of Hill Trail
North adjacent to Lots 415, 416, 417, 418, Lanes Demontreville Country Club so described in said
resolution including the three conditions. (Motion passed 4-0).
B. Request for driveway on unimproved City right-of-way. Property described as Lot 1, Block 4,
Tamarack Farm Estates. Applicant: John Carr, 5308 Linden Trail N. _
John Carr is building a house on Lot 1, Block 4,Tamarack Farm Estates. Mr. Carr requested that he be
allowed to use the unimproved future road as a temporary driveway to his new house. He would prefer a
side -loading garage. In his letter dated April 24, Tom Prow recommended approval of this request with the
following conditions: 1. The property owner shall be responsible for any grade or alignment changes that
may be needed when the future street is constructed., 2. The property owner shall be responsible for any
removal costs when the future street is constructed. In his letter dated April 28, Jon Whitcomb, Developer
of Tamarack Farm, stated that any improvements made by Mr. Carr would by at his risk. If a road were to
be put in, any improvements they would have done would be lost. In the future, if the property owner to the
North wants to share a portion of the driveway, he would have to come to the City with a request.
M/S/P DeLapp/Hunt — to direct the City Attorney to prepare an agreement for John Carr for the use of the
unimproved right-of-way for access to the house built on Lot 1,Block 4, Tamarack Farm Estates
conditioned upon applicant being notified of the conditions suggested by the City Engineer in his memo
dated April 24, 1998 and the Developer, in his memo dated April 28, 1998, with both documents being
made part of this motion by reference. (Motion passed 4-0).
C. Village Committee Request
Administrator Kueffner reported the Village Commission Chair, Yvette Oldendorf, has scheduled a
meeting for May 12 and asked for Tom Prew's attendance to discuss water drainage and storm water
issues. Tom Prow will not be able to attend, but Administrator Kueffner will be attending to give an
overview on the Met Council's policies for rural centers. Lake Elmo Elementary School has been booked
for an open public forum for June 10`n. The Committee asked if money should be spent on a direct mailing
or should they insert an article in the Newsletter.
M/S/P Hunt/Dunn — to approve sending the City Engineer to a future Village Commission meeting to
update them on drainage problems within the Village Study Area. (Motion passed 4-0).
M/S/P Hunt/DeLapp - to direct the staff to include an article on the Open Public Forum by the Village
Commission for June 10`" on the front page in the Newsletter and authorize a mass mailing to the Lake
Elmo residents concerning this meeting. (Motion passed 4-0).
Administrator Kueffher will meet with Ms. Oldendorf to discuss what will be included in the notice. The
Design Team will be sent a meeting notice.

12. CITY ADMINISTRATOR'S REPORT:
A. 1998 Payroll
Administrator Kueffner asked for a workshop between the Council and staff. The Council scheduled a
workshop for Wednesday, May 20"i, 5 p.m.
B. Applications for City Planner
The deadline for City Planner applications is May 8". The Council will receive copies of applications for
the City Planner so they can review all the applications and respond back at the May 19" meeting with a
list of names to interview. The Council will invite a member from the Planning and Village Commission to
participate in the interview process.
C. Clean Up -Day
Lake Elmo Clean Up day is scheduled for Saturday, May 9, 8:00 a.m. until noon at the Washington County
Fairgrounds for all Lake Elmo residents. When Councilor DeLapp asked if the Council officially approved
Clean -Up Day, Administrator Kueffner responded the Council did not.
Captain Johnson, Washington County Sheriff s Dept., did not appear at the meeting so the Council asked
that this item be added to the next Council agenda.
The Council adjourned the meeting at 10:20 p.m.
