The meeting was ca' led to order. by Chairman Lendgeist at 7:35 e....
Those members present were: M. EThr, B. Folz, F. Pott. Those
absent: L. Karvida, E. aeClair, E. Tomljanovich, and T. Torseth.
Chairman Lundquist asked for a motion to approve the minutes
of the July 26 meeting as published. Two typeograehlcal errors
in the paragraph starting with "Mr. Donal,ry Novak" were noted.
The sentence which reads "The Commission m(rnbers requested that
the Village Council send a letter to Mrs. J. Stedt advising her
that if he sold a portion of Lot 11 to Mr. Novak, that she must
retain at least 35 feet in order to maintain the frontage of Lot
10 at 135 feet." should read "The Commissie n members requested
that the Village Council send a letter to Lrs. J. Stedt advising
her that if she sold a portion of Lot 11 to Mr. Novak, that she
must retain at least 35 feet in order to maintain the frontage
of Lot 10 at 125 feet." A motioe was made by M. Eder that the
minutes be approved with the a..ove corrections. Seconded by B.
Folz. Carried 4-0.
Curtiss Johnson appeared regarding a building permit for a par-
cel of land on County 70 neue Goose Lake in the J\IE e of Seotiol
aQs, He was advised that the transfer of title of this parcel
without platting was illegal. The Uerrbers of the Commission
were of the opinion that the land be platted before a permit is
issued. Mr. Johnson was advised that he could appear before
the Village Council at their next meeting if he desired.
Jamee Schultz cind William Delanex appeared regarding the sub-
division of a lot on the NW corner of North Shore Drive and
Netet, (SW i of Sec. 13). Two variances wou'.d be required:
) Variance of transfer cf title could be per-
mitted based on Subdivision Regulations Sec-
tion 12C. This would permit a Certificate
of Survey to be filed in the Village Office
in lieu of the usual plat.
2) Variance of easement is reasonable because
due to topography, access to the S'iJ lot is
off of Neneta and now existing there.
A motion was made by Le Lder that the P1anninF Commission
recommend to the Courci"_ that the variances be granted be-
cause the.proposed development is consistent with the adjacent
area development. This recommendation is subject to the con-
ditions that: 1) The north line of the SW let be moved to the
north line of easement and the eaet line of SW lot43e - licit tdrtued
to the same north line of eaeement. 2) A permanent 20 foot
road easement be included with the title for the Sad lot.
The motion was seconded by B. Folz and carried 5-0.

Mr. J Lenz and Mr. W.Wacker appeared regarding an addition
to a dwelling on a substandard lot at the NE corner of
and Third Streets. The present structure is 26 ft. X 2ft.
and two stories. Proposed additinn is 16, ft. X 24 ft. Set-
backs with addition -:rould be 10 ft. on the North, 22 ft. on
the East, and 22 ft. on the Soatb. Lot size is 60 ft. X 120
ft. Due to the existing character of the area and the exist-
ing structure in need of repair, and being that the only per-
tinent problem is an adequate infiividual sewer e system that
would last fnr 10 to 1_5 year. ; a motion sae made by B. Folz
that variance be granted upon favorable results of percL1.latien
tests to be performed by property owner an presented to Vill-
age Council. The motion was seconded oy i bder an] carried
unanimously.
Mr. and Mrs. F. Hoffman of 1641 Dusty Lane appeared regarding
the possibility of getting a building permit for the Sub-
standard lot they own adjacent to their present residence.
Mr. Hoffman indicated that he wanted to seLi this lot, but if
it is not buiida"ie, the sale price .could be adversely affect-
ed. B. Folz indicated that the previous owner had sold the
lot at a reduced price because it was not buildable and had
so advised the Hcffmans at the time they purchased the lot.
Mr. Hoffman said he was not so eniviscd. ''Ar. Hoffman then re-
quested a certified copy of the r.inute s of this meeting. He
was advised that a copy signed by the secretary would be for-
warded to him. Also, these minutes would be subject to ap-
proval at the next meeting. A certified coey of the minutes
would be available only through the Village Office.
Mr. Elmer Hasse appeared with a revised preliminary plat
because the Village Engineer had advised hire that the original
plat was "basically unacceptable". An extended discussion
followed during which the following points were raised:
1) The Commission does not anderstand bonestroc's
reasons for revising the plat in the manner
shown.
2) The Commission di.sa _ proves of Cutlot A be-
cause it is isolated ana would fnrce a cap-
tive buyer or seller when the adjacent land
is subdivided.
3) Outlot A is not suitable for subdivision
nor parkland without ingress and egress for
residents of Blocks 2 and 3.
4) The existing housing elan the north side
of County 70 and in_ediately westerly of this
tract presents a future subdivision problem
for Outlot A.
5) The Commission fails to Gee an appreciable
difference between maintenance of pipeline
along a property line compared to through
a lot where the buildings are a sufficient
distance from the pipeline.
Planning Commission, August 10, 1971
6) All lot boundaries must be to the center-
line of the pipeline easement and subject
to that easement.
B. Folz will contact Mr. Bonostroo and the Council and try to
resolve this matter by the end of the. week. It was also agreed
that B. Folz would contact Counsel Raleigh slid set a public
hearing far the subdivision cn August 23rd.
There was some discussion of the variance request by
Mr. C. Johnson foJ_lowed by a notion by B. Fclz that the
Commission recommend to the Vil1 : ;e Council that this variance
not be approved. Mr. Johnson has been informed at prior meet-
ings dating back over a year of the Village Subdivision Reg-
ulations.
The Hoffman variance request on. Dusty Lane was again discussed.
Since the Planning Commission is about to start an analysis of
all plats in the Village, it was decided that this area would
be processed first. A recommendation on the Hoffman variance
will be postponed until this analysis is completed.
MI Eder presented a preliminary plat for Lot 1 Block 1 of Eder
Pine Ridge Acres lying in the N; z of Sec. 10. The proposed
plat was discussed and B. Folz was directed to have Councel
Raleigh publish a notice cf public nearing on this matter for
August 23rd.
Mr. and Mrs. Vittori did not appear because the final plans
for their building are not completed.
The Calvin Bartley property lying in the MI '- of Sec. 24
was discussed. The preliminary lot plan that was submitted
showed a proposed dwelling on the north half of the 300 ft.
lot. There was no objection to the preliminary plan, but a
question was raised regarding^ the removal of an existing
cabin. Mr. Bartley should be advised by the Village Office
that a potential street is located in this area on the Com-
prehensive Plan, but is not defined at this time.
A motion f-or ad jornrnent was made by F. Pott, seconded by
L. Karvida, and carried 5-0 at 12:10 a.rn.
