PLANNING AND ZONING COMMISSION
MINUTES OF THE MEETING MAY 8, 1973
Meeting called to order at 7:45 p.m. Members present: Chairman
Wm. Lundquist, B. Folz, D. Lyons, T. Torseth, J. Zignego. J. Sovereign
arrived 9:45 p.m. Building inspector John Mueller was also present.
Minutes of April 23 meeting were approved as submitted.
Joe Morris appeared regarding lakeshore lots on Lake Jane. He came in
with his proposed sketch plan of the Olinger lakeshore property. He was
proposing to divide it into four (4) lots, each of which would be
.85 to .87 acres from the present lakeshore level to the edge of the
road rightaway (33' from the center line). In view of the fact that the
lots were substandard in area by a substantial amount, it was recommended
that he either divide it into only three (3) lots of approximately 1.1 acres
each, or get extra land (.55 acres) from Elmer Richert so that he could
have four lots of one acre each. It is further understood that before
the plat is approved, the land fill for each house on each lot necessary
to allow a building permit and septic system must be approved by the
Watershed District.
Certain plat information was lacking, including exact property lines and
exact description of the property. Mr. Morris was notified to refer to
the Model Subdivision Regulations Code for content of preliminary plat
information. The preliminary plan that Mr. Morris brought in did not
include. the Elmer Richert property.
Because the land area above 928' is extremely minimal, there is no additional
land to replace a septic system upon failure. Therefore, it is reasonable
to believe that Mr. Morris may be subject to pumping and holding his septic
effluence within the next ten years after the system is installed.
Mr. Morris said this would be acceptable.
Mrs. Frank Leier, 8490 Demontreville Trail No., regarding septic system.
PZC recommended that Mrs. Leier contact M. Eder of the Watershed District
and present the proposed plan for the septic system and request a
determination of the flood plain elevation of the creek that runs through
the property. Once this elevation is determined and the ground location
is established, the septic system can be installed at any location on the
property that meets the setback and the vertical clearance necessary
according to septic system ordinance. B. Folz will contact M. Eder to
explain the problem to him.
Neil McLouth, Doerfler Construction Co., 1885 Wilson, St. Paul, appeared
regarding the excavation of approximately 10,000 cubic yards of dirt from
the northerly portion of the Lampert property to make the land more usable.
PZC recommended that he obtain a copy of Mining Ordinance 124. After he
informs himself of the regulations in the ordinance, he should notify the
Village Office to set a date for a hearing for a Special Use Permit. He
was quite agreeable.

It was noted in the conversation that a great deal of dirt is presently
being removed from the site of J & W Boat & Motor. PZC would like to
know if the removal of this dirt was a part of the Building Permit or
Special Use Permit.
Ronald Colosimo, 101 Lyon St., St. Paul, had questions on the land usage
of 48 acres of A. & F. Lake property on Lake Elmo Road. Mr. Colosimo
is considering buying the property and building a 50' x 300' metal pole
barn on a concrete slab at the back of the property. PZC informed
Mr. Colosimo that he should check with Bill Schwab on any possibility
that this land may be acquired in the Metropolitan Park.; He was also
asked if this was a long-term or short-term investment. He anticipates
capital return within less than ten years on the laying hens which would
be housed in the building. He was also informed that there may be a
potential sanitary sewer line running across the front of the property
in the next ten years.
PZC recommended that prior to purchase of this property, a hearing should
be held and Mr. Colosimo should request a Special Use Permit for this
agri-business. The land is presently zoned single family suburban.
Betty Ecker, Pendleton Co., and Mrs. Nowezke appeared regarding a building
permit for Gov. Lot 1, Section 24, Gary Horrisberger property. This is
a five -acre lot with a twenty -foot easement to North 30th Street,
immediately east of the Durand property. The tract is about 1,000 feet
long and 250 feet wide, beginning about 300 feet south of 30th Street.
They were advised that a road plan for Section 24 was being developed
by the Village Engineer. This should provide good access to this piece
of property. Mrs. Nowezke is interested in acquiring the property to build
a house in the fall of 1973 or spring of 1974. The ladies were informed
that the basic information necessary to consider a decision would not
be available for at least one month. They were also informed that the
village ordinance requires a 66-foot road access for each tract, to which
this parcel does not comply.
Planning Consultant -- Motion by B. Folz, seconded by T. Torseth, to
recommend to Village Council that notices be sent to planning firms in
the metropolitan area and a committee be established to interview the
firms that reply and select a planning consultant to be retained on a
fee basis, based on the village's needs. Motion passed unanimously.
The next meeting of the Planning and Zoning Commission will be held on
the 4th Tuesday of May -- May 29th -- due to the holiday.
Meeting adjournedat11:05.
Respectfully submitted,
Sandy Phernetton
