HomeMy WebLinkAbout08-27-73 PZMVILLAGE OF LAKE ELMO PLANNING AND ZONING COMMISSION MINUTES OF THE MEETING AUGUST 27, 1973 Meeting called to order at 7:45 p.m. Members present: Chairman Wm. Lundquist, B. Folz, M. Eder, C. King, D. Lyons, J. Zignego, J. Sovereign. Gerry Breheim, 8415 - 38th St. No., requested a kennel license for purpose of raising dogs. She was informed she would need a special use permit and also needs licenses for her present dogs. John Mueller, Building Inspector, Dwight Rafferty appeared to request a variance for building Mr. Rafferty's house back from the existing line of houses. Motion by B. Folz, seconded by J. Sovereign, to accept the recommendation of the building inspector to permit the house to be set back as staked (approximately 200 feet from the road) and inform neighbors of his planned location. Motion passed unanimously. Robert Mordick, 11443 30th St. No., appeared requesting a variance from the one acre lot size on a 220 ft. (E-W) by 229.05 ft. (N-S) tract (not including the N 33-ft. for R/W). He was informed it would not be possible to recommend a variance until city sewer is in due to the 79' width of the proposed lot. Bill Paulson,8206 Deer Pond Trail, requested a variance to build a garage closer to the road than the house. Request was OK'd by J. Zignego, who viewed the site, on the condition he gets written approval from all property owners within 250' of his property. Provision must also be made for a turnaround area that does not required backing onto the street. Garage must be moved back four feet from proposed location (see attached sketch). Motion by J. Zignego, seconded by B. Folz, to accept recommendation by J. Zignego. Motion carried unanimously. After discussion of the matter of a special use permit with John Mueller for the purpose of erecting an above -ground swimming pool by Hubert Rhode, it was agreed a special use permit is needed due to the Uniform Building Code regulations concerning this type of structure. An appearance before the PZC by Hubert Rhode will be scheduled for the next meeting. PZC recommended that an ordinance applying to swimming pools be included in proposed village code. It was heard indirectly that the NW quarter of Section 21 proposed subdivision plat is being deferred by the developer, Artic Enterprises, for an indefinite period of time.
