PLANNING & ZONING COMMISSION
MINUTES OF THE MEETING OF MAY 28, 1974
Present: R. Dreher, B. Folz, R. Johnson, D.Lyons, J.Sovereign,
T. Torseth, T. Williams, D.Grace arrived at 9 P.M.
Absent: W. Lundquist
Meeting called to order at 7:40 P.M. by acting Chairman, Folz.
Minutes of 5/14/74 meeting approved as submitted.
Springborn
Special Use Permit

Mining Permit
The required public hearing was held, for
the Springborn Special Use Permit for a
recreational development on part of the
Springborn farm in Sec. 4. Concerns were
voiced by neighbors over late evening noise,
trespassing on surrounding property by the
public, and additional permits being required
for further development.
Motion by Williams second by Johnson to
recommend approval of the SUP for the follow-
ing land uses: a) tube slide with lift,
b) ski hill with lift, c) ice skating,
d) sleigh rides and hay rides. Further, all
detailed construction and development plans
must be approved by the PZC and the Council
on an individual basis. Motion passed unani-
mously.
Mr.& Mrs. Downs will submit an application for
swimming pool on their property in Sec. 15.
The application will include the signed ap-.
proval of abutting property owners in lien
of a public h94ng and a plan showing com-
pliance of th ,isiting with the conditions
stated in the PZC meeting minutes of 4/10/73
(except #6).
Subject to these conditions, Motion by
Sovereign, second by Lyons to recommend approv
al of the permit. Motion passed unanimously.
Mr. Walker of Walker Construction desired to
have a mining permit transferred to Lampert
Lumber, assuming the permit was valid to
6/20/74. However, Mayor Eder informed the
PZC that the permit in question expired in
January 1974. The PZC recommends that Lampert
Lumber apply for a new mining permit. The
application process normally takes 45 days.
Note: B. Folz will telephone Mr. Walker on
5/29 to notify him of the situation.

Richert Mining Permit: Elmer and Wilbur Richert appeared on
behalf of their parents to submit a new
proposal for a mining permit on the Fred
Richert land in
'Sec. 16. Motion by Torseth, second by
Dreher to recommend approval of permit
subject to the provisions of the Village
mining ordinance with the letter dated
5/28/74 made part of the minutes, correcte<
as follows: 602(3) Richard Schreier and
Jerry Mogren (in both lists) , and 603 (02) -•
"applicant will comply with---". Further,
the Council should give special considera-
tion to the location of the haul road.
In accordance with the letter of 4/26/74
from the Village Fncr4 neer, no excavation
will be Lelow 930 ft. to maintain a
safety margin above the 920 ft. recom-
mended in the letter. Under section 602 (9;
"Dust control materials" should be CaC1 2
or equivalent. Motion passed on 6 aye,
1 nay, 1 abstention.
Note: Nay vote was cast because of the
proposed haul road location. Use of this
northern road will increase gravel truck
traffic on Jamaca Ave., which traffic is
considered hazardous to area residents.
E. Richert replied that use of a southern
access to highway 212 would necessitate
obtaining easement from the property owner
to the south of the mining area, result in
increased dust control problems due to the
loner dirt road, and hinder the permit
owners from having control over the access.
Note: PZC requests the Village Attorney
to advise the Council on the legality
of the application of the 4/22 public
hearing to the permit application of 4/2.

Motion by Williams second by Sovereign that
the Village Clerk notify Sandy Phernetton
that she either attend all PZC meetings
herself or furnish a replacement in advance
of meetings she cannot attend.
