PLANNING AND ZONING COMMISSION
MINUTES OF THE MEETING JUNE 24, 1974
Meeting called to order at 7:35 P.M. by acting chairman Folz.
Members present: Dreher, Folz, Grace, Lyons, Sovereign, Williams.
Torseth was excused after 8:00 P.M.
Minutes of June 11, 1974 corrected as follows:
Page 1, Larry Parson: should read "....15 feet from the front of
said adjoining property owner's home."
Motion by Lyons, second by Dreher to approve the minutes as corrected.
Motion passed unanimously.
Clarence No one appeared at the hearing other than Mr. Pierre and
Pierre his mother, Eleanor. He requested having a maximum of
Auto -shop six cars under repair at one time. No new sign is contem-
Permit plated. PZC requests 12 off-street parking places be
provided: 2 for employees, 6 for vehicles under repair,
4 fot.:customer parking. Operating hours to be 7:00 A.M.
to 7:00 P.M., eccept Sunday. Before the Council takes
action, Mr. Pierre must submit a scale drawing showing
existing buildings, roadways, fencing, well and septic
system and also- the locations and dimensions of the
proposed buildings and parking areas.
Motion by Grace, second by Lyons, torecommendapproval
of a permit for.an,auto repair shop, subject to the above
conditions. Carried unanimously.
Arvold Dr. Arvold requested a permit to install an inground
Swimming swimming pool at his residence in Sec. 2. He presented
Pool only a verbal description and was told that he must submit
Permit a written plan. Also, because of possible future changes
in the Swimming Pool Ordinance regarding fence -height re-
quirements, and because of possible insurance advantages,
Dr. Arvold was advised to investigate installing a six-foot
fence instead of the four -foot fence required by the present
ordinance.
Motion by Sovereign, second by Lyons, to recommend approval
of the permit providing: signed approval of property owners
within''350 feet is submitted in lieu of a public heating,
and all the design standards of the current Swimming Pool
Ordinance are met, Has Well as a 10 foot lot -line setback.
Carried unanimously.
Note: If the required signatures are not obtained ,
Dr. Arvold is responsible for notifying the Village
Office to set up a public hearing.
Ralph Mr. Pierre requested approval to split off a residential
Pierre lot from his property in Sec. 28. The PZC advised that

division surveyor showing locations of buildings, driveway, well
and septic systems, and any easements. necessary to provide
ingress and egress to buildings on the large tract and to
utilize the existing well. The survey.must be a boundary
survey with monuments placed. The PZC will make a recommenda-
tion at the next regular meeting after the survey has:been

submitted to the Village Office.
The Pierres need not appear, again before the PZC.

The MBMA proposed designating loth. ST., Co. 17
north of loth. St., and Co. 15 south of loth. St.
as "major transportation routes" for the moving
of large structures through Lake Elmo. Their
proposal was included in a letter and accompanying
map, dated June 6, 1974. Williams and Lyons reported
the Council had discussed this letter and map, but
was apparently unaware of the proposed use of Co. 17
between 10th. St. and 212. The moving of large structures
through the "Old:Village" is thought by the PZC to be
unfeasible because of existing low wires.
Motion by Sovereign, second by Grace, to approve of
the proposed route with the exception th&t we delete
Co. 17 from loth. St. to Minn. 212 and we recommend
the use of Co. 15 north from 10th. St. to 212 and 212
west to Co. 17, and thence northerly. Carried unanimously.
Mr. Wacker wants to attach a garage to the east of his
house in Sec. 13. The garage is to be located 8 feet
west from the alley to the east, and 8 feet from the side
yard lot line to the north. The adjacent garage to the
north is 3 feet further east. The Old Village Ordinance
#21. Sec. 57, defines sideyard set back for all buildings
as 5 feet. No mention is made in the new codification
of side and rear lot -line setbacks for garages.
Motion by Dreher, second by Grace that we recommend
that a variance be granted for issuance of the building
permit. The variance allows the garage to be located
no less than 5 feet from the side and rear lot lines.
The PZC requests that a copy of the site plan be placed
in its file. Carried unanimously.
Motion by Williams, second by Sovereign, that B. Folz
submit a new setback ordinance for residential zoning
districts, The PZC will review the requirements for
garage setbacks.
Carried unanimously.

Subjeott Placement of over d utility and cable television power lines, traffic
signals and control signs.
The Minnesota Building Mover's Association and the Heavy Hauling, Machinery Moving,
Rigging and Ereoting Division of the Metropolitan Transfer Men's Association have
joined together in a Traffic and Safety Program for our industries. We are aware
that various state, county, and municipal governmental agenoies are permitting
installation of overhead utility and cable television power lines at 18 feet,
traffic signals and control signs at 16 feet heights from the street.
The installation of these overhead lines, signs, and signals create traffic
movement problems for our industries as well as others. After considerable study
and many meetings with governmental officials, it was suggestedito us that we
prepare and submit to the various interested agencies of government and to the
Cable Television Industry "proposed" or "suggested" major transportation routes.
Stich routes do not necessarily mean that these are the only routes or streets
that will be used for moving buildings or oversize objects. These oversize routes
should be regulated or controlled in a manner so that no overhead obstructions to
travel would be located any closer to the streets than 24 feet. Traffic oontrol
signs and signals could be installed with hinges (as has been done by the Highway
Department in many areas) and not oreate any serious problems for any hauling
industry.
We respectfully request that you study these proposed or suggested major oversize
routes and advise us if there is any reason which may make them unsuitable for
such uses. We can, we believe, by working together, your agency and our industry,
put together a program that will improve traffic flow, safety, and reduce costs
and expenses for all concerned.
Enclosed is a map showing the proposed major oversize moving routes. If you are
included in the area of this map which is the first phase of this program we will
look forward to your study and review of this proposal and your comments, sugges-
tions, or recommendations. However, if you believe a meeting of the various
parties is desirable, please let us know and we will be pleased to arrange a
meeting.
