(Grace not present) Mr. Tucker is a prospective purchaser of Lots 227-232, Lake DeMontreville Country Club. The property is now owned by Jerry Bratsch. Mr. Tucker is checking on the buildability of the lot. He presently resides at 1950 West County Road B-2, Roseville, Minnesota 55113. His business telephone is 633-8130. The lot has 71.5 foot frontage on Lake DeMontreville and is pie -shaped. One side is 166.3 feet and the other side is 175.63 feet. A question arose as to whether the easement over Lot 227 had been vacated by the City. This same prob- lem had been discussed at previous PZC meetings on August 13, 1974 and September 10, 1974. Mr. Mueller was present and indicated that he felt that the lot might be unbuildable. The basement floor will have to be three feet above the high water mark. The septic system will have to be four feet above the high water mark. The septic system can be no closer than 75 feet from high water mark and the well has to be 75 feet away from the septic system. 930 feet is the high flood mark for Lake DeMontreville. No action was taken and Mr. Tucker was informed that if he desired to pursue the matter further, he must submit a two -foot contour map complete with topography, soils data and professional soil analysis report relative to the proposed drain field location. These are the same requirements that were indicated to Mr. Bratsch at the August 13 meeting in 1974. MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING AUGUST 12, 1975 Page 2 DAVE LICHT Mr. Licht discussed the comprehensive plan adding individual input of PZC members. He indicated that the City must define the urban -rural service areas by October 1, 1975. If this is not done, the Metro Council will do it for them. The service areas should be staged out over five-year periods beginning in 1975. A long discussion took place regarding the feasibility of sewering Lake Elmo. Sewers will, Mr. Licht admitted, bring development, but he claimed this development can be controlled by forcing the developer to foot the bill for road, sewer and water previous to the time he is able to sell the housing. The developer can also be required to dedicate land for schools, police and fire protection. He indicated that Bloomington is using this approach and forces the developer to foot the bill for all the expenses. This makes the development in an area where the City does not want development very difficult. MOTION by Lundquist. The following sewer time -table should be adopted by the PZC for use in the comprehensive plan: 1990 Sewering of the Tri-Lakes area. The park shall be the northern -most boundary sewered. 1885 The old village should be sewered and Sections 24 and 13. 1980 Sewers should be provided to 3M. 1975 Section 32 already has sewer and development should be encouraged first there. After Section 32 is adequately developed, Section 33 should be developed by hooking it into the WONE System through Section 32. If a sewer interceptor becomes available in or near Section 35, it should then be developed. After 35 is developed, Section 36 can be developed and then Section 34. SECOND by Grace. VOTE All in favor. BUILDING The PZC requests that the City Clerk prepare a monthly list PERMIT of all building permits issued with the location of the REPORTS structure and other information about the structure. This will be used by the PZC to monitor growth in Lake Elmo. MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING AUGUST 12, 1975 Page 3 BATTEN TIMBER DREHER 3M Meeting Representatives from the Batten Timber Company discussed the change in the special use permit granted in 1974 so that three burning pits could be established. Each would be 20 feet deep and the earth removed would be used as a screen around the pit. This burning has been requested by the clientele of Batten Timber. The number of diseased elm trees that are being removed is exceeding the capacity of the chipper. The chipper has been breaking down and burning seems to be the only solution to destroy the trees. Batten Timber is also interested in constructing a sawmill. Dave Licht stated that he felt the PZC should grant a 90-day permit under PCA standards so that the operation could be observed. The PCA has been informed of the project and they told the City forester that they approve of the project and it conforms to their standards. MOTION by Williams. That the PZC accept recommendations of the planner and recommend approval of the amendment to the special use permit, subject to the restrictions to be submitted by the planner and forester. SECOND by Grace. VOTE All in favor. Bob Dreher brought plans for his Pole barn which measures 72 x 36. It's presently constructed at the Washington County Fairgrounds and will be moved to the Dreher farm. MOTION By Grace. The PZC recommends approval of the issuance of a special use permit to allow construction of a Pole barn, subject to the Council's grant of a variance to the set -back ordinance at 4.05(J). This variance is necessary because of the surrounding low land on the Dreher property. SECOND by Armstrong. VOTE All in favor. The agenda for the 3M Meeting to be held on Thursday, August 14, at the Oakland School was discussed. John Rudquist of 3M was present. ADJOURNMENT MOTION by Williams to adjourn. SECOND by Armstrong. VOTE All in favor. The meeting was adjourned at 11:35 p.m. MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING AUGUST 12, 1975 Page 4 THE NEXT SCHEDULED MEETING IS MONDAY, AUGUST 25, at 7:30 p.m. Respectfully submitted, Thomas G.
