CITY OF LAKE ELMO
PLANNING AND ZONING COMMISSION
MINUTES OF THE MEETING OF JANUARY 26, 1976
Meeting called to order at 7:40 p.m. by Chairman Johnson
Johnson, Crombie, Dreher, Grace (9:30), Lundquist, Novak, Sovereign (7:45)
and Armstrong (8:35).
Terry and Nancy Emerson requested information concerning a variance to
move a house from Normandale Road to Eden Park in Lake Elmo. The house
is approximately 25 years old and it has a brick exterior. The building
inspector will be looking at it tomorrow. The PZC advised them to
apply for a variance.
James Jungman is anticipating purchasing Lot 18, Berschens Shores from
the present owner, Howard Walker. This is on Lake Jane Road and 45th
Street. Jungman questioned when sewer service would be available and
was told that he might have an answer in 1976. He also questioned the
controls on the Lake level in the future and was told that this will
be done by the Valley Branch Watershed District. The PZC advised him
to get a contour map.
HEARING Dave Licht indicated that the City has invested much time and money
COMPREHENSIVE on the Comprehensive Plan. It was a difficult plan because of com-
PLAN plexities. Compromises have been made and he would hate to see the
plan go down the drain because of certain issues. The plan should be
a direction. Licht suggests that the PZC recommend passing the plan
so that the Metropolitan Council may start discussion. The community
may continue discussion and changes can be made. Licht emphasized
that it is a policy plan, not law. It cannot become law until the
Metropolitan Council review period is over in 90 days.
TODD WILLIAMS questioned if amendments of any great change
would be made then would the Metropolitan Council have to reinvestigate
those amendments for 90 days. Licht stated that if the document is
adopted and then amended it needs 90 days to be reviewed again. Williams
made the following suggestions to establish a referendum:
1. Establish a committee of citizens who have expressed
interest at meetings for referendum.
2. Develop pro and con arguments of issues.
3. Determine which issues are to be on referendum.
4. Conduct a referendum.
5. Incorporate the response from the referendum into the Zoning
and Comprehensive Plan.
As possible questions, Williams raised the following: Should
Lake Elmo have central sewer? Should Lake Elmo's Northeast corner be
agricultural? Should Lake Elmo have a large business development like
Dayton's in the areas suggested?
CHAIRMAN JOHNSON said that Don Raleigh had stated that the City
of Lake Elmo cannot conduct a referendum on the Comprehensive Plan
because State Statutes do not allow it. If the City was a Charter
government then the referendum could be held under the terms of the
Charter. Possibly a questionnaire would serve the same purpose as a
referendum to give guidance to the PZC and the City Council.
ROBERT ZIERTMAN questioned if changes were made after the
Metropolitan Council saw the plan would it have to have an extra 90 days.
MEETING OF THE PLANNING AND ZONING COMMISSION January 26, 1976 Page 2
HEARTNG Licht said no, not unless major issues are changed. Licht said that
COMPREHENSIVE many questions can be answered with the next step which is zoning.
PLAN GEORGE KRUEGER raised several questions about the use of the
(Continued) Northeastern agricultural area.
BILL SCHWAB then made a presentation concerning the County
Planning Offices views on the Comprehensive Plan. By 1990 87% of the
sewered area of Lake Elmo is scheduled to have sewer according to the
plan. At the same time only 60% of the total projected population
will be present. Possibly too much land is projected into sewer.
Schwab indicated that up to now it had been assumed that the sewer would
be paid for by the Federal and State government. He indicated that
through discussions with the staff he had been informed that based on
the original plan by Bonestroo for the WONE sewer the Oakdale area should
be able to be sewered by that interceptor. If that is so, then the Lake
Elmo interceptor will not be needed for the Oakdale area and therefore
there will be no Federal or State funding. If Lake Elmo is the tail end
comminuty on the sewer interceptor it will pay the full cost for the
sewer.
LICHT stated that he doesn't agree with the Metro Council
population estimate and says that the Metro Council staff has made
statements to the effect that 3M won't have any affect on growth in
Lake Elmo. The Metro Council can restrict development by withholding
the sewer. If an area does not want development it probably has a good
chance to fight the sewer.
SCHWAB said that the plans Lake Elmo has for sewer may change
if Lake Elmo has to pay for the sewer itself. Schwab also questioned
the single family use around the 3M Research "Park" Complex. Possibly
there should be some apartments near the 3M development.
WILLIAMS stated that he was informed that the Washington
County Planning Commission is not in favor of a parkway along 19. They
do not want to encourage through traffic. Williams indicated this road-
way should be no wider than 2 lanes.
At 9:50 the Hearing was closed by Chairman Johnson. The list of all those attending is
attached hereto. Johnson emphasized that the citizens may send in written statements or
make verbal comments to the Planning Commission in the future. There will be more hearings
during the 90 day period of review. Any group which would like to, can meet with the PZC
and discuss the development.
EMERSON
The questions discussed earlier as to the moving of the Emerson house
to the Eden Park plat was considered further. Mueller has not looked
at the house yet. It is 62 1/2 feet by 38 feet. The Eden Park plat
has not yet been recorded. Mueller would like a contract with the
Emerson's that they will bring the house up to code after it is installed.
MOTION by Grace.
That the PZC recommends to the City Council that it approve a variance
of City Ordinance §504.190 as to the age of a house which may be moved
into the City so as to allow Mr. Emerson to move the house situated on
Highway 100 Crosstown and 62nd in Edina to the Eden Park plat subdivision
subject to approval by the building inspector and written approval of
all landowners within 350 feet of the final location of the property on
which the house will be located and further that the applicant enter into
an agreement with the City drawn by the City Attorney promising to bring
the building up to code.

VOTE all in favor.
COMPREHINSIVE MOTION by Lundquist
PLAN That the Planning and Zoning Commission adopts the Comprehensive Plan
pursuant to Minnesota Statute 462.355 as its recommendation to the
City Council and for referral to the Metropolitan Council subject to
continuing examination of the plan by the PZC during the Metropolitan
Council review period and inclusion of any changes and/or amendments
that are deemed necessary by the PZC.
SECOND by Sovereign
VOTE in favor: Johnson, Crombie, Dreher, Grace, Lundquist, Novak,
Sovereign
Against: Armstrong
Armstrong indicated that he has several misgivings about the plans
including its sewer projections. More citizen input should be obtained
through an informational questionnaire before the PZC should take final
action on this.
MOTION by Armstrong
That the PZC requests the City Council to afford the PZC some represen-
tation in the discussions and negotiations with the Metropolitan
Council as to the Metropolitan Council's approval or denial of all or
any portion of the Comprehensive Plan and that the Council keep the
PZC up to date as to all stages of negotiation.

VOTE all in favor
TOP TWENTY Mr. Schwab had examined the proposed plat of the Top Twenty Investment
INVESTMENT Club because of the fact that it borders on the proposed Metropolitan
CLUB Park. Because of the soil type Schwab indicated that there would be
side lot seepage in the northeast corners. The soil is too granular and
the septic systems will seep too quickly. The southwest corner will have
too slow of a precipitation rate. Restriction should be placed on the
plat in accordance with the soil test. Other than the sewage problems
Schwab saw no significant affect on the park. He suggested that a
letter be sent to the developer asking for more detailed soils informa-
tion on each lot -before approval is granted to the plan. Any action
on the Top Twenty Investment Club was deferred to the next meeting.
Sovereign indicated that she will abstain from any votes in connection
with it because her husband is one of the Top Twenty.
ANNUAL MOTION by Sovereign
MEETING That the Annual Meeting be postponed until the next meeting of the
PZC.
ADJOURNMENT
Motion died for lack of Second.
An election was then held and the following persons were elected:
Chairman, Grace; Vice Chairman, Sovereign; Secretary, Crombie.
The meeting adjourned at 11:55 p.m. The next meeting will be held on
February 10, 1976 at 7:30 p.m.
