CITY OF LAKE ELMO
PLANNING AND ZONING COMMISSION
MINUTES OF THE MIMING OF JANUARY 10, 1978
was called to order at 7:40 PM by Chairman Grace.
Duane Grace introduced Don Moris to the members of. the Planning Commission.
Mr. Morse wit occupy the position of Dick Johnson, whose term expired this
year.
Crombie, Dreher, Moris, Grace, Sovereign, Novak, Michaels
Council: Lyons, Shervheim, L. Whittaker, Administrative Assistant
Motion by Michaels to to accept the minutes of December 13, 1977 as
written. Seconded by Dreher. Motion carried 6-0.
Tri—Star Addition — Lee Rossow — Development of 48.32 Acres — John Cody Farm
10689 — 60th Street — Section 2
Mr. Rossow presented the proposed plat with some alterations relating to
the access road in from Highway 36. There are two proposed Outlots —A&,B,
these are to be sold with Lot 1 Block 2 and will serve as a temporary
access until 59th Street is completed as a through Fist —West Street.
Audience:
The question of the ?_Acre exception, with the existing house, was asked.
Was this transaction legal, since this is a five acre zone and the house
was split off with two acres? Mr. Rossow stated that this pieoe has been
recorded and did not know what could be further done.
Road drainage — the water follows the property Until it crowns, and it
will then flow into the ponds described, the residue then flowing south.
Access — the present access onto Highway 36 will be moved 50ft. west.
The exception will have access from outlot B.
Exception — It was suggested that a variance be required for this parcel.
Also, a variance for a gravel road.
59th Street — The Highway Department present feeling is to have no service
lane next to highway. Eventually 59th Street may serve as the service
lane. 59th Street as proposed, is on the power line easement.
Outlots — Larry Whittaker felt the Outlots A & B, as proposed are unac—
ceptable. The way Lot 1 Block 2 is proposed, it makes a "U" around the
exception. Mr. Whittaker felt the developers could take more advantage
of the terrain if some changes were made.
Novak recommended that before further consideration can'be given that the
reports from MDOT, the City Engineer and Valley Branch Watershed should
he received.
The public concerns expressed were the water flowage and the direction
of 59th Street, with the possibility of the extension of 59th to the
East and West. Rezoning, as requested on the application, will not apply.
9:50 the hearing was closed,
PLANNING AND ZONING COMMISSION JANUARY 10, 1977
Brookman Addition: No report from VBWS has been recei.ved.Two changes are requested
by the developers, 1) no concrete curb and gutters be required until
sewer is in 2) the Planners report requests alleys. The developers
choose not to put these in unless there is a need..
Motion by Dreher to recommend approval of the Concept Plan for Brookman
Addition, as it is proposed, and that bituminous curbs and gutters be used
rather than concrete until such time as sewer is put in. Also, deletion
of the planners recommendation for alleys, as per the City Code.
Seconded by Sovereign. Motion carried 7-0
Pepin Engineers: Don Pepin — Erecting a building behind the White Hat Restaurant
Mr. Pepin has a contract to purchase approximately 1 acre behind the
White Hat Restaruant. The property will fade 35th Street. It is zoned
General Business. The building will be approximately 6500 sq. ft.

Grace felt this would come under General Industry, rather than General
Business. IIe suggested Mr. Pepin make application, then a hearing will
be held before it is presented to the Council. Also a pert test is
required.

taken plane and those that are pending. January 30, 1978 the PZC and
the Council will meet jointly for the Zoning Ordinance. Also plans for
