CHARLES E. ICEISTER - HEARING FOR SUP TO DEPOSIT UP TO 300 CU. YD. OP FILL ABOVE
HIGH ELEVATION, WITHIN 1,000 FEET„DP THE NORMAL HIGH WATER MARK OF
LAKE ELMO.
Chairman Grace reviewed the letter from VBWD stating this request
meets their criteria. Larry Bohrer reviewed the Shoreland Management
Act and submitted this meets the code and requirements.- A letter
from Lloyd Shervheim indicated no objection to the permit.
Mr. Keister is proposing to fill on the West and South side of his
house. The area is the on the back -water side,of the peninsula of
Lake Elmo, He wants to fill the area in order to make the property
more useable. The question of the Schwartz driveway and the culvert
under it was discussed. According to a letter from the City Engineer
dated 1979 the Schwartz culvert is blocked and. should be
cleaned out. Presently the driveway is restricting the run-off .flow.
Crombie indicated the culvert may he sinking and a gravel base under
the culvert may help this problem, This area, will still retain water
even after it is filled,
Jeanne Schwartz, adjacent property owner has no objections providing
this does not add additional water to her property. M,r.. Keister
stated all the run-off should go sunder the culvert or along the
driveway as it does now. The hearing was closed at 8:05 p.m.
Michels moved, Lundquist seconded, to grant the SUP to Charles Keister
to deposit up to 300 cu. yd. of ill above the high water mark, within
1000 feet of the normal high water mark of Lake Elmo. The PZC also
suggests the City Council look at the culvert on the Schwartz property
and determine what action is necessary to solve the problem. Motion
carried 5-0 1 abstention, Prince. The Administrator will see if this
item cannot be presented to the Council before the August 7 meeting,
WALTER PECAN - EASEMENT TO PROPERTY OFF PRIVATE ROAD.
'Mr.'Pechan what steps, have to he taken to up -grade his driveway to
rural standards in order to gain access to the back of his property,
This was the recommendation of the Council when Mr. Pechan requested
access preciously, The present driveway will be considered an extension
of Keats. Mr. Pechan has agreed to dedicate 50 feet. The parcel in
question is already divided off and would not he covered under the
moratorium. A variance will still he required for a lot with no
frontage on a public street, Mr. Pechan said he will dedicate 50 ft.
for the extension of Keats Ave, to 4.5th Street, possibly to 46th Street.
and also 33 feet on 46th Street, which reins across the top of his
property. The PZC cannot make a recommendation on the road, this is
a Council decision. If the following conditions were met the PZC
would_have no objections to the request: l.. dedication of 50 ft.
for the -extension of };eats to 45th Street, or possibly 46th Street,
2. Prepare a maintenance agreement and 3, dedicate 33 ft on 4hth St.
