HomeMy WebLinkAbout07-26-82 PZMLAKE ELMO PLANNING COMMISSION MEETING
JULY 26, 1982
Acting Chairperson Prince called the meeting to order at 7:35 p.m.
in the City Hall.
PRESENT: Commissioners Dreher, Gifford, Lyall, Mazarra, Moe, Nazarian,
Peterson. Also, Administrator Whittaker.
1. MINUTES - M/S/P Peterson/Gifford to accept the 7/12/82 Planning
Commission minutes as written. (4 ayes; Mazarra, Peterson & Prince
abstain) Moe arrived 7:45 p.m.
2. PUBLIC HEARING - NEUDAHL REZONING AND PLATTING ON LOT SUBDIVISION
LAKE JANE ESTATES
Acting Chairperson Prince opened the public hearing at 7:48 p.m.
Present were Ken & Sharyl Neudahl; and Dennis Peck of Votel Development
and Bruce Folz, Surveyor, to represent the Neudahls on their request to
rezone the entire Neudahl 34.5± acre parcel from Rural Res.to R-1 and
Shoreland and to plat one 1.5-acre lot, as recommended by the City Council.
• Dennis Peck - Tonight we're requesting (1) rezoning and (2) final plat
on one lot. R-1 zoning is compatible to remaining area, concept plan
for remaining 34 acres considers road from Fox Fire Estates, topography,
and drainage. We met with Valley Branch Watershed and they have no
problem with single lot —didn't deal with 34 acres since its only concept
plan. Additionally, DNR made some recommendations. (Prince gave City
Engineer's letter expressing his one concern to Peck.)
• Bruce Folz - Presented concept plan for Lake Jane Estates to rezone
entire Neudahl parcel to R-1 into 16 total lots with average density
of 2.61 acres with Shoreland overlay. Regarding total concept plan,
Folz explained proposed new roads; ponding areas in SE and NW corners
so there would be no drainage into Lake Jane as presently prohibited by
the Watershed; slopes to be graded in top NW corner and fill used for
proposed roads; detailed soils tests not completed yet; plan would be
consistent with 30' dedication to Lake Jane Road; and 14' strip on Lake
Jane has title problems so not included in plan. Regarding platting
of Phase I, Lot 1, Block 1, Folz explained 150' frontage on Lake Jane
Road and that the Neudahls would like to use existing driveway located
on proposed Jane Road Circle North coming off Lake Jane Road.
Concerns of Surrounding Property Owners:
• Walter Weber - lives on Jerome Court and was concerned about
his lots being assessed for extension of Jerome Avenue,, although he
said it was shown on plat when he bought property. (Whittaker said
present City Council policy is that property owners are only assessed
if they benefit from the new roads.)
• Joel Nyhus - concerned about drainage (Folz explained drainage plan)
and also additional traffic.
PLANNING COMMISSION MEETING - 7/26/82 page 2
• Loren Barber - Felt platting of whole area should be dealt with now
( and not just the one lot; shouldn't be concerned with landowner's
financial hardship but with upholding currentity zoning requirements.
(Whittaker explained that City can't refuse owner a reasonable use
when it fits into Comp. Plan and ordinances. It wasfurther explained
by Prince that 16 lots on concept plan, with average of 2.61 acres,
fits well into surrounding platting --Fox Fire is 2.5 acres, with
smaller lots on Lake Jane. Dennis Peck suggested that any other issues
on concept plan can be addressed when plat comes up.)
• Mike Moen - likes this concept plan better than the first plan
presented; roads are laid out better and looks like good planning;
complimented the Planning Commission on their foresight.
• Cheryl-Nyhus' - was concerned that Lake Jane Road would have to be
widened with 16 future additional homes. (Whittaker didn't think 16
homes would have that large an impact and roads as proposed would have
effect of splitting up traffic.)
M/S/P Dreher/Mazarra to recommend that Kenneth Neudahl's 34.5± acre
parcel be rezoned from Rural Residential to R-1 as provided in the
Comprehensive Plan. (8 ayes)
M/S/P Lyall/Nazarian to recommend that the Final Plat be approved for
one 1.5-acre lot subdivision, with the following stipulations:
1. there be one driveway coming off Lake Jane Road as opposed to
two (located on proposed Jane Road Circle North);
2. cash park donation be accepted; and
3. right-of-way to Lake Jane Road North be dedicated
(8 ayes)
3. PUBLIC HEARING - HAMMES PLAT FOR CLUSTER ON LOTH STREET AND
KEATS AVENUE - HAMMES COUNTRY VISTA
Present were Bill Hammes; Dorothy Lyons; Bruce Folz, Surveyor; and
Jerome Marah of the Oakdale Gun Club.
Folz presented concept plan for Hammes Country Vista, showing platting
of 38.26-acre parcel into one 1.5-acre lot and Outlot A which would be
limited to 6 remaining lots as permitted in the 7/40 cluster, located
in a RR zone. Folz explained developmental agreement would be needed
for Outlot A; plat does not include "Exception" but includes Hammes
homestead; this is only concept plan and not final plan; and house would
be moved onto Lot 1, Phase I (house has to be moved by September 1)
with driveway coming off loth Street North.
Concerns of Commissioners:
• Gifford was adamant about the noise problem from the Gun Club to the
east and concerned about future problems and complaints it would cause
after people move in. Suggested clustering should be in NW corner
and not in SE corner near the gun club.
PLANNING COMMISSION MEETING - 7/26/82 page 3
• Mazarra - agreed with Gifford on noise because of past problems with
gun club, however owner should be able to develop his land; berms may
help to inhibit noise, pine trees maybe more so.
• Moe also concerned about gun club problems - parents will start
complaining because of children running along fence lines, people are
already complaining.
• Lyall - questioned whether a berm to muffle sounds would do any good,
he didn't think it would have much effect. We have saleable piece of
property, can we put it in cold storage because there's a gun club there?
We can discuss where house is too close to property line, but 30-40
feet further west would not make much difference in sound.
• Dreher - once Midland Meadows starts moving, can see complaints coming
in to extent gun club would no longer be issued a permit —could be
25 to 50 years.
• Nazarian - because Midland Meadows was approved, we're obligated to
approve this plat.
Commissioners generally agreed they have faith in the gun club, but not
people who will live next to it.
• Whittaker felt future property owners next to gun club should be made
aware of noise before buying.
Answers to Concerns of Commissioners:
• Jerome Marah, representing Oakdale Gun Club, said they are doing all
possible to inhibit the noise; in stages of cutting down noise and
are continuously monitoring sound so we are compatible with surrounding
community; a State representative came out and measured sound which was
well within State standards; discontinued skeet shooting because of
complaints; and are following all regulations as prescribed (such as not
shooting within 500' of platted property). Concerned that house
location on Phase I is too close to east property line.
• Dorothy Lyons - we've always been a good neighbor of the gun club and
know they're truly working on problems and addressing the noise situa-
tion. Didn't cluster in NW corner because of tremendous traffic
potential on Keats Avenue with Regional Park located on north boundary
line, estimates up to 3,000+ vehicles on a weekend in future.
• Bill Hammes - house located close to east line as he'd like to
continue farming land.
• Folz - platted cluster in SE corner since they wanted to avoid Keats
Avenue North which would involve the County; SE corner is higher area
and more suitable for development; sound is worse in north part since
waves go in cone pattern from muzzle; maximum noise level according to
City ordinance is 65 db which should be adequate, if noise brings
complaints, Council can enforce control; berms cost a lot of money and
if the gun club is gone in 10 years, we're stuck with a huge berm that
PLANNING COMMISSION MEETING - 7/26/82 page 4
is unattractive, unmaintained, and would serve no purpose; gun club
will not be a surprise to property buyers since it's very visible;
Midland Meadows on south side of gun club was approved, can't restrict
landowner from developing his land because of neighboring land use if
it falls within ordinances; trying to create problem that doesn't
exist; and could put house on 10 acres under minor subdivison but
this plan makes better use of the land.
M/S/P Nazarian/Dreher to recommend acceptance of the 38.26-acre plat
owned by William Eo„Hammes, with the stipulations that:
1. it is a cluster development under RR zoning;
2. Outlot A is to be a maximum of 6 lots if resubdivided;
3. Keats Avenue right-of-way to be dedicated; 10th Street to be
4. cash park donation to be accepted; dedicated
5. development agreement to be provided that 6 lots in Outlot A
are contiguous to Lot 1, Phase I; and
6. City Engineer's recommendation be incorporated regarding
protection of ponding area on NE corner.
(7 ayes; Gifford nay)
The public hearings closed at 9:52 p.m.
4. ADMINISTRATOR'S REPORT
A. Landscaping Standards - City Council basically supports Planning
Commission's recommendation to establish landscaping standards —
objections were that berms are expensive and "planting island" language
should be changed to "landscaping" or "plantings." Nazarian suggested
giving businesses option of expressing what their main objections are;
Whittaker will send them a letter.
B. Comprehensive Plan Amendment - Council approved this amendment
without any changes such as the Planning Commission recommended.
C. Blom:mist/Popov Rezoning - Council adopted Planning Commission's
recommendation that site should be rezoned from Rural,Residential to
Highway Business; building plan will be reviewed for approval when ready.
D. C.U.P. for Advertising Sign - Marlin Rygh has applied for a
conditional use permit for an advertising sign on Highway 94 near the
Valley High Drive-in. M/S/P Gifford/Lyall to hold a public hearing
August 9 at 8:15 p.m. to discuss this issue. (8 ayes)
*amended Ron Smith
8/9/82 E. House to be Moved - Application received from*H#arme•s- to move
house onto property at 9999 loth Street North from Keats and 15th.
Prince - approval should be based on what building inspector says. If
anyone gets the chance, they should look at the house before next meeting.
Lyall - depends on whether it would improve neighborhood or not; with
cost of housing what it is today, we're going to see more of these.
This item will be placed on the August 9 Planning Commission agenda.
The meeting was adjourned at 10:00 p.m.
