Commissioners present: Gifford, Michels, Nazarian, Lundquist and Moe Absent: Dreher, Peterson, Graves, Ryberg and Lyall. 1. MINUTES: May 9, 1983 - M/S/P Michels/Moe to approve the minutes of May 9, 1983, as written. Carried 6-0. 6. REPORT ON COLOSIMO AND SOVEREIGN: The Council deferred action on the hearings and variance requests for two reasons. 1. the new affidavit verification procedure was not in effect when the notices were sent - new notification and hearing will have to be set. 2. Both parties agreed to bring in preliminary plats for their parcels. Sovereign informed the Council that the Planning Commission recommendation to plat two 125' lots off of Olson Lake Tr. would not be feasible in that the extension of Parcel 1 & 2 would prevent locating a cul-de-sac in that area necessary for future development. He indicated he will bring in the cul-de-sac and subdivision plan; but, will still ask for a lot size variance. - -Michels - the two ownership in one family is not an adequate reason for creating a substandard lot. - -Prince - need a more accurate sketch showing dimensions, septic and drainfield location and future location of Parcel 1 & 2. Also present and future road/driveway alignments. Colosimo - City Attorney suggested that the City obtain a deed from Maistrovich, Colosimo and Springborn for public right-of-way on the existing driveway. Several Council members -appeared -to favor granting a variance to permit Colosimo's to rebuild on an unimproved street. Their main concen was the improvement of Jane Rd. N. --Prince - questioned where r-o-w for Jane Rd. N. & Colosimo driveway easment road were located. Whittaker will verify r-o-w for the future extension of Jane Rd. N. - -Nazarian - received a call from a resident on the Jane Rd. N. improvement - concerned about construction equipment tearing up the road. 7. JUNE 13 MEETING: The Secretary will verify who can attend the reschedule June 13 meeting. 8. GRANT TOWNSHIP REZONING: Whittaker referred the Commission to the hearing notice for rezoning property off of Highway 36 & County 17 to Commercial. Lake Elmo proposes no commercial use on the south side of the higheay. The Commission offered no comments as they did not feel this rezoning would have any impact on Lake Elmo. 9. PLANNING BOOK: Whittaker informed the Commission that Gunner Isberg's book "Local and Regional Planning In Minnesota" is available at the City Office for any member interested in using it. 10. OTHER COUNCIL UP -DATE: Whittaker up -dated the Commission on the Klawitter law suit - City is taking them to court; C&NW rezoning - City waiting for the declaratory judgement; and Nelson/Hageman - City received letter requesting reconsideration of their rezoning request pending legal ramifications. LAKE ELMO PLANNING COMMISSION, MAY 23, 1983 -2- 3. DECOSTER - LARGE LOT SUBDIVISION AND HEARING DATE: Douglas Decoster was present and explained the location and intended use of the property. Mr. John Bodey is proposing to purchase 11.45 acres for residential use. This lot abuts the Armstrong property. - -Lundquist - noted the 'exception parcel", which is a parcel of record, has a tiny sliver of property, owned by Tom Armstrong along its southwest boundary, adjacent to the Bodey/Decoster parcel. If this is a reserved strip, he recommended that the two property owners, Armstrong and Pierre resolve the discrepancy and deed the "sliver" to the.Pierre exception parcel. As long as there is no dispute between the involved property owners, now is the time to rectify the title. --Commission recommended that Mr. Decoster split off the remaining 40 acres of his property, north of loth St. abutting this piece with the same .parcel number, during this Large uotiSub.division process - -Whittaker - as this is a 10 acre zone, hares to require a sub- division plan. He explained the park donation requirements for large lot subdivisions. He referred the Commission to his letter of May 19, which outlines all the material Mr. Decoster will have to have ready for the hearing; also, he recommended that the City Engineer review the proposal before the hearing. The Commission also considered establishing a $175/lot park donation for 10 acre lots. Additional park dedication/donation can be required should the property be further subdivided. M/S/P Nazarian/Gifford to call a public hearing on June 13, 1983, at 7:45 p.m. to consider a large lot subdivision for Douglas Decoster, subject to any and all supporting data being available by the 31st of May. Carried 6-0, 2. BURRWOOD ESTATES - PRELIMINARY PLAT AND HEARING DATE: Bruce Folz presented the preliminary plat. He informed the Commission that because of financial cutbacks, Demontreville Tr. N. will continue to serve as County 13 with Highlands Trail becoming the new County 13 sometime in the distant future. Because of this situation the County is requesting 100 ft. r-o-w dedication from Burrwood Estates. (County letter of May 16 , 19831. Valley Branch had two verbal concerns: 1. the overflow berm from pond #1 should provide a pipe to outlet the water before it overflows. and creates erosion problems and; 2; the size of the culvert at the south end of the parcel. Folz will redraw the plan and include the Valley Branch ?ecommendations. - -Prince - may have to look at 50 ft, set -back requirement since County is also requiring a 50 r-o-w - setback on the preliminary plat is shown at 30 ft. - variance request could be considered. --Folz - if completed, may present Final Plat with Preliminary Plat for approval at the hearing. M/S/P Nazarian/Moe to hold a public hearing on June 13, 1983, at 8 p.m. to consider the Preliminary, and possibly the Final Plat of Burrwood Estates. Carried 6-0. LAKE ELMO PLANNING COMMISSION, MAY 23, 1983 -3- 4. GENE PELTIER - REVIEW VARIANCE, REZONING AND HEARING DATE: Bruce Folz presented Mr. Peltier's request to rezone one 1 1/2 acre lot out of a 40 acre parcel. The parcel would be accessed off an unimproved right-of-waysection of Legion Avenue in Eden Park. Folz explained possible future road connections through the property from Lake Elmo Avenue to Legion and a possible north extension of Legion to the Myron Ellman Addition. The 40 acre parcel is located south of the Earl Goerss property and north of Pete Durand. Goerss has indicated that he might consider developing a concept plan for his property in conjunction with an over-all plan for the Peltier parcel. At this time, Peltier just wants the one lot for his son. He plans to develop the property at -a later time and would incorporate the proposed lot into the future plat. - -Prince - have been requiring platting. --Folz - will make a commitment to plat when remaining property is developed. Not creating a legal or title problem by doing this --Whittaker = issue is equal treatment of all similar requests. Same as Neudahl and Crombie. --Folz - this being the case, may make sense to rezone the entire parcel and possibly include the Goerss property. --Prince - confirmed R-1 zoning for this parcel in the Comp Plan. --Nazarian - need to address park dedication, ponding, etc. at the hearing. M/S/P Nazarian/Moe to call a public hearing to consider a variance from the Subdivision Ordinance, a Simple Lot Division and rezoning, from RR to R-1 for Gene Peltier. Carried 6-0. 5. BROOKFIELD III - SITE AND BUILDING PLANS: The Commission reviewed the Building Inspector's memo and the application of Brookfield Associates regarding site and building plan review for Brookfield III. Dave Loos explained the exterior material of the building, which will be a one-story warehouse/office building like Brookfield I. He submitted a proposed landscape plan designed by Siefert Nursery. - -Whittaker - Ordinance does not require screening or buffering between commercial uses; but the loading dock must be screened. --Prince - would like to see the area look more attractive - believes this can be handled with landscape. - -Loos explained how the number of parking spaces were arrived at. Office space requires 1 per 200 sq. ft. - warehousing requires 1 per 800 sq. ft. 29 spaces are provided calculated on the 800 requirement. --Gifford - cannot see any problem in requiring less parking spaces when they are not needed. --Loos - plan on completing the landscape islands at Brookfield II this summer. The Commission discussed Pine Tree screen south of the drainage ditch. This property belongs to the school. Don Raleigh indicated he would supply the trees if the school would allow a row of trees to be planted and agree to replace broken or damaged trees caused by the children. Dave Loos explained that trees along the north ditch were not feasible because they would be pushed into the ditch area during snow removal. LAKE ELMO PLANNING COMMISSION, MAY 23, 1983 -4- 5. BROOKFIELD III BUILDING AND SITE PLANS: --Prince - favored Don Raleigh's suggestion. No problem with the parking or building - would like to see more landscaping. M/S/P Nazarian/Moe to table a recommendation for the Brookfield III Site and Building Plan pending a further detailed landscape plan. Carried 6-0. The Commission will review this June 13 if it is ready. ADJOURNMENT: M/S/P Moe/Michels to adjourn at 9:40 p.m. Carried 6-0.
