December 12, 1983
DRAFT
The meeting was called to order by Chairperson Prince at 7:30 p.m. in
the Council Chambers.
Commissioners present: Nazarian, Michels, Dreher, Peterson, Graves,
Lundquist, Moe (arrived 7:45)
1. Minutes:
M/S/P Michels/Graves - To approve the minutes of the November 14,
1983 Planning Commission meeting. (Carried 6-0-1 <Nazarian>)
2. Oakdale Resolution:
The Commission was in agreement with Klaers' concerns as outlined in
his memo of December 8th regarding some of the wording of the Oakdale
Resolution. From the seventh "Whereas" of the resolution; the
Commission at no time agreed to relinquish Lake Elmo's designated
County State Aid Highway Funds for the construction of the proposed
50th Street Extension in the City of Oakdale. What was said was,
"when Oakdale was interested in doing something with 50th street, they
should submit a proposal to Lake Elmo and consideration would be given
to the request at that time." Also, the fourth "Whereas" from page
two of the resolution, wherein it states "providing for sanitary sewer
service" should read something like "the possibility of providing for
sanitary sewer service"
The Commission objects to the wording in this Oakdale Resolution and
does not wish to recommend adoption.
3. Starting time for Planning Commission Meetings:
M/S/P Michels/Graves - To call the Planning Commission meetings to
order at 7:00 (instead of 7:30) for three months, and to evaluate the
early starting time after three months. (Carried 8-0)
4. Late December Meeting:
Consensus of the Commission was to cancel the late December meeting.
However, the Commission will be notified, and a meeting will be called
if anything requiring immediate action by the Planning Commission
should arise.
5. Public Hearing for CUP and Shoreland Permit application for a
nursery in a RR zone for Ron Smith at 9999 10th Street North.
Pursuant to published notice, this hearing was opened at 8:00 p.m.
in the Council Chambers.
Lake Elmo Planning Commission Meeting 12/12/83 Page 2
In response to City Engineer's memo of December 8, 1983, in which he
states that water and sanitary facilities should be provided for the
employees, Mr. Smith stated that the water and sanitary facilities in
the house could be used by the employees. The present house could
also be used for the exchange of money with customers.
Mr. Smith stated his nursery stock would consist of trees, shrubs
and landscape timbers. He further stated that he would like to
restructure his storm damaged barn, and that he has already done some
berming by planting trees. Smith stated that at this time his
equipment consists of one farm tractor. He further stated that he may
deal in gravel sometime in the future, depending on obtaining the
right equipment.
Concerns were expressed by the Commission regarding potential
expansion of the business; that expansions have a tendency of taking
place and getting out of hand. The permit should specifically state
what can be done under the CUP, so the City has control over future
expansion of the business.
T
M/S/P Michels/Moe To recommend to the City Council approval of the
CUP and Shoreland Permit application for Ron Smith, 9999 loth Street
North, in accordance with City Standards. (Carried 8-0)
Commission requested that the City Council be specific in what will be
allowed under this CUP.
6. Public Hearing on Comprehensive Plan amendments for:
1. MUSA Line
Pursuant to published notice, this public hearing was opened at 8:30
p.m. in the Council Chambers.
Dreher stated his concerns were for the residents in Section 32 that
have been paying sewer assessments for 10 to 15 years. The new
proposal would eliminate the sewer for these residents, and they have
been paying for it, with the intention of getting it before 1990.
Recommendation was made that the Met Council staff be advised that
Lake Elmo would reduce the area to some extent, but will not reduce
it to the point of excluding a property owner that has been paying
sewer taxes.
The public hearing was closed at 8:50 p.m.
M/S/P Graves/Nazarian To recommend to the City Council that the MUSA
Line be changed to run down the Section 32 Line, east on 4th Street,
and south on Inwood. (Carried 8-0)

2. I-94 Concept Plan
Pursuant to published notice, this public hearing was opened at 9:00
in the Council Chambers.
Discussion regarding Larry Whittaker's memo of 11/22/83. The proposal
showed: (1) Commercial development between Co. Roads 13 and 19, when
sewered; (2) Leave everything past Co.Road 19 - POST 1990 Highway
Business and control development by keeping RR zoning and discouraging
any plats of clusters or 10 acre lots in the 500 feet closest to the
service road; so that the land could be available for HB. (3)
Continue to work on standards to prevent an undesireable character
from developing further along the I-94 strip - and remain open-minded
about development proposals that aren't exactly within the "planned
area".
Discussion between the audience and the Commission regarding the 1/8
mile setback for commercial development.
Concerns of the developers were that they would not be able to fully
develop their land if the setback remained at 1/8 of a mile.
Discussion regarding the placement of signs in Lake Elmo. Concerns
expressed by Gene Peltier were that no signs could be erected in a RR
zone.
Mayor Eder suggested that the area be mixed business. It should be
rezoned as such to keep residential development away from the area.
He further suggested that the Commission wait for the decision on the
racetrack, before doing anything.
Jim Olson, property owner along I-94 asked the Commission to put as
much latitude as possible within the corridor proposed to be zoned
commercial.
Dorothy Lyons presented the results of her telephone
development plans of Woodbury, Afton, etc.
Discussion of the size of the sewer pipe in Section
to be installed, who it will service, etc.
Prince suggested that the I-94 Investors meet
for an exchange of ideas.
Jim Olson stated that it was difficult to say at this time when he
would develop his land or how he would do it. He further stated that
he felt that the Met Council is not always correct in their planning,
and shouldn't be allowed to do Lake Elmo's planning for Lake Elmo.
with
Dorothy Lyons asked the Commission to look at
surrounding communities to see what they are doing
the I-94 area.
The public hearing was closed at 9:50 p.m.
The meeting was adjourned at 10:00 p.m.

The Planning Commission is an advisory body to the City
Council. One of the Commission's functions is to hold public
hearings and make recommendations to the City Council. The City
Council makes all final decisions on these matters.
Lake Elmo Ordinances require that certain documents and
information be included in applications. The Planning Commission
may postpone consideration of an application that is incomplete
and may for other reasons postpone final action on an
application.
For each item, the Commission will receive reports prepared
by' the City Staff, open the hearing to the public, and discuss
and act on the application. If you are aware of information that
hasn't been discussed, please fill out a "Request to Appear
Before the Planning Commission" slip; or, if you came late, raise
your hand to be recognized. Comments that are pertinent are
appreciated.

RE: AGENDA MEMO FOR 12/12/83 PLANNING COMMISSION MEETING
MINUTES: Attached are the minutes from the last Planning
Commission meeting held on November 14, 1983 for your
consideration.
CITY OF OAKDALE RESOLUTION: Attached is the Resolution Lake Elmo
adopted following Joint Planning Commission meetings with
Oakdale, and the Resolution Oakdale adopted. Oakdale is asking
Lake Elmo to also adopt the Resolution it passed in late
November.
Prior to adopting our Lake Elmo Resolution, I asked the Oakdale
staff about their concerns and included them in our Resolution.
The Lake Elmo Resolution was passed mainly because of the
drinking water issue, and to let the County know that Lake Elmo
is receptive to most any solution to this water problem that the
County deems best.
The Oakdale Resolution is broader in scope. It talks about other
items discussed at the joint meeting in very definite terms.
Before this resolution was passed by Oakdale, I received a draft,
and in turn, expressed my concerns to the Oakdale staff. None of
my concerns resulted in any changes in this Oakdale Resolution.
My concerns with the Oakdale Resolution are:
1. The last "Whereas" on page one - - This statement is much
too definite. The groups discussed the possibility of
relinquishing the funds and indicated that Lake Elmo
would consider any Oakdale request on this issue, but,
at no time did the Lake Elmo group say in fact that we
would give up these County funds. The Planning
Commission does not have this authority. Lake Elmo does
not even have the County 5 year CIP for streets as the
County is currently drafting this plan. It is much too
soon to make this a definite statement in a Resolution.
The County CIF may not even need Lake Elmo to
"relinquish" these funds for Oakdale's 50th Street, but
at the right time, and if it is needed, Lake Elmo would
give due consideration to any Oakdale request.
Lake Elmo Planning Commission Agenda Memo November 8, 1983 Page 2
2. The fourth "Whereas" on page 2 - - This "Whereas" states
"Providing for sanitary sewer service ---" and again is
too much of a commitment on the part of Lake Elmo. I
asked Oakdale to have this read, "The possibility of
providing for sanitary sewer service ---".
If the City of Oakdale would have followed my two suggestions to
"tone down" the definite commitment on the part of Lake Elmo in
these two noted "Whereas", I then would have had no problems
with this Oakdale Resolution.
However, as the Oakdale adopted Resolution reads, I strongly
recommend that Lake Elmo does not adopt this Resolution. If the
two staffs cannot agree on proper wording, then simply stated:
The Planning Commission's met together and the Lake Elmo City
Council adopted a Resolution and the Oakdale City Council adopted
a slightly. different Resolution.
The City Attorney reviewed the Oakdale Resolution and simply
indicated that the Lake Elmo City Council could adopt it if so
desired.
LAKE ELMO PLANNING COMMISSION STARTING TIME: A member of the
Planning Commission requested that this item be placed on the
agenda. The Code states that the Planning Commission will meet
monthly on the 2nd and 4th Monday at 7:30 p.m. (However, the
Park Commission meets at a different time than indicated in the
Code.) I have no problems with meeting earlier in the evenings,
and we could try this for a while if so desired. If starting
earlier in the evening is tried and works out, we should
eventually change the Code.
LATE DECEMBER, 1983 PLANNING COMMISSION MEETING???? The last
Planning Commission meeting in December is scheduled for Monday,
December 26, 1983. This is a legal holiday and the City Offices
are closed. We could meet on Tuesday, December 27th, 1983, if
the group feels a meeting is needed. I understand that the past
practice has been to cancel this last meeting in December. At
this point in time, I have no agenda item scheduled that would
require that meeting in late December.
PUBLIC HEARING FOR RON SMITH CUP: Attached is the application
for a Conditional Use Permit (CUP) for Ron Smith, at 9999 10th
Street to operate a nursery in a RR zone, his tax statement
indicating the legal description of the property; a legal survey
of the lot; a site plan proposal for the lot; a map showing the
location of the lot; four pages from the City Code relating to
CUP'S; and a list of the existing CUP'S in Lake Elmo.
A report from City Engineer, Larry Bohrer, is being mailed out
individually.
The Building Official reviewed the material, and while he did not
prepare a report, he recommends approval. He further indicated
that no new CUP'S have been issued in 1983, and that no
complaints about the existing CUP'S were received in 1983.
I am not an expert on land use, but this seems to be a reasonable
request and use of the land. Staff cannot forsee any problems
that this CUP would present and recommends approval.

PUBLIC HEARING ON COMPREHENSIVE PLAN AMMENDMENTS:
City Consultant, Larry Whittaker, has prepared a memo on these
amendments (which is enclosed) and will be present at the meeting
for this discussion. He will explain what the Met. Council is
requesting concerning the MUSA line and will explain the options
we have regarding the location of the MUSA line.
The memo also summarizes the October 24th discussion on the I-94
Concept Plan. Whichever proposal, if any, is selected by the
Planning Commission will be forwarded to the City Council, and
this should take place soon. A decision to make no changes in
the Comp. Plan is a decision to leave the entire 1/2 to 1/4 mile
strip along I-94 as future commercial and would not need Council
action. Larry is very concerned that the City take some steps to
insure "quality, staged, commercial development" in this area.
Larry's memo also discusses the remaining issues from the 1983
Planning Commission work plan. As time allows, these items
should also receive some discussion after the Public Hearings.
OTHER NOTES:
1. At the November 15, 1983 City Council meeting, the
