One of the Commission's functions is to hold public hearings and make recommendations to the City Council. The City Council makes all final decisions on these matters. Lake Elmo Ordinances require that certain documents and information be included in applications. The Planning Commission may postpone consideration of an application that is incomplete and may for other reasons postpone final action on an application. For each item, the Commission will receive reports prepared by the City Staff, open the hearing to the public, and discuss and act on the application. If you are aware of information that hasn't been discussed, please fill out a "Requet to Appear Before the Planning Commission" slip; or„ if you came late, raise your hand to be recognized. Comments that are pertinent are appreciated. AGENDA LAKE ELMO PLANNING COMMISSION AUGUST 26, 1985 7:30 p.m. Meeting Convenes 7:40 p.m. 1. Minutes - August 12, 1985 2. Public Hearing for Large Lot Subdivision (preliminary plat) for Linda Larson located at the E1/2 of NE1/4 of Section Wand the E1/2 of the S1/4 of the SE1/4 of Section 2. 3. Call public hearing for rezoning from RR to R1 a parcel of land described as Part of Government Lot 3, Section 24. Applicant is Gene Peltier 4. Call public hearing for rezoning from RR to R1 a parcel of land described as Part of Government Lot 2. Applicant is Raymond Mester. 4. Other el LAKE ELMO PLANNING COMMISSION MINUTES AUGUST 12, 1985 Chairperson Nazarian called the meeting to order at 7:30 p.m. in the Council Chambers. Present: Novak, Johnston, Graves, Prince, Lundquist, Moe, Kuettner, Lyall (arrived 7:35). Absent: Lang, Schiltz 1. Minutes: July 22, 1985 M/S/P Lundquist/Kuettner - to approve the minutes of the July 22, 1985 Planning Commission meeting as presented. (Motion carried 6-0-2<Graves, Johnston›). 2. Public Hearing for Preliminary Plat, and Rezoning for Finnemann Enterprises (Midland Meadows). Pursuant to published notice, this public hearing was called to order by Chairman Nazarian at 7:35 p.m. in the council chambers. Mr. J. R. Stockstead explained the need for rezoning from R1 to RR and for preliminary plat approval for Finneman Enterprises (Midland Meadows) on loth Street North. They will now subdivide into 12 large lots, 5 being 12 acres in size, 5 lots in 7 acre size and 2 lots in 4 acre size. The 12 acre lots on the west side would be rezoned RR. Bruce Folz, representing Mr. Stockstead, explained in detail the presentation. The driveways will be along l0th Street North and along Lake Elmo Avenue. Nazarian acknowledged a letter from Lawrence Bousquet, Director of Operations, Washington County, dated 7-23-85 to Bruce Folz, a list of property owners notified, letter from Larry Bohrer to PZ Members dated 8-8-85, letter from Nels Nelson, Barr Engineering, to Bruce Folz dated 7-31-85 and Drainage Study for Midland Meadows by Bruce Folz dated 7-10-85. Prince brought up the letter from Washington County requesting not allowing driveways at all to access directly to CR 70. Bruce Folz explained that now they ask for three driveways. One driveway would serve two houses with 10 cars per house and that would make 20 cars coming in and its absurd to think that this would create a traffic problem. The road is flat, and there are no horizontal or vertical curves. Folz is willing to listen to any good arguments why access should be denied on that road and feels that the County is unreasonable. Bohrer in his letter of 8-8-85 stated the applicant's offer to construct common driveways is reasonable in this case. Kuettner questioned what the benefit was for rezoning. Folz replied rezoning makes it possible for these parcels to be able to have horses. (Motion carted 8-1<Novak-shares concerns of the Valley Branch Watershed District›). 2. Public Hearing for Rezoning from RR to R1 and Preliminary Plat approval for Raymond Mester in Section 10. POSTPONED INDEFINITELY . The applicant was not ready and this public hearing will continue at a later date. 3. Public Hearing (continued) for Clapp Thomssen Pursuant to published notice, this public hearing was called to order by Chairman Nazarian at 8:30 p.m. in the Council chambers. Don Bishop explained this is not a Clapp-Thomssen Corporation Enterprise, but the owners are associated with Clapp-Thomssen. Nazarian acknowledged the list of property owners within 350 feet, letters dated 7-19-85 and 8-8-85 from Larry Bohrer to the PZ Members regarding the Preliminary Plat Review and Lake Elmo Heights -Preliminary Plat Review. Chairman Nazarian excused Planning Commission Member Dan Novak because he was an adjoining property owner. Kuettner asked if there were only three lots, lot 1, 4 and 5 that are over two acres and do the lots that are over 2 acres all have a drainage easement on them. Also asked if the drainage conformed to the City Standards and the one percent rule. Bruce Folz answered yes to all three questions. Prince questioned the park donation and Folz answered it will be in cash value. Novak stated that in Tablyn Park there is suspected nitrate problems. For example, an owner one block from the property had 16.8 and an owner two blocks from the property had 8 or 9 and Novak gave the names of Reitberger and Pribnew. Folz explained that their water will be tested and if the well water doesn't pass you cannot use the well. Some of the lots in Tablyn Park are too small and the drainfields are poorly designed and should be LAKE ELMO PLANNING COMMISSION MINUTES AUGUST 12, 1985 PAGE 3 rebuilt. M/S/P Kuettner/Graves - to recommend to the City Council to approve the preliminry plat and final plat for 11 lots in Phase I. (Motion carried 8-0-1<Novak>). M/S/P Kuettner/Moe - to recommend to the City Council approval of a variance allowing 3 lots, 1, 4, and 5, greater than 2 acres in size. (Motion carried 8-0-1<Novak>). 4. Large lot subdivision for Linda Larson. Mark Vedder, North -Northwest Realty, representing Linda Larson made a short presentation. The total amount of land is approximaely 91 acres. 71 acres lies along the west side of 17 and south side of 50th Street. 20 acres being west on 17 and abutts 50th St. from the north. Larson proposes to split property into 9 parcels. Eight of the parcels will be sold as building sites. Parcel A was sold to a neighbor to the south to add on to their present property. Mark Vedder had questions regarding park donation fees that should be brought Up at the next meeting. 5. other Dean Johnston has submitted his resignation from the Planning Commission as of this August 12, 1985 meeting. Dean will pursue his MBA and feels that his evening classes will prevent him from devoting the necessary time to the Commission. M/S/P Graves/Johnston - to adjourn the Planning Commission Meeting at 9:15 p.m. August 8, 1985 To: Planning Commission Members From: Marilyn Banister, Acting City Administrator Re: Agenda Memo for August 12, 1985 Planning Commission Meeting 1. Public Hearing for Rezoning from R1 to RR and Preliminary Plat approval for Finneman Enterprises (Midland Meadows) on 10th Street North, approximately 1/4 mile west of Lake Elmo Avenue. Attached are the applications for the rezoning and preliminary plat, the list of property owners that were notified of these public hearings, a letter from Washington County to Bruce Folz regarding CSAH 17 and CR 70, a preliminary plat of Midland Meadows and a report from Larry Bohrer. Bruce Folz is representing Mr. Stockstead and should be present at this meeting to answer any questions from the Commission. 2. Public Hearing for rezoning from RR to R1 and preliminary plat approval for Raymond Mester at the property legally described as Part of Government Lot 2, Section 10. Mr. Mester does not have ready all of the information required for this preliminary plat and asked that this application be postponed indefinitely. 3. Public Hearing (continued) for Clapp Thommsen/Don Bishop for Preliminary Plat and Final Plat Approval for 11 lots in Phase I. Attached is the application, list of property owners notified of this public hearing, and two reports from Larry Bohrer. If the Planning Commission views this proposal favorably, its recommendation to the City Council should be to approve the final plat contingent upon the approval of construction plans and specifications, entering into a developers agreement with the City, and furnishing the required security bond, plus any other concerns that Larry Bohrer may have. Bruce Folz, representing Mr. Bishop, will be present at this meeting to answer any questions the Commission may have. 4. Call public hearing for Linda Larson for large lot subdivision at the property legally described as E 1/2 of SE 1/4 Section, 2 and the E 1/2 of the NE 1/4 of Section 11 except parcels 37011-2210 and 37011-2250. Mrs. Larson proposes to subdivide the approximately 91 acres into lots of 10 or more acres, with the exception of the south 9.45 acres which will be sold to the neighbor to the south to add to their existing property. According to the code, the Planning Commission is to review the application and information submitted and call a public hearing. This public hearing is tentatively scheduled for August 26, 1985 at 7:40 p.m., but can be changed at the discretion of the Planning Commission. 5. Other If any Planning Commission member wishes to add anything to the agenda, it can be done at this time. OTHER INFORMATION Update on City Council action from 8-6-85: Approved a shoreland permit and side yard setback for Russell Anderson at 4891 Olson Lake Trail. - Approved the large lot subdivision for Gordon Lundholm as recommended by the Planning Commission. Approved a rezoning and large lot subdivision to Frank and Arlene Meyer in Section 3 off of Keats Ave. - Approved a shoreland permit for Quigley Construction for Lots 3 and 4 DeMontreville Highlands 5th Addition. - Approved the site plan and granted a simple lot division to the Lake Elmo Physicians Clinic. - Voted not to pump from Lake Jane to Nippoldt's property, but voted to proceed with obtaining the necessary permits to pump from the DNR and VBWD in case a suitable site is found. County Commissioner Artie Schaeffer suggested that the City look at the possibility of pumping to Berchen's pond. It was noted that Washington County is against any pumping to a site in close proximity to the contaminated landfill as this could adversely affect the work they have done to clean up this mess. In relationship to the flooding problem, we just received the list of water levels from VBWD which may be of interest to you. - Will interview five canidates for the City Administrator's position at 5:00 p.m. on Tuesday, August 20th.
