HomeMy WebLinkAbout04-22-91 PZMThe Planning Commission is an advisory body to the City Council. One of the Commission's functions is to hold public hearings and make recommendations to the City Council. The City Council makes all final decisions on these matters. Lake Elmo Ordinances require that certain documents and information be included in applications. The Planning Commission may postpone consideration of an application that is incomplete and may for other reasons postpone final action on an application. For each item, the Commission will receive reports prepared by the City Staff, open the hearing to the public, and discuss and act on the application. If you are aware of information that hasn't been discussed, please fill out a "Request to Appear Before the Planning Commission" slip; or if you came late, raise your hand to be recognized. Comments that are pertinent are appreciated. AGENDA LAKE ELMO PLANNING COMMISSION APRIL 22, 1991 7:30 p.m. MEETING CONVENES 1. AGENDA 2. MINUTES: April 8, 1991 3. FOX FIRE MANOR (Continuation) Rezoning to RE and Preliminary Plat. Ruben Lauseng, 9591 60th Street, wished to state his concern of how close exactly 55th Street will come to his property. The plat appears to show this street touching or entering onto the corner of his property, and he would like the Planning Commission to address this. At the last Planning Commission meeting the developer promised to get in touch with Mr. Lauseng, but has not contacted him yet Administrator Kueffner gave Mr. Lauseng a copy of Valley Branch Watershed's preliminary report which should address some of Mr. Lauseng's concerns. At its April 2nd City Council meeting, the City Council voted to accept the new Park Dedication Ordinance with the reasonable portion to be 7% of the total land in a proposed residential subdivision. The City Council also voted to accept a fee in lieu of land from Arabian Hills, and looked at a new proposal from the Parks Commission Chair, Nancy Hansen, requesting park land from Rolling Hills, possibly Steve Korhel's property and possibly Fox Fire Manor. The Parks Commission will be meeting on Monday, April 15. M/S/P Thomas/Enes - to recommend approval of rezoning the property to be known as "Fox Fire Manor" from RR to RE on the basis that this request does comply with the Comprehensive Plan. (Motion carried 8-1, against: Bucheck, felt more reasons should be given). Greg Frank, representing Pacesetter Properties, stated he would prefer the Planning Commission recommend approval of the preliminary plat tonight and pass it on to the City Council. The Parks Commission will meet April 15th and will make their recommendation regarding park land dedication to the City Council which will meet April 16th. Lake Elmo Planning Commission Minutes April 8, 1991 Page 2 Steve Korhel, 5540 Keats Ave., stated he would like the Planning Commission's reaction to his problem of future access to his property from the west, as none is provided for in this preliminary plat. City Planner Black stated Mr. Korhel already has access to his property from Keats, from a topography point of view, another access to his property would be more amenable from the North. Mr. Black stated the Planning Commission will not be land locking Mr. Korhel by approving this plat. Mr. Korhel stated there is a 75' drop in the middle of his property. To construct a road from the north or east would requir much grading. Chairman John stated Mr. Korhel has not brought in a formal road plan and there is not an application before the Planning Commission, therefore suggested Mr. Korhel get in touch with the developers to resolve his concern. Commissioner Mcleod asked Mr. Korhel how long he has known about the proposed subdivisions. Mr. Korhel answered around the first of this year. Commissioner Johnston stated it appears the developers have made an effort to get together and develop roads that make sense and tie in with existing road, and while Mr. Korhel's concern can be appreciated, it is speculation. Commissioner DeLapp suggested changing the northern part of the road to be a curve instead of a 90 degree angle, and the cul-de-sac towards Mr. Brogren's property be eliminated to become a private driveway and grant a variance, therefore eliminating the City's responsibility for upkeep. M/S/F Johnston/Conlin - to recommend approval of the preliminary plat for "Fox Fire Manor" (rev. 3-6-91) subject to meeting the recommendations 1-5 of City Planner Black's report, page 3, dated March 21, 1991 (item #5 amended to read "The applicant shall be required to satisfy the Park Dedication requirement according to the recommendation of the Parks Commission and approval of the City Council), subject to meeting the conditions 1-7 of Barr Engineering's report dated March 22, 1991, and as amended by Commissioner DeLapp which would require a variance for road fontage on lot 5. (Motion failed 3-6). M/S/P DeLapp/Thomas - to recommend approval of the preliminary plat of "Fox Fire Manor" (rev. 3-6-91), subject to meeting the recommendations 1-5 of Mike Black's report page 3, dated March 21, 1991 (item #5 amended to read "The applicant shall be required to satisfy the Park Dedication requirement according to the recommendation of the Parks Commission and approval of the City Council), subject to the conditions 1-7 of Barr Engineering's report dated March 22, 1991, subject to amending the road design as shown on "Exhibit A", and recommend granting a variance for lack of road frontage on lot 5, and that the landscaping standards established for the RE Zone Ordinance be complied with. (Motion carried 9-0). Lake Elmo Planning Commission Minutes April 8, 1991 Page 3 Mr. Liles stated he would certainly disclose to potential property buyers the farm's nearby cannot be held liable for noise, debris, or smell, and the same would be disclosed about Lauseng Stone Co. M/S/P Bucheck/Stevens - to recommend the City Council provide for an access for obtaining a road easement to provide for the long term access to the west end of Mr. Korhel's property. (Motion carried 5-4, against: Johnston - gives a neighboring land owner veto power over another persons use of the plat; Thomas - agrees with Johnston and not enough information present; John - brining another issue when a site plan had already been approved; Conlin - concept plan of Rolling Hills should be looked at as the most sensible place for access). 4. CONCEPT - REZONING FROM RR TO AG: Neil & Deb Krueger An application has been submitted for the rezoning of approximately 36 acres from RR to Ag. The property is legally described in part as that part of E1/2 SE1/4 Section 11 T29 R21 lying northerly of centerline of currently existing east west roadway known as 43rd Street N. M/S/P Enes/Johnston - to call a public hearing for April 22, 1991 at 7:30 p.m. to consider this request for rezoning. (Motion carried 9-0). Chairman John suggested addressing item 7 at this time with item 5 and 6 to follow. 7. LANDFILL UPDATE FROM COMMISSIONER CONLIN. Commissioner Conlin stated Met. Council recently passed a resolution that park land and sensitive Mississippi waterways be exempt from landfill sites. This is only a resolution, not a law, but it will hopefully make the County Commissioners more comfortable with voting against the landfill in the park. The County Board will be voting on a resolution to support the legislation on sensitive ground water and dropping the landfill site at 9:00, Tuesday, April 9. 5. LIMITED BUSINESS (Continuation) M/S/F Stevens/Enes - to accept the Limited Business Ordinance as drafted and present it as is, with the addition of Veterinary Clinics under (B) (1) Permitted Uses. (Motion failed 3-6) Chairman John stated Permitted and Conditional Uses should be covered again due to some items being tabled at previous meetings. Commissioner Mcleod stated Veterinary Clinics should be added as a Permitted Use under (B)(1). Commissioner Conlin stated the zone is there, but there is no ordinance to give to potential applicants. Commissioner Stevens felt we should give what the Planning Commission has so far and give it to the Council. Commissioner Bucheck was concerned on page 4, item (1)(B) the words "may be made" should be changed to "shall be made". Commissioner Thomas stated that was his motion and the words "may be made" was his intent so that anything else would be left to the discretion of the City Council. Lake Elmo Planning Commission Minutes April 8, 1991 Page 4 Commissioner Stevens suggested eliminating golf courses and driving ranges from this ordinance due to the fact they don't bring a lot of tax dollars. Commissioner Conlin suggested adding indoor storage, gasoline sales and convenience stores to the Uses. M/S/F Stevens/Bucheck - to eliminate Vineyards, Golf Courses and Driving Ranges from the Limited Business Conditional Uses. (Motion failed 3-6). M/S/P Thomas/Johnston - to table discussion of the Limited Business Zone Ordinance. (Motion carried 7-2). M/S/F Conlin/Bucheck - to give full attention to this Ordinance at the next Planning Commission meeting. Administrator Kueffner stated the next Planning Commission meeting will have three public hearings. The Commission discussed that no additional information is needed to finish this Ordinance, so the only hold up appears to be the disagreement on Permitted and Conditional Uses. The Commission feels split, and cannot come to a complete consensus. Some Commissioners feel the new Economic Development Board will be taking over their job. Some Commissioners felt the Commission has taken too long on this Ordinance. M/S/P Bucheck/Stevens - to recommend to the City Council the Limited Business draft dated 2-25-91, with the addition of Veterinary Clinics under (B)(1) Permitted Uses. (Motion carried 5-2-2, abstain: Johnston, Thomas) 6. 1989 AUDIT REPORT Commissioner Bucheck stated the Mayor said dense development was needed on I-94 because the Auditor's report stated this. Commissioner Bucheck stated the Auditor's report did not state this, it stated the way our taxes are changing has a lot to do with State actions, and that the City needs to consider the fact it may have to increase the taxes of its citizens. Commissioner Bucheck understands the report is saying things are changing, and also that the City needs to change the way it deals with its money. Commissioner DeLapp stated the State has a policy that takes 400 of all commercial revenue out of any City and distributes it region wide, for example if a building goes into Woodbury - Lake Elmo gets some of that 40%; if a building goes into Lake Elmo - we lose it. Commissioner DeLapp also stated the taxes in Lake Elmo are now the lowest in our area that allows any commercial development at all. Commissoner Mcleod stated a recent article in the Pioneer Press shows Lake Elmo's taxes on a comparable property were higher than Woodbury or Oakdale. Chairman John stated this is not a Planning Commission issue and unless Commissioner DeLapp sees some means of establishing some understanding of how to increase the tax base of the City by approving certain properties which are more revenue producing than others it is just a political discussion. Chairman John suggested that by the first meeting in May, Commissioner DeLapp undertake getting a comparible study of housing and businesses, such as Lake Elmo Bank, and what the Net effect of those properties are in terms of the revenue the Council gets, because then it might Lake Elmo Planning Commission Minutes April 8, 1991 Page 5 control our thinking in terms of what we're proposing to approve or what we're proposing to compromise on in order to create a better tax base for the City. M/S/P Johnston/Stevens - to adjourn the meeting at 10:30 carried 9-0). p.m. (Motion The Commission requested Administrator Kueffner draft a letter thanking Jim Arkell for being on the Planning Commission, and Chairman John will sign it. REQUEST FOR PLANNING COn?ISSION REVIEW Meeting Date: April 22, 1991 AGENDA TOPIC: PUBLIC HEARING: Request to rezone 36 acres from RR to Ag - Neil & Deb Krueger ITEM NO. 3. This is a public hearing to consider the'request of Neil & Deborah Krueger for a rezoning from Rural Residential (RR) to Agricultural (A). A copy of the public hearing notice is attached along with the list of property owners notified. Section 301.060 E. (page 301-25 thru 301-27) outlines the procedures and requirements for a rezoning. As noted in the information you received at your last meeting, the Krueger's are requesting this rezoning so that they can have an open sales lot to sell Christmas trees, and propose to remodel an existing building to include an office and small gift shop. The uses proposed by the Krueger's appear to be allowed under "Alternative Uses" Section 301.070 D.1.b. (page 301-30). That is not what you are considering at this public hearing, but you may want to familiarize yourself with this ordinance. Getting back to the rezoning before you, the Ag zoning district requires a minimum of 40 acres. (See Section 301.070 D.1.d. Minimum District Requirements. However, there is a provision for nominal 40 acre parcels and that reads: A forty acre parcel not reduced by more than 10% due to road rights -of -way and survey variations. The Krueger's have a 36 acre parcel, reduced by right-of-way on both Lake Elmo Avenue and 43rd Street. Therefore, staff feels that the applicant meets the intent of the nominal 40 acre standard. (A) The applicants have provided a statement of reason for the rezoning request. (over) (B) The proposed land use (Ag) conforms to the future land use designation in the 1990 Comprehensive Plan. (1) The soil map (see Comp. Plan Map) does indicate the property is Agriculturally suitable. (Also note there is an existing tree farm on the site.) (2) A map is attached showing all general location of the property and the land use within at least a 350' radius. (C) Records at the City office and at Washington County indicate this property is owned by Neil & Deborah Krueger. (D) Applicants have provided a list of property owners within 350' of the property. Planning Commission Action "The Planning Commission shall make its report on the application to the council, in writing, (your minutes are used), within 60 days after the public hearing, unless the applicant consents to extend consideration by the Planning Commission. The report shall recommend that the amendment be granted or denied and shall include the Planning Commission's recommendation as to any conditions to be imposed, if the amendment is granted, including time limits or provisions for periodic review and shall state the reasons therefore." The attached letter regarding a street name change is self-explanitory. I know that some of you feel very strongly about making such a change, probably city-wide. It has even been suggested in the past that we adopt a system similar to that of Woodbury. This may be a worthy project for the Commission to put on its work plan, and if you concur I feel that we should do some research into why thie system was adopted in the first place; that we should'receive input from our Fire Department and the Sheriff's Department. I also think that we could get a copy of Woodbury's plan '(or any other City that has chosen not to go with the Uniform Name and Numbering system). I only hope that you chose to carefully review the health, safety and welfare element (which was probably one of the. reasons the "System" was adopted), when considering or proposing any changes. 04 '19,91 09.14 KILL MICRr1L OF P1MERIc'dl 00 BULL M(CfiAL. IN reviewing our last two plats, it has become quite apparent that without a street plan, our planning for future developments as well as future parks becomes very difficult. I have talked to Wyn John about this and he agreed with this concept. I also brought it up at the last council meeting, and the council authorized expenditures up to $1,000 to develop such a plan. I will have a copy of a plan from another City that -was done by Mike Black so you can review the procedure with him at the meeting. Wyn has suggested that a subcommittee be appointed to work with Mike, to bring a plan back to the Commission for review. Wyn stated he would like to sit on this subcommittee, and has suggested that you appoint him along with Jim Mcleod, Rita Conlin and Steve DeLapp.
