DRIVEWAY WIDTHS (Sub -Committee Report) Commissioner Delapp drafted amendments to the existing ordinance on driveways. The Planning Commission made amendments to the draft, and the consensus was to get advice and comments from Building Official Jim McNamara. 4. Concept Review: Comp. Plan Amendment to Change Future Land Use Designation of Beaubien Property to RED M/S/P Thomas/Johnston - to strike this review due to lack of proponent. (Motion carried 7-0). 5. Concept Review: Rezoning and One Lot Subdivision: Gene Peltier. Gene Peltier, 10376 Hudson Blvd., is requesting to subdivide and rezone a parcel of land located on County Road 17 near I-94 (adjacent to "The Forest" development). The parcel is approximately 22 acres and is currently zoned RR. The request is to subdivide approximately 2.5 acres (which has a house on it) and rezone to RE or Rl . Gene stated he is planning his estate now for his children's sake, so that they do not have to contend with this after he's gone. The consensus of the Planning Commission is to rezone the 22 acres to RE, plat the one lot at 2.5 acres, and request a variance from the 250 foot diameter requirement, the hardship being it would create an odd shaped lot due to the location of the existing house and it would hinder future platting access & design. Lake Elmo Planning Commission Minutes December 9, 1991 Page 2 6. MUSA The Planning Commission last discussed the MUSA district ordinance on November llth at a workshop meeting. The City Council has reinstated the MUSA amendment to the Comp. Plan, therefore the Planning Commission called a workshop meeting on Monday, December 16th at 7:00 p.m. at City Hall. 7. CSAH 10 Recommendation M/S/F Conlin/Stevens - to recommend County Road 10 be a divided highway from I-694 to the start of the pond, where it should then taper down to two lanes and remain two lanes to County Road 13, in order to preserve the pond. (Motion failed 2-3-2, against: McLeod, Delapp, Thomas, abstain: John, Johnston). M/S/F Delapp/Stevens - to recommend County Road 10 be a divided highway from I- 694 to Helmo Ave., where it should then start to taper down to two lanes and remain two lanes to County Road 13. (Motion failed 2-4-1, against: Conlin, Johnston, Thomas, McLeod, abstain: John). M/S/P McLeod/Thomas - to recommend County Road 10 be a divided highway as the Washington County recommended, but to span the pond with a bridge instead of fill. (Motion carried 4-3, against: Delapp, Stevens, Conlin). 8. Oakdale Flidden Valley Development - Discussion Only. The Lake Elmo Planning Commission comments regarding the "Hidden Valley" housing development proposal in Oakdale are as follows: There is not a "park" in the plan, the plan appears too dense, the plan goes over wetlands, poor road design, homes are planned to be built over gas lines, entrance onto Highway 36 is too dangerous, there is a large concern of run off into Olson Lake, what will be the impact on the school districts?, will an EAW be requested? 9. Other - Senior Housing M/S/P Johnston/Thomas - to recommend Chairman John contact Terri Gallus, of HRA, to get more information on senior housing in Lake Elmo. The regularly scheduled PZ meeting for December 23rd has been cancelled. The meeting was adjourned at 10:30 p.m. PZ DRAFT Revised 12-9-91 1602 DRIVEWAYS 1602.060 General Reouirements A. Discussion with Dick Herold & Don Wisniewski, Washington County Highway Engineers, regarding upgrade of 10th Street. -Don Wisniewski, Director of Public Works and Dick Herold, Design and Construction Engineer, for Washington County, presented and explained the CSAH 10 upgrade proposal for a four lane divided highway from I-694 to just east of County Road 13. The cost for the four lane project is approximately $1,000,000. Mr. Herold presented a graph showing the traffic increase over the past fifteen years (1975 - 1990). Mr. Herold stated the traffic counts in the 10th Street area are approaching 7,000 cars per day (1,000 cars at peak hours) which is the threshold for a four lane road. Generally 10,000 cars per day is the point at which a four lane divided highway is necessary. The normal design period is 20 years; in Washington County the normal increase in traffic over a 20 year period is about 1.8 times, but in this area due to the close proximity of the freeway systems and interchanges (I-694 and I-94) that increase is probably closer to 3 times. Mr. Herold stated traffic projections are based on facts & figures from the past and present & future proposed development in the area and are very reasonable. Chairman John asked if the road is enlarged - won't that increase traffic? Mr. Herold stated the traffic will increase even if kept at two lanes - people will take the shortest route to their destination, plus new businesses developing in the area, such as the proposed Walmart, and new housing developments will further increase traffic. Commissioner McLeod asked 1) when were the traffic counts taken, and were any of the collateral roads blocked off or under construction at the time the counts were taken? 2) why do we need such a wide right- of-way? 3) do you feel filling the pond will be successful? Mr. Herold presented a graph showing historical traffic counts over several years which indicate a steady rise in traffic. The right-of-way is wide due to the amount of settling that will occur and for drainage. Mr. Herold recognizes it is a tough area, but they have investigated it and feel that filling can be successful. The Commission suggested why not build a bridge rather than filling. Mr. Wisniewski stated that they are making a very large public investment to rebuild this road, and to build a bridge over the lake would cost twice as much, it's not cost effective, Chairman John asked how long it was before the two lane on Radio Drive had to go to four lane? Mr. Herold answered within ten years, and they have considered staging this project like Radio Drive. Lake Elmo Planning Commission Minutes November 25, 1991 Page 2 By providing for a four lane road now - developing property owners will be able to plan better. Mr. Herold stated the alignment has shifted to the North side of the road due to the considerable amount of wetlands on the South side of the road, and the No Net Loss of Wetlands requirement from the State and Federal - EPA, DNR and Core of Engineers. Sue Dunn, 11018 Upper 33rd St., asked if an EIS will be done? Mr. Herold replied and EAW will be prepared. Mr. Herold stated they are hoping to start construction this next summer, depending on buying right-of-way, municipal approvals and preparing/processing an EAW, and an engineering design solution for going across Armstrong lake. Chairman John thanked Mr. Herold and Mr. Wisniewski for their time and presentation. Mr. Herold stated the commission can call him if they have anymore questions. The Planning Commission will make a recommendation at their next meeting in two weeks. 4. CONCEPT REVIEW: PROPOSED C.U.P. IN RR ZONING DISTRICT. Tom Soderberg, Hudson, WI, is requesting consideration for rezoning approximately 45 acres off of loth Street and Keats Ave. from RR to Ag in order to qualify for a C.U.P. for a horse stable. Mr. Soderberg explained he intends to build an 80' x 200' building which would contain 18 box stalls for horses and an indoor riding arena, also there will be an outdoor paddock/pasture area. Mr. Soderberg does not own this property, but is presently in the process of purchasing it. He further explained his business will be boarding horses, breeding horses, training horses, showing horses and giving lessons. Mr. Soderberg stated he currently owns and runs a stable in Hudson, Wisconsin and intends to retain that stable as well as building the new one. Mr. Soderberg stated 90% of the activity will be in the indoor riding arena, but that he specifically wished to purchase this property in order to have access to the riding trails in the Park Reserve. Mr. Soderberg has talked with Jack Perkovich, Washington County Parks Director, and stated Mr. Perkovich was in favor of his proposal. The Planning Commission asked how many horses maximum Mr. Soderberg planned to have on this property - the stable has 18 box stalls, but is it possible to have more outside in the paddock area? Mr. Soderberg replied yes it would be possible to have more than 18 horses. Mr. Soderberg stated when they first move in - he expects about 15 horses, but he does not know how many horses hell have in the future because it will depend on how business goes. The commission asked what are the hours operation going to be? Mr. Soderberg stated routine hours would be 8 a.m. to 9 p.m. The commission asked if the Dayton Development Equestrian/Pedestrian Easement was accessible to this property? Mr. Soderberg replied the easement runs right through the property. The commission was concerned about traffic generated by people bringing their horses in just for the day. Mr. Soderberg stated this type of arrangement does not occur at his present stable and does not expect it to at this new site. The commission asked if it would be feasible for the building to be sided with perhaps cedar rather than just a metal pole building in order to take into consideration the new houses proposed across the road, Mr. Soderberg stated the building runs vertical to the road, therefore the visual impact is minimized, and the front of the building will be attractively finished. The commission mentioned the Oakdale Gun Club and wanted the applicant to be aware of the neighboring noises. The consensus of the Planning Commission was in favor of the general proposal, and strongly suggested Mr. Soderberg get in touch with the next door neighbor, Ron Smith, to notify him of the proposal. Also, to come back with specific suggestions of his own for the C.U.P. conditions other than landscape, signs, lights, hours, number of horses, manure removal, etc. Lake Elmo Planning Commission Minutes November 25, 1991 Page 3 5. PROPOSED ORDINANCE FOR LOT LINE ADJUSTMENT City Administrator Kueffner stated City Planner Mike Black reviewed the ordinance and suggested adding one more item under information to be submitted - (c) A current 1/2 Section map or scaled drawing depicting all parcels involved in the lot consolidation. M/S/P Conlin/Delapp - to recommend approval of this Ordinance with item (c) added as suggested. (Motion carried 7-0). 6. OTHER A. HISTORIC PRESERVATION COMMISSION Commissioner Bucheck suggested the Planning Commission approach the new architects in town about joining the Historic Preservation Commission. It was discussed and decided that the City Council is in the process of forming this commission. B. ECONOMIC DEVELOPMENT COMMITTEE Commissioner Bucheck suggested the Planning Commission write "Thank You" letters to businesses for doing something good, i.e. Ray Salus driving range sign. The commissioners were asked to take a look at the sign at their leisure. C. SENIOR HOUSING PROJECT Chairman John stated he talked with Teri Gallus, of HRA, and she has been looking at a project for Lake Elmo which would provide cottage style residences for independent living for able seniors. Existing projects are in Scandia, Forest Lake, Hugo, Stillwater, and Cottage Grove. Two weeks ago they had a meeting with the Jaycees to investigate the need for this type of project. Some of the criteria is that it's close to bus lines, stores, clinics and hospitals. Size of the project will depend on the need, but the thought is cottage style bungalows or a three story development up to 18 units, they have twelve units in Marine. The highest density is 50 units as in Stillwater. They indicated they do not need sewer, the Scandia project has a drainfield. Commissioner McLeod stated we really need to consider something of this nature, because Lake Elmo's low income housing status now. Commissioner McLeod stated he checked with Mr. Ballet, Executive Director Washington County HRA, as to whether Cimarron qualifies for "low income housing", and the answer was absolutely not, due to the non -ownership of property - owning the home and renting the lot disqualifies it. The Planning Commission needs to consider if this is a desirable concept or not for future planning The meeting adjourned at 10:15 p.m. REQUEST FOR PLANNING COMMISSION REVIEW MEETING DATE: December 9, 1991 AGENDA TOPIC: Driveway Widths (Sub -committee Report). ITEM NO. 3. Attached is a draft proposed ordinance submitted by Steve DeLapp regarding driveway standards. It appears that this proposed ordinance needs a little more work, which you may want to do at the meeting. When you feel you have an ordinance that you would like to pass on to the council, I would like to get an opinion from the city attorney on what is being proposed. 1602 DRIVEWAYS... 1602.060. Plan Amendment to change future land use designation of Beaubien property to RED. ITEM NO. 4. As you know, the city council denied Mr. Beaubien's request for a simple lot subdivision, based in part on the recommendation of the commission. Mr. Beaubien has asked that the city consider designating his property as RED on the future land use map. This will, I am sure you know, require an amendment to our comprehensive plan. Prior to going thru the entire comp plan amendment, etc., Mr. Beaubien, who will be represented by his daughter, Joanie Chavez, would like an indication from the planning commission as to whether or not they would support such an amendment. Please note that there is not a lot of detail provided for you to review, this is just a concept review. v• 0 _y. = SR REQUEST FOR PLANNING COMMISSION REVIEW AGENDA TOPIC: Concept Review: Rezoning and one lot sub- division: Gene Peltier. MEETING DATE: ITEM NO. 5. Gene Peltier, who owns property on I-94, part of which abuts "The Forest", has asked the city to consider allowing him to subdivide and rezone a parcel of land (which is adjacent to "The Forest", so that he would be able to sell the house that is there. The parcel appears to consist of approximately 20 to 25 acres. The property is currently zoned Rural Residential (10 acre minimum), but Mr. Peltier requests that he be allowed to subdivide a smaller lot. The future land use for this property is RED, but Mr. Peltier has stated that he does not feel the time is right to develop the entire parcel at this time. But because of the increasing taxes on this house, which he rents out, he feels that he must sell the property or continue to lose money. What the commission should consider is whether or not it would consider this one lot subdivision and rezoning to either R1 (as is "The Forest") or RE. ary or I -LAKE ELMO City of Lake Elmo 3800 Laverne Avenue North Lake Elmo, Minnesota 55042 OCT 2 9 1991 DEVELOPMENT APPLICATION FORM COMPREHENSIVE PLAN AMENDMENT ZONING DISTRICT AMENDMENT TEXT AMENDMENT CONDITIONAL USE PERMIT VARIANCE * (See Below) APPEALS SITE & BLDG. As this packet is being prepared, the mayor has called an emergency meeting (for Friday, December 6 at 5:30 p.m.) to reconsider the MUSA issue. As you know, when the council failed to ratify the 1990 Comprehensive Plan, action was taken to stop the MUSA extension, which is now being reviewed by the Met. Council. Since the council did adopt the comp plan at its December 3 meeting, the MUSA issue can be reconsidered. (It wasn't done so at the last meeting because of the late hour), but it is an issue that should be resolved - one way or another. Assuming that there is a possibility that the MUSA - or comp. plan amendment that would allow for a MUSA in Lake Elmo will be resolved tonight, I have enclosed the latest draft of your MUSA ordinance. I will advise you at the table as to whether or not you should proceed with the preparation of this ordinance,
