Meeting Minutes
Monday, June 22,1998
Chairman Armstrong called the meeting to order at 7:00 PM in the Council Chambers of City Hall, 3800
Laverne Avenue North, Lake Elmo, Minnesota. Present: Commissioners Berg, Graczyk, Helwig,
Sessing. Absent: Brass, Carlson, Herber, Mandel, Monette. Also present: City Planner Chuck Dillerud
and Councilor Karen Johnston.
Chairman Armstrong introduced Chuck Dillerud, the new City Planner, and welcomed him to the
Planning Commission and the City.

(Motion Passed 5-0).
2. MINUTES
M/S/P Helwig/Sessing — to accept the minutes from June 8,1998 meeting.
(Motion Passed 5-0).
3. PUBLIC HEARING:
File No. 98-13 Applicants: Bradley Bealka, Diana Mundinger, Joseph & Charlott Moris.
9757 45th Street. Minor Subdivision and Variances.
Chairman Armstrong said because no survey was included with the application, and this is a
submittal requirement, it is tough to grant a variance. Although the applicant did provide a sketch
of the proposal, some measurements may not be correct. Suggested tabling this file until the
applicant can provide a legal survey.
There was discussion regarding the buildings on the property. The applicants said the barn was
built circa 1900 and the milkhouse had a failing foundation and would most likely be removed.
Commissioner Berg asked Mr. Bealka and Ms. Mundinger if they intended to preserve the barn
and if they had contacted a preservation society in that regard. Ms. Mundinger said the barn
appeared to be in good shape and indicated they would like to have it restored.
In general, the commissioners indicated they would be favorable to granting the variance, but
require the legal survey. As soon as the applicant can provide such legal survey, the file will be
put on a subsequent PZ agenda.
M/S/P Helwig/Berg — to table file No. 98-13 until such time as the applicant can provide a legal
survey.

4. FENCE ORDINANCE
Commissioner Sessing read the changes he wrote and proposed to Section 1360.02 Subd. 1 of the Lake
Elmo Municipal Code.
Commissioner Berg said he felt April 1 was too early in the season to require snow fencing be removed
and it was agreeable to extend that date to April 15.
Commissioner Graczyk said he felt it may be too restrictive to amend the fencing section of the code
because the City may not have received any complaints regarding snow fences and, why address it now.
He also expressed concern regarding definitions of "types" of fences, i.e. steel, picket and wood.
M/S/P Helwig/Sessing — to recommend amending the Municipal Code Section 1360.02 as follows:
Subd. 1 Fences alone Property Lines.
Fences may be placed along property lines provided no physical damage of any kind results
to abutting property. No snow fences shall be allowed within fifty (50) feet of the nronerty
line unless the adioinine property owner lives written permission. All snow fences will only
be allowed from November 1 to April 15 of each year.
(Motion Passed 4-1). Opposed: Chairman Armstrong; feels the 50 feet limit is too restrictive.
City Planner Dillerud said he will bring the Fence Ordinance back to the Planning Commission again,
after further review.
The Commissioners briefly discussed the OP Ordinance and it will come back to them.
Chairman Armstrong adjourned the meeting at 7:45 PM.
