Rezone (down zone) from RR to AG
Planner Dillerud explained that the applicant petitioned the City to rezone 165 acres of land from
RR to AG, the purpose being to build an accessory structure to store agricultural equipment. He
noted the site history and existing conditions, as found in the staff report. He said the site is clearly
an active farming operation. He said staff finds that the rezoning from RR to AG is consistent with
the Comprehensive Plan.
Gene Peltier
10376 Hudson Blvd.
Mr. Peltier said he has been a farmer in the community for over 52 years, and simply wanted to
build a pole building to store farm equipment, understanding it was necessary to rezone from RR to
AG, which permits him to do so.

p.m. - NO COMMENTS.
M/S/P Ptacek/Sedro - to recommend adoption of an ordinance to rezone 165 acres of land

Lake Elmo Planning Commission Meeting Minutes - Monday, August 28, 2000 page 1
Parkview Estates. He noted the concept plan for this development had been approved by the City
Council at its June 20, 2000 meeting. He said the applicant proposes division of 38+ acres of land
into 17 single family detached lots, which includes 16 new lots and one existing homesite. He said
staff finds the proposed plan responds affirmatively to the approved concept plan, findings required
for approval of a Conditional Use Permit, and development stage plan.
Tim Freeman (representing applicant)
Folz, Freeman & Dupay
Mr. Freeman explained that the proposed street widths are 18'; and, after meeting with the property
owners to the East, 16`h Street would be paved, in the event further development might occur.

A resident asked why a Wetland Treatment System was not proposed for this darlopment
Mr. Freeman said it was not cost effective to install a Wetland Treatment System in a smaller,
lengthy development.
Chairman Armstrong closed the comment portion of the Public Hearing at 7:32 p.m.
Commissioner Sessing noted that the existing accessory structures on the homestead would be
relocated to an outlot on the new plat, which has no principle structure.
M/S/P Armstrong/Sessing - to recommend approval of the Open Space Development
Stage Plan, Preliminary Plat, and Conditional Use Permit for Cardinal Ridge.
(Motion Passed 6-1). Opposed: Ptacek; the plan does not meet the spirit and intent of the
OP Ordinance, opposed to giving density bonus for the Village Green.
5. PUBLIC HEARING: Impact Zone - Section 300 Amendments
Planner Dillerud said that during some previous Public Facility discussions, Councilman DeLapp
suggested a solution might be to pen -nit a broad range of uses acceptable within Lake Elmo with no
distinction, if singular criteria were the common denominator. He noted that Councilor DeLapp said
all Public Facility uses would be acceptable in residential zones if the structure developed was
compatible with the impervious surface coverage.
Chairman Armstrong said the current Public Facility Ordinance has few standards, and the draft
amendments is an attempt to take the OP ordinance, and apply it to PF uses. He said the basic idea
is to allow PF uses in defined areas.
Chairman Armstrong opened the comment portion of the Public Hearing at 7:50 p.m.
Chuck Palmer
(Representing Lake Elmo Churches)

(Motion Passed 6-1). Opposed: Sedro.

Chairman Armstrong excused himself from the dais. He discussed the history of the Armstrong

to expand the commercial storage operations to cover 10 acres of the 264-acre site; and over time,
increase the structure area by 47,500 square feet.

on the South side of 50th Street. He noted that the applicant is the owner of both parcels and
