PUBLIC HEARING: Variances Joe Kiesling 9359 Jane Road N. Planner Dillerud explained that the applicant's are, for a second time, requesting variances to construct an addition to their home and to construct and additional deck connecting existing decks along the waterside of their home. He further noted all of the proposed construction is within the 100-foot setback to Lake Jane. He said no new documentation had been submitted by the applicant's support of their new application. He said any additional staff analysis or discussion relating to this issue remains essentially as found in the May 10, 2001 staff report. Planner Dillerud said he provided the Commission with resolutions approving and denying the variances. Chairman Armstrong opened the comment portion of the Public Hearing at 6:14 p.m., and noted that the Public Hearing was called for 7:00 p.m. and made the following motion: M/S/P Armstrong/Deziel - to table the Kiesling Public Hearing to after 7:00 p.m. (Motion Passed 8-0). 4. Site and Building Plan Review: Carriage Station Professional Park - Lot 4 Marquess Development Highway 5 and 55d' Street Planner Dillerud stated that the City Council approved a Planned Unit Development Plan Amendment and overall Site Plan for 4 office buildings on Lot 15, Block 1 of Carriage Station in June of 2001. He said that while the June site plan approval included the site layout/landscape/exterior lighting of the entire site, architectural elevations for only one of the four proposed structures had been submitted and approved at that time, therefore the plan before the Commissioners was for Lot 4 of the site. He presented illustration boards which depicted the exterior surface and roof materials, the exterior light fixtures -which he mentioned did not meet the lighting standards, and the general site plan. Lake Elmo Planning Commission Meeting Minutes Monday, September 10, 2001 page 1 John Arkell Marquess Development Mr. Arkell reviewed the site plan, adding nothing to what was presented by Planner Dillerud, but offered answers to questions the Commissioners might have. Chairman Armstrong said the proposed plan seemed to be in compliance with the standards for Limited Business, and that the exterior surfacing was equivalent to the previously approved structure. M/S/P Armstrong/Berg - to recommend approval of the Section 520 Site Plan for Lot 4, Block 1 Carriage Station Professional Park subject to the following conditions: 1. Compliance with all applicable conditions of City Council Resolution #2000-40, approving the Planned Unit Development Plan and Master Site Plan for Carriage Station Professional Park. 2. Deletion of the proposed "Craftsman Outdoor Lanterns" with exterior lighting fixtures in compliance with Section 1350 of the City Code. (Motion Passed 8-0). Commissioner Deziel asked if "equivalent" [exterior surfacing] material was only for certain areas of the City. 5. Site and Building Plan Review: Eagle Point Office Center I Lot 1, Block 2 Eagle Point Business Park Second Addition Planner Dillerud explained that the use and performance standards applicable to the site were established by the Eagle Point Business Park Planned Unit Development Plan approved by the City Council in 1999. He said the 3.5-acre site was approved in Preliminary Plat form in September of 2001, and the Final Plat creating the site, and the Eagle Point Boulevard street right-of-way would be considered by the City Council at its September 11, 2001 workshop/meeting. He said the applicant proposes to construct a 32,263 square foot professional office building on the site that complies with the PUD Plan. He recommended a reduction in the number of parking spaces, an increase in the number of parking islands, and compliance with the exterior lighting standards. George Burkards United Properties Steve Doughty Pope Associates Mr. Doughty stated the parking spaces at the south entrance to the site had been reduced from 136 vehicles to 132; the landscape plan is consistent with the approved Planned Unit Development Plan standards; EFIS, which is a stucco -like surface that will match the brick surfacing is proposed to provide additional color and definition to the exterior walls. Mr. Burkards said he fek the varied percentage of exterior surface materials is a good idea; regarding the parking spaces -the plan meets or exceeds the minimum requirements. Commissioner Berg said, although the EFIS might be more attractive, he would take the "purist" approach to the exterior surface and recommend glass, brick, and stone [per Code]. Lake Elmo Planning Commission Meeting Minutes Monday, September 10, 2001 page 2 M/S/P Sessing/Herber -to recommend approval of the Site Plan/Final Planned Unit Development for Lot 1, Block 2 Eagle Point Business Park 2"d Addition, subject to the following conditions: 1. Reduction of the off-street parking constructed to not more than 132 spaces required by Code and the PUD Plan. Elimination of excess parking spaces shall be concentrated in areas adjacent to the site entrance to overcome potential conflicts with traffic flow onto the site from Eagle Point Boulevard. 2. Increase in the number and/or area of parking landscape islands to comply with Code standards, based on the actual parking count that results. 3. Compliance with Section 1350 standards regarding exterior lighting. 4. Approval and recording of the Final Plat of Eagle Point Business Park 2"d Addition. 5. Compliance with the recommendations of the City Engineer. (Motion Passed 7-1). Opposed: Berg 3. PUBLIC HEARING: Variances Joe Kiesling 9359 Jane Road M/S/P Armstrong/Berg - to take the Kiesling Variance issue off the table. (Motion Passed 8-0). Planner Dillerud re -introduced the variance request. Chairman Armstrong invited comments from the public at 7:05 p.m. Mr. Kiesling said he would be building nothing closer to the lake than already exists; he is not doing anything differently than what many of his neighbors did; and, he will compromise the submitted plan. He explained that back in the 1970's, impervious surface coverage was not an issue, and Lake Jane's shoreline was lower. Commissioner Berg stated that the two regulating agencies set their own rules -some identical, some different- and some confusion may have resulted. Mr. Kiesling said the Department of Natural Resources had control over the water in the 1950's, and he did not plan to build anything closer to the water than what is already there. He said again, he would compromise on the scale of the deck. He stated all he wanted was to walk out the kitchen onto the deck and enjoy the view of the lake, and that the original structure had a deck off the kitchen. Joe Hatmnerly Resident Mr. Hammerly expmssed his support for the Kiesling variances by saying that he had foamed the process sincethis spring He said Mr. Kiesling eeas not changing the footprint of the primary stun rre; this case has become entangled and is not fairas a neighturandfellawresidemt of Lake Elmo. He said serzral neighbors on the other side of the lake had completed extensive remodeling Chairman Armstrong closed the comment portion of the Public Hearing at 7:25 p.m. Lake Elmo Planning Commission Meeting Minutes Monday, September 10, 2001 page 3 Commissioner Taylor asked Mr. Kiesling if he had signed an earlier agreement. Mr. Kiesling said he was aware of an agreement, but he never signed it, stating "a person cannot sign away future rights". He mentioned that he had installed plantings, trees and shrubs along a property line, and in the 1970's the Tri-Lakes Association started to pump water into Lake Jane. Commissioner Mandel referred to the September 10, 2001 letter from Molly Shodeen (DNR). Planner Dillerud suggested the Commissioners might want to postpone this issue to the September 24, 2001 meeting, allowing Mr. Kiesling a chance to provide a visual interpretation of his "compromise" to the Commissioners. Chairman Armstrong said whichever decision the Planning Commission made; this would probably go to the City Council level for a decision. Commissioner Deziel said he felt Mr. Kiesling had been treated unfairly, due to a mistake made by the Commission, and that Mr. Kiesling had lost an entire building season already. He suggested the Commission "couldn't fix it tonight" Planner Dillerud said the City Council had the findings of fact when they addressed the original appeal. Mr. Kiesling said applying for another set of variances was quicker than taking this issue to court. M/S/P Deziel/Mandel — to table the Kiesling Variances to the September 24, 2001 Planning Commission meeting. (Motion Passed 4-3-1). Opposed: Taylor, Berg, and Armstrong. Abstain: Ptacek.
