Ac ion eques e <br />Consent <br />Public Hearing <br />Discussion <br />Action <br />Resolution <br />Work Session _X <br />LAUDERDALE COUNCIL <br />ACTION FORM <br />Meeting Date January 28, 2014 <br />ITEM NUMBER Permit Fees <br />STAFF INITIAL <br />APPROVED BY ADMINISTRATOR <br />Following is a letter from Barbara eRosier. any of you know that she suffered brain <br />damage after falling off her roof a number of years ago, shortly after she purchased her <br />home. <br />Over the past few years, staff have been in contact with Barbara with regard to her garage. <br />It was in a state of disrepair, especially after a tree hit the comer of it. We had been trying <br />to help her find resources to take care of it. Kevin worked with her through the past summer <br />to get Peace Lutheran Church involved. Based on our last interactions, we thought the gar- <br />age was going to be town down by Church members. <br />4-11 <br />This fall, Dave noticed that improvements were being made to the garage.. We sent Barbara <br />a letter explaining that a permit needed to be pulled. To make a long story short, we had a <br />number of interactions with the Roseville resident that did the work. We explained to him <br />that virtually all of the work he performed was governed by the building code and that was <br />why a permit was required. He has been unhappy about this. However, we finally got him <br />to let Dave inspect the work he did. The work he did didn't bring the garage up to code but <br />did shore up the structure. Dave has the discretion as the building official to allow this for <br />such old structures that were built long before the building code existed. <br />Based on conversations with Barbara, we thought she was going to stop by City all to fin- <br />ish the permit process until we received this letter this week. As it is addressed to the Coun- <br />CiL I am bringing it to your attention. <br />She is asking for the Council to waive the permit requirement and the fee. It isn't within the <br />Council's discretion to waive the state building code requirements. I will explain that to her <br />again. As the Council sets the fee schedule, you could waive the fee. I strongly encourage <br />the Council not to do that. Many, many people who pull permits are on a fixed income. <br />Waiving the fee could open the door to many more requests. As the permit fees are used to <br />pay a significant portion of Dave's salary, waiving fees would require us to find the money <br />elsewhere (i.e. raise permit fees or levy more tax dollars). <br />I will reply back to Barbara after getting the Council's perspective. <br />
