Councilors absent: None. Staff present: Heather Butkowski, City Administrator; Jim Bownik, Assistant to the City Administrator; and Miles Cline, Deputy City Clerk. Approvals Mayor Gaasch asked if there were any additions to the meeting agenda. There being none, Councilor Dains moved and seconded by Councilor Grove to approve the agenda. Motion carried unanimously on a roll call vote. Mayor Gaasch asked if there were any corrections to the minutes of the January 12, 2021 city council meeting. There being none, Councilor Pulford moved and seconded by Councilor Moffatt to approve the minutes of the January 12, 2021 city council meeting. Motion carried unanimously on a roll call vote. Mayor Gaasch asked if there were any questions on the claims. There being none, Councilor Moffatt moved and seconded by Councilor Dains to approve the claims totaling $162,037.30. Motion carried unanimously on a roll call vote. Consent Councilor Moffatt moved and seconded by Councilor Grove to approve Resolution No. 012621A — Approving a 3.4% Variance to the Lot Coverage Requirement at 1763 Malvern Street and the 2020-2021 union contract and acknowledging the December financial reports and Fourth Quarter Investment Report. Informational Presentations/Reports A. City Council Updates Mayor Gaasch stated that the City received the Capitol Region Watershed District Partner of the Year award for the Seminary Pond project. Councilor Dains mentioned that Administrator Butkowski sent out a Metro Transit survey that he asked community members to complete. Dains mentioned the meeting Ramsey County is hosting on February 3 regarding economic prosperity and development in the county. Councilor Pulford added that he appreciated the Deterra article in the newsletter. Finally, Mayor Gaasch stated she attended a meeting with other Ramsey County mayors and Betty McCullum to discuss the COVID-19 vaccine rollout plan. Discussion with City Attorney about Financial, Legal, and Land Use Agreements Required to Close Land Sale of 1795 Eustis Street City attorney Ron Batty attended the meeting. He addressed the Council's questions about the process of pulling together the various financial, legal, and land use agreements for the sale of 1795 Eustis Street to Real Estate Equities (REE). In the January funding cycle, REE was not awarded the tax credits needed to build the project. Based on a last-minute federal tax credit change, a few projects jumped into the 50% AMI track ahead of the City in the lottery pool. We are the priority project at the 100% LIHTC (Low Income Housing Tax Credit) pool. The next allocation process is in July. B. National League of Cities Warranty Line Program The City Council discussed whether to participate in the National League of Cities (NLC) Service Line Warranty Program administered by Utility Service Partners Inc. Their representative spoke to the Council last spring about how the program operates. The NLC program fills an insurance gap. In summary, sewer lines from the main line to people's homes are the homeowner's responsibility to maintain and replace. Water lines also are the responsibility of homeowners to the right-of-way line. This is not always known by property owners until something stops working. Repairs are typically expensive and not covered by insurance. Staff reached out to the three Ramsey County cities that partnered with the NLC program to see how it was working for them. The responses were not favorable for two primary reasons. The materials advertising the program brought to the forefront issues of service line ownership that cities were caught off -guard by. The partnership created a de facto endorsement for the NLC program that doesn't feel right to some cities. There are other players in the market that provide different levels of sewer / water line coverage and more are coming forward. For example, staff requested information from Xcel Energy as they provide sewer blockage insurance. American Family is in the final stage of getting state approval for their insurance program. However, the NLC program would not be available to residents without Council approval. After discussion, the Council asked staff to prepare information on the topic to include in the next newsletter. Set Agenda for Next Meeting The February 9 council meeting may include the Gasparre Pond dredging quote and a St. Paul Regional Water Treatment Plant update. Community Development Update The Council discussed Ramsey County HRA's support of a St. Paul housing project that took tax credits from the pool needed to close the REE deal. St. Paul and Minneapolis are allocated tax credits so there is an equity issue when they receive credits and get county HRAs to ask for more on their behalf. Staff will do additional research, discuss with county staff, and report back on talking points for council members who wish to discuss the issue with the county commissioner. B. Opportunity for the Public to Address the City Council Mayor Gaasch opened up the floor to anyone in attendance interested in addressing the Council. There being no people interested in speaking, Mayor Gaasch closed the floor. Councilor Moffatt made a motion to enter into a closed session at 8:17 p.m. This was seconded by Councilor Pulford and carried unanimously on a roll call vote. Closed Session A. City Administrator Performance Review The Council discussed the City Administrator's performance review. Councilor Pulford made a motion to return from closed session at 9:13 p.m. This was seconded by Councilor Dains and carried unanimously on a roll call vote. Those who knew him knew that Bob loved Lauderdale. Staff prepared a memorial resolution that tried to capture this. Feel free to send me edits. I will share with his widow Crystal and offer her an opportunity to speak at the meeting if she would like. She has attended a number of our virtual meetings. RESOLUTION NO. 020921A CITY OF LAUDERDALE COUNTY OF RAMSEY STATE OF MINNESOTA MEMORIAL RESOLUTION HONORING FORMER LAUDERDALE MAYOR ROBERT C. WISEN WHEREAS, the City of Lauderdale mourns the death of former Lauderdale Mayor Robert C. Wisen, known to the community as Bob; and WHEREAS, Bob was born in Lauderdale in 1926, educated at the Lauderdale School, and died in Lauderdale on January 19, 2021; and WHEREAS, Bob's spirit of service was displayed in many ways including his deployment to Europe during World War II and in his capacity as mayor from 1970 to 1978; and WHEREAS, after his time in office, Bob offered counsel to subsequent mayors and council members as they grappled with pressing City issues; and WHEREAS, Bob's affection for his community extended to Peace Lutheran Church where he was a life-long member; and WHEREAS, Bob regularly attended and volunteered at community events. The number of candy bags Bob packed and hot dogs Bob wrapped for hungry Halloween Party goers is countless and his spirit of service for neighbors and friends knew no limits. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Lauderdale, Minnesota recognizes the contributions of Robert C. Wisen to the City and community organizations over the course of his life and offers sincere condolences to his wife Crystal and his family. Adopted this 9th day of February 2021. With the lack of rain this fall, the pond is almost completely dry. The low water level allowed staff to get an idea for how much sediment was in the pond. The estimate was three to four feet. Without water, the pond is much easier to dredge and staff spoke to the contractor working on Seminary Pond. They provided an estimate based on the removal of three to four feet of sediment if the soil was not contaminated. The Council authorized the soil testing process in December. The sediment was tested and was found to be clean enough to not need to be hauled to a special dump sites. The contrac- tor will decide where to haul the material. Staff worked with the city engineer to get approvals from Capitol Regions Watershed Dis- trict for the project. The diagrams submitted with the permit are attached. Capitol Region and Barr Engineering staff compared the pricing to Seminary Pond and other projects. The cost is $2 per cubic yard more than Seminary Pond which is a bigger project with a greater economy of scale. The Seminary Pond pricing was far below engineer's esti- mates so the pricing for this project was considered very good. Staff could get an additional quote but then specifications would need to be written and a different outcome is not likely. STAFF RECOMMENDATION: Motion to approve the Contract between the City of Lauderdale and Nadeau Companies, LLC, for the dredging of Seminary Pond. Contract between the City of Lauderdale and Nadeau Companies, LLC This contract (the "Agreement") is made and entered into this 911' day of February, 2021, between the City of Lauderdale, Minnesota (the "City"), and Nadeau Companies, LLC., (the "Contractor"), (collectively, the "Parties"). 1. Scope of Services. The Contractor agrees to remove between three and four feet of sediment from Gasparre Pond in Lauderdale, Minnesota. It is estimated to be 1,500 cubic yards of material. The Contractor will meet stormwater requirements identified on the attached diagrams and complete necessary restoration work. 2. Compensation. The City agrees to pay the Contractor an amount not to exceed the quoted price of $36,545.00. Any changes in price must be approved by the City before the costs are incurred. The City shall not withhold monies for the payment of any federal or state income taxes, social security benefits, or other taxes. 3. Term. This agreement is applicable for work completed in winter/spring of 2021. 4. Independent Contractor Relationship. It is expressly understood that the Contractor is an "independent contractor" and not an employee of the City. The Contractor shall have control over the manner in which the services are performed under this Agreement. The Contractor shall supply, at its own expense, all materials, supplies, equipment and tools required to accomplish the work contemplated by this Agreement. The Contractor shall not be entitled to any benefits from the City, including, without limitation, insurance benefits, sick and vacation leave, workers' compensation benefits, unemployment compensation, disability, severance pay, or retirement benefits. 5. Insurance Requirements. A. Liability. The Contractor agrees to maintain commercial general liability insurance in a minimum amount of $1,000,000 per occurrence. The policy shall cover liability arising from premises, operations, products -completed operations, personal injury, advertising injury, and contractually assumed liability. The City shall be named as an additional insured. B. Automobile Liability. If the Contractor operates a motor vehicle in performing the services under this Agreement, the Contractor shall maintain automobile liability insurance, including owned, hired, and non -owned automobiles, with a minimum liability limit of $1,000,000 combined single limit. The City shall be named as an additional insured. C. Workers' Compensation. The Contractor agrees to comply with all applicable workers' compensation laws in Minnesota. D. Certificate of Insurance. The Contractor shall, prior to commencing services, deliver to the City a Certificate of Insurance as evidence that the above coverages are in full force and effect. 6. Indemnification. The Contractor agrees to defend and indemnify the City, and its employees, officials, volunteers and agents from and against all claims, actions, damages, losses and expenses arising out of the Contractor's performance or failure to perform its duties under this Agreement. 7. General Provisions. A. Entire Agreement. This Agreement supersedes any prior or contemporaneous representations or agreements, whether written or oral, between the Parties and contains the entire agreement. B. Assignment. The Contractor may not assign this Agreement to any other person unless written consent is obtained from the City. C. Amendments. Any modification or amendment to this Agreement shall require a written agreement signed by both Parties. D. Governing Law. This Agreement shall be governed by and interpreted in accordance with the laws of the State of Minnesota. E. Savings Clause. If any court finds any portion of this Agreement to be contrary to law or invalid, the remainder of the Agreement will remain in full force and effect. F. Waivers. The waiver by either party of any breach or failure to comply with any provision of this Agreement by the other party shall not be construed as, or constitute a continuing waiver of such provision or a waiver of any other breach of or failure to comply with any other provision of this Agreement. G. No Waiver by City. By entering into this agreement, the City does not waive its entitlement to any immunity under statute or common law. H. Termination. Either party may terminate this agreement at any time for any reason. If the contract is terminated early, the City will pay a pro rated fee for services performed to date.
