Councilors absent: None. Staff present: Heather Butkowski, City Administrator; Jim Bownik, Assistant to the City Administrator and Miles Cline, Deputy City Clerk. Approvals Mayor Gaasch asked if there were any additions to the meeting agenda. There being none, Councilor Kelly moved and seconded by Councilor Pulford to approve the agenda. Motion carried unanimously. Mayor Gaasch asked if there were corrections to the minutes of the August 8, 2023 city council meeting. There being none, Councilor Pulford moved and seconded by Councilor Kelly to approve the minutes of the August 8, 2023 city council meeting. Motion carried unanimously. Mayor Gaasch asked if there were any questions on the claims. There being none, Councilor Dains moved and seconded by Councilor Sayre to approve the claims totaling $100,265.88. Motion carried unanimously. Consent Councilor Sayre moved and seconded by Councilor Pulford to approve the Consent Agenda thereby acknowledging the July financial report. Informational Presentations/Reports A. City Council Updates Councilor Dains stated that Roseville and Falcon Heights' environmentally focused staff will attend the September 12 city council meeting to present on their work and opportunities for cooperation. Councilor Pulford shared that he attended some League of Minnesota Cities focused on cable franchise fees and affordable housing. Discussion/Action Item A. 2024 Budget and Levy B utkowski explained that the general fund budget is typically discussed in August and the other funds in October. This year the budget is a little more complex due to the spending down of the ARPA funds, the new public safety funds, and the budget increase drive by public safety costs. The packet also included a memo from St. Anthony's city manager regarding the policing cost increases and first run levy increase numbers for other Ramsey County communities. She explained that nothing can be finalized until the City receives the fiscal disparities revenue number and the taxable market values. Those numbers were anticipated on August 24. Set Agenda for Next Meeting B utkowski stated that the September 12 council meeting might include an electronic funds transfer policy and a variance request for 1743 Malvern Street. Work Session A. Community Development Update B utkowski stated that Real Estate F quities (REE) expects to complete construction of the Fern by mid-Septembei with tenants moving in by the end of September. REE plans to seal coat Malvern Stieet and Spring Street to repair rough spots created during the construction process. She continued to say that R1i F'; would hold an open house upon completion of the building. B Opportunity for the Public to Address the City Council Mayor Gaasch opened the floor to those in attendance interested in addressing the Council. John Mueller, 1931 Carl Street, approached the Council in regards to a proposed lot division that would require a variance for the allotted square footage. He has been in touch with staff. There being nobody else interested in speaking, Mayor Gaasch closed the floor. The County's procurement office didn't hke how the original contract was dated and sent this version over for approval instead. Nothing substantive changes regarding the contract. STAFF RECOMMENDATION: By approving the Consent Agenda, the Council approves the Agreement Between Ramsey County and the City of Lauderdale for hlection Services. Agreement Between Ramsey County And The City of Lauderdale for Election Services This is an agreement between the County of Ramsey, through the Ramsey County Elections Office, 90 West Plato Boulevard, St. Paul, MN ("County' ), and The City of Lauderdale, 1891 Walnut Street, Lauderdale, MN ("City"), for the provision of election services by the County ("Agreement"). 1. Term This Agreement will be in effect for the period from January 1, 1, 2024, through December 31, 2026 (' Initial Term"), unless earlier terminated pursuant to the provisions of this Agreement. 2. Renewal and Termination This Agreement may be renewed for one additional two-year period by written agreement of the parties, in the form of an amendment to this Agreement. An amendment for renewal of this Agreement must be executed by all parties no later than June 1, 2026. This Agreement may be terminated by any party by written notice to the other parties no later than June 1 of any year, effective on January 1 of the following year. Upon termination of this Agreement, the City -owned voting equipment and materials previously owned by the City related to elections will be returned to the City. 3. General Agreements a) This Agreement only applies to precincts located solely within Ramsey County. b) This Agreement only applies to regularly scheduled elections. c) The County will conduct all special elections required by law during the term of this Agreement on behalf of City. The costs of all special elections that are not held concurrently with a regularly scheduled State, County or City election will be billed to the city for the actual cost realized to conduct a special election. The city will also pay all costs applicable to any state special elections that are not conducted on the date of a regularly scheduled City or state election. d) If a city primary is required, the City will pay all costs applicable to the primary. The County shall invoice the City separately for the costs of the primary e) The costs for Recounts for City elections will be billed separately from this Agreement for the actual costs realized. f) The costs for Ranked Voting Reallocation for the City will be billed separately from this Agreement for the actual costs realized. 1 4. County Responsibilities Except as otherwise provided in this Agreement, the County will provide all services, equipment, and supplies as required to perform on behalf of the city and all election -related duties of the City specified in this Agreement. These duties will include: a) Promote and advance the strategic priorities and values of Ramsey County: People, Integrity, Community, Equity and Leadership. b) Recruit, train, and supervise staff to carry out the duties specified in this Agreement. c) Conduct annual inspection of the polling places established by the City according to Minnesota Statutes section 204B.16 in order to verify compliance with all state and federal accessibility requirements; make suggestions about polling locations to City based on feedback from voters, election judges, the polling location's administration, and annual surveys. d) Pay all rental costs for the Election Day, absentee, and early voting polling places. e) Recruit, train, assign, and pay election judges. Compensation to election judges will be in an amount as determined by the Ramsey County Board of Commissioners. f) Select and administer an election judge management system. g) Procure and provide interpreter services to be available at absentee, early voting, and Election Day locations in accordance with Section 203 of the federal Voting Rights Act. h) Carry out the duties of the city clerk described in Minnesota Election Law regarding the administration of the voting system and the requirements set -forth in the Joint Powers Agreement between the County and the municipalities in Ramsey County to administer the County's voting systems. i) Program, layout, approve, and print the ballots for all City elections. j) Prepare and transport all election materials to and from each Election Day, absentee and early voting polling place. Provide election signs, forms, supplies, voting equipment, and other related materials for each Election Day polling place. k) Provide on -street parking and metered parking for early voting, absentee, and Election Day polling places. I) Compile, audit, and report election results and election statistics for dissemination to the appropriate canvassing boards, the public, and the media. Provide copy of election abstract to be used by City for their canvass. m) Provide election -related information on the County web site relating to City elections. 2 n ) Conduct recounts for City offices and ballot questions. o ) Prepare, post, and publish notices of filing and election as required by Minnesota Statutes sections 205.13 and 205.16. Publish, post, and provide the sample ballots as required by Minnesota Statutes section 205.16. p) Administer all aspects of absentee voting carried out by the Municipal Clerk in Minnesota Chapter 203B, including all in-person absentee voting activities at absentee voting locations determined by the Ramsey County Auditor. q) Administer campaign finance reporting and economic disclosure activities designated to the City clerk in accordance with Minnesota Election Law. r) Perform all duties of the candidate filing officer, including the acceptance of affidavits of candidacy and petitions. s) Maintain a database and prepare maps of election districts and precinct boundaries. Provide maps in digital and print formats, available to the public. t) Retain all election records in accordance with Minnesota Election Law and data retention requirements. u ) Conduct civic engagement events regarding voter registration, absentee voting, election judge recruitment, and election related civics. ✓ ) Recruit student elections judges and teacher liaisons as part of Ramsey County's Student Election Judge Program. 5. City Responsibilities The City will perform the following election -related responsibilities: a) Provide the County with an inventory list of voting equipment and election related materials, owned by City, to be returned by the County upon termination of Agreement. b) Conduct the canvass of election results following every City election. c) Issue Certificates of Election in accordance with Minnesota Statutes sections 205.185 & 211A.05. d) Attend annual pre-election meetings held by the County and complete trainings required for state election officials as determined by the Minnesota Secretary of State. e ) Send required mailed notice of levy referendum in accordance with Minnesota Statutes section 126C.17 subd. 9(b). 3 f) Provide recruitment information about serving as an election judge within City and on the City's website. g) Provide the title and text of City questions to be placed on the ballot in accordance with Minnesota Statutes section 205.16 subd.4 or section 205A.05, subd.3 h) As needed, identify new locations the City would prefer to use as precinct polling places on Election Day. Annually approve polling places in accordance with Minnesota Statutes section 204B.16. Provide resolution of approved polling locations to the County by the December 31 deadline set forth in section 204B.16. i) Draft, schedule, and approve all resolutions required of the City in Minnesota Election Law to administer elections. j) Designate a person who will be the principal contact for the County. 6. Office Space and Equipment Storage The County will provide suitable office and warehouse space to conduct all election -related activities and for storage of election equipment and supplies. 7. Costs and Payment Payments to cover the costs incurred by the County in the performance of the provisions of this Agreement for regularly scheduled elections will be made by the City in eight equal quarterly amounts for a two-year budget period, for a total of 12 quarterly payments during the Initial Term of the Agreement. Payments will be due on March 31, June 30, September 30 and December 31 of each year. The cost of election services for Regular Elections for the 2024 calendar year will be $21,240.00. The County will provide an initial cost estimate for the 2025-2026 calendar years to the City no later than April 1, 2024. Such initial cost estimates will become final if the County does not provide an updated cost estimate by July 1 of the year the cost estimates are provided. Costs will be adjusted as necessary by the County to account for the following factors: 1) estimated voter turnout; 2) labor contracts and agreements for non -represented employees approved by the Ramsey County Board of Commissioners 3) changes in the Consumer Price Index for the Minneapolis -Saint Paul metropolitan area, as determined by the U.S. Bureau of Labor Statistics for the previous two-year period; 4) changes in state, federal, County, or City legal requirements, as applicable; and 5) other factors having a significant impact on election costs. The County will notify the City of additional costs that it will incur as a result of changes to applicable election laws. The County will include and separately identify in any invoice for a regular election or a special election the cost that was incurred as a result of the enactment of new election laws. 4 8. Voting Systems The cost of the operation and maintenance of the voting system is not included in this Agreement and is the subject of a separate agreement. 9. Insurance Each party shall maintain such insurance as will protect such party from claims which may arise out of, or result from, the party's actions under this Agreement. During the term of this Agreement, the County and City will maintain, through commercially available insurance or on a self-insurance basis, property insurance coverage on the voting equipment each owns, for the repair or replacement of the voting equipment if damaged or stolen. Each party shall be responsible for any deductible under its respective policy. Each party hereby waives and releases the other parties, their employees, agents, officials, and officers from all claims, liability, and causes of action for loss, damage to or destruction of the waiving party's property resulting from fire or other perils covered in the standard property insurance coverage maintained by the parties. Furthermore, each party agrees that it will look to its own property insurance for reimbursement for any loss and shall have no rights of subrogation against the other parties. 10. Indemnification Each party to this Agreement will be responsible for its own acts and omissions, and the acts and o missions of its officials employees, and agents and the results thereof, to the extent authorized by law and shall not be responsible for the acts of the other party, its officials, employees, and agents, and the results thereof. Data Practices All data created, collected, received, maintained, or disseminated for any purpose in the course of this Agreement is governed by the Minnesota Government Data Practices Act, any other applicable statute, or any rules adopted to implement the Act or statute, as well as federal statutes and regulations on data privacy. 12. Alteration Any alteration, variation, modification, or waiver of the provisions of this Agreement shall be valid o nly after it has been reduced to writing and duly signed by all parties. Any amendment must be approved no later than June 1 of any year for implementation on January 1 of the following year. 13. Dispute Resolution The Agreement shall be interpreted and construed according to the laws of the State of Minnesota. All litigation regarding this Agreement shall be venued in the appropriate State or Federal District Court in Ramsey County, Minnesota. 5 14. Severability The provisions of this Agreement are severable. If any part of this Agreement is rendered void, invalid or unenforceable, such rendering shall not affect the validity and enforceability of the remainder of this Agreement. 15. Legal Representation The Ramsey County Attorney's office will advise and represent the County in all election -related matters. 16. Independent Contractor It is agreed that nothing in this contract is intended or should be construed as creating the relationship of agents partners, joint ventures, or associates between the parties hereto or as constituting the County as the employee of the City for any purpose or in any manner whatsoever. The County is an independent contractor and neither it, its employees, agents, nor its representatives are employees of the City. 17. O ur proposal uses the property in a reasonable manner because it conforms with the approved land use for the site. It uses the site as intentioned by the zoning code. What are the unique circumstances to the property not created by the landowner? The unique circumstances of this property are what necessitated this variance application. As part of the permit application process to build a new home, we hired a registered land surveyor who generated a site plan that was submitted to the city for review and approval. The site plan and subsequent building plan was approved and a building permit was issued allowing work to begin. Once the house was built, it became apparent to city staff that there was a mistake on the site plan as it incorrectly showed the location of the house immediately to the north of 1743 Malvern Street. The city approved the site plan based on this information and the house at 1743 Malvern Street was placed on the lot by the surveyor and subsequently constructed. This situation was not created by the landowner in that the landowner hired a Registered Land Surveyor in the state of Minnesota and submitted the site plan created by the surveyor. The landowner had no reason to assume or believe that the site plan was incorrect as it was never questioned or made mention of by the city. This was a mistake made unintentionally by the land surveyor. H ow will the variance, if granted, not alter the essential character of the locality? The variance if granted will not alter the essential character of the locality because the granting of the variance would be consistent with the demonstrated character of the locality. The granting of the variance would allow the continued construction of a new house without creating a hardship to the landowner that could limit future ability and willingness to build new homes. Allowing the variance would acknowledge that humans make mistakes while acknowledging that new homes of the type and scale being built at 1743 Malvern Street are good for the community and its people. Having built several new homes in Lauderdale over the past few years, the granting of this variance would demonstrate what kind of place we have experienced Lauderdale to be: a great community that is competently and fairly managed for the good of its residents and stakeholders. How is granting of a variance in harmony with the purposes and intent of zoning ordinances? The city had previously concluded in the initial zoning review that issuing a permit was in harmony with the purposes of the zoning ordinances Our request does nothing to change the use or intent of the project, it just allows it to continue without disruption or modification. How are the terms of a variance consistent with the Comprehensive Plan? Granting this variance is consistent with the comprehensive plan in that it acknowledges the tension that can be created while developing new housing while positively creating to the housing stock of the community. By limiting encumbrances on the property owner the variance supports the desire for housing affordability by allowing and encouraging net increase in supply of new housing. The general fund budget increase is 9.96% In real numbers, the gen- eral fund expenses are up $163,706. The biggest cost driver is the $123,455 Increase in po- licing. The portion of the increase being paid by Lauderdale property owners is $78,741 or a local levy increase of 8.9%. The total levy increase is 7.9%. These number maintain the tax rate of 28.128% year -over -year In theory, with the flat tax tate, property owners' taxes would be flat but of course that isn't the way things work Lauderdale property values are increasing faster than the rest of the county. Rising property values are better than declining values but they come with real dollar consequences m terms of property tax shifts that staff can speak to during the council meeting. A spreadsheet summarizing the proposed levy im- pact on homes follows. Fi;ven with the 7.9% levy increase, the budget requires a number of funding sources to make up the difference between the proposed levy and the actual 20% increase in costs. The budget factors in the increases in LGA and fiscal disparities; using $67,169 of the $98,329 in public safety aid* $30,000 transfer from the enterprise funds (602 and 603) and a host of cuts to small items throughout the budget including eliminating the contingency fund. Staff can discuss the whole budget in greater detail at the meeting. Included in the packet is a revised county -wide levy spreadsheet as well as the county infor- mation presented at our recent meeting. Determine contribution value — Calculate the growth in prior year commercial -industrial values over the base year values for each city and township in the area. The growth is adjusted for abatements, tax court petitions and other similar adjustments to commercial -industrial value that have occurred since creation of the prior year's report. The end result determines what portion of that city/township's tax base will be contributed to the fiscal disparity pool and to determine the total fiscal disparity pooled value. 2. Determine distribution value — Allocate the pooled value to each city/township based on the relative strength of that jurisdiction's tax base by comparing average market values per capita. Allocate the distribution values to overlapping taxing authorities based on proportionate shares of residential values. 3. Determine distribution taxes — Multiply the distribution value for each taxing authority by the prior year's tax rate for that authority to determine a fiscal disparity distribution levy. The distribution levy will reduce the levy used to calculate local tax rates (also market based rates in the case of schools) because funds will be available from the fiscal disparity pool. The distribution formula is meant to recognize the need of a taxing authority based on its previous levying pattern. The accumulation of distribution levies for every taxing authority in the region provides the total fiscal disparity levy against the fiscal disparity pool. 4. Determine contribution taxes — Determine an area -wide rate by dividing the total fiscal disparity levy by the total pooled value. Determine what portion of each city's commercial -industrial tax base should be charged the fiscal disparity rate by dividing that city/township's final contribution value by the current year's commercial -industrial value. Multiply this percentage times the net tax capacity of the commercial -industrial portion of a parcel to determine that parcel's value subject to the fiscal disparity area -wide rate.
