Councilors absent Jeff Dains. Staff present: Heather Butkowski, City Administrator; Jim Bownik, Assistant to the City Administrator and Miles Cline, Deputy City Clerk. Approvals Mayor Gaasch asked if there were any additions to the meeting agenda. There being none, Councilor Kelly moved and seconded by Councilor Pulford to approve the agenda. Motion carried unanimously. Mayor Gaasch asked if there were corrections to the minutes of the July 9, 2024 City Council meeting. There being none, Councilor Sayie moved and seconded by Councilor Pulford to approve the July 9, 2024 City Council meeting minutes. Motion carried unanimously. Mayor Gaasch asked if there were corrections to the minutes of the July 15, 2024 Work Session. Consent Councilor Pulford moved and seconded by Councilor Kelly to approve the Consent Agenda thereby approving the Fourth Amendment to the Joint Cooperation Agreement with Ramsey County for Pooling of the Community Development Block Grant Funds and Resolution No. 072324A Appointing a Responsible Authority and Assigning Duties (Data Practices) and acknowledging the June financial report and the second quarter investment report. Discussion/Action Item A. Resolution No. 072324B Approving of Letter of Concurrence for Watershed District B oundary Change/Adjustment Rice Creek Watershed District (RCWD) is one of three watershed organizations within Lauderdale's city limits. RCWD did hydrological modeling to determine where, within their district, water actually flows. B ased on RCWD information, they want to move parcels in and out of their district to better align with LAUDhRDALF CITY COUNCIL MF'F,TING MINUTH,S L auderdale City Hall 1891 Walnut Street Lauderdale, MN 55113 P age 2 of 3 July 23, 2024 hydrological reality. The packet included maps and address lists showing which Lauderdale properties will move into the Mississippi Watershed Management Organization (MWMO) or Capitol Region Watershed Distiict (CRWD). No Lauderdale properties will move into RCWD territory. Overall, Butkowski said that this is a positive step. We have a good working relationship with RCWD, but regularly work more closely with CRWD, and have standing membership on the MWMO boaid. In an ideal world, Lauderdale would be in one watershed district. As that is not a possible outcome, these changes are for the better. Councilor Kelly made a motion to adopt Resolution No. 072324BApproval of Letter of Concurrence for Watershed District Boundary Change/Adjustment. This was seconded by Councilor Sayre and carried unanimously. B . Contract to Repair Walnut Street Storm Sewei Pipe Butkowski explained that the City has an easement for its storm sewer pipe that runs through 1769 Walnut Street. The adjacent property owner recently notified staff that the pipe collapsed and separated from the storm sewer manhole that it ties into. It is the City's responsibility to repair this. Staff worked with the city engineer to put together a simple spec that was put out for quotes to at least four contractors. Two responded The pricing was very similar, but Valley -Rich Co. Inc. was slightly cheaper at $14,800 versus $15,152. The City has contracted with Valley Rich Co. Inc. in the past, and we anticipate the work will be completed in the next month. Staff prepared our standard independent contractor s agreement. To move ahead, the Council would need to approve this with a motion. Councilor Sayre made a motion to approve a Contract between the City of Lauderdale and Valley Rich Co. Inc. as presented. This was seconded by Councilor Pulford and carried unanimously. C. 2025 Budget and Levy Butkowski presented a rough first draft of the 2025 budget which includes many of the known costs for next year including staffing costs. St. Anthony sent over a preliminary policing cost of $1,052,453 or 7% over last year. Fire service costs would rise at a rate of 2.5%. The budget includes funds to join the Minnesota Association of Small Cities. As you would expect, costs are up across the boaid. Staff budgeted for the additional investment interest anticipated but LGA is only going up $205. A 10.7% levy increase is needed to balance the budget. The Council saved a third of the public safety funds provided by the legislature for 2024. Without that, the levy increase would be approximately 13.5%. Staff will continue to update the budget as information comes in. Set Agenda for Next Meeting Butkowski stated that the August 13 council meeting might include the 2025 budget and levy, a one-year extension agreement with the City of St. Anthony for policing services, and a diaft of storm water ordinances. Work Session A. Community Development Update Butkowski reiterated that council members should finish their comments on the Uses chapter of the new zoning ordinance and remit to the planning consultant. Councilor Pulford mentioned that NineNorth met and that he is sitting on a couple of League of Minnesota Cities policy committees. The Council also discussed funding that Lauderdale will receive from the small cities' transportation funding pool. B Opportunity for the Public to Address the City Council Mayor Gaasch opened the floor to those in attendance interested in addressing the Council. There being nobody interested in speaking, Mayor Gaasch closed the floor. The reminder from staff usually solves the problem. There is one property 1816 Carl Street that hasn't followed through with necessary yard work after receiving multiple let- ters. Prior to voting on abatement, the City Council must hold a hearing on the matter should the party responsible for the pioperty wish to address the City Council. Staff indicate the cost to abatement the nuisance is $125.00 per hour for labor and equipment. OPTIONS: STAFF RECOMMENDATION: Motion to adopt Resolution 081424A A Resolution Abating Rank Growth at 1816 Carl Street. RESOLUTION NO. 081424A CITY OF LAUDERDALE COUNTY OF RAMSEY STATE OF MINNESOTA A RESOLUTION ABATING RANK GROWTH AT 1816 CARL STREET WHEREAS, Lauderdale City Code Title 4, Chapter 6 call for the abatement of rank growth; and WHEREAS, the City mailed first notice of the rank growth to the owner via the US Postal Service on July 9, 2024; and WHEREAS, the rank growth was not removed by the July 23, 2024 deadline provided in the first letter; and WHEREAS, the City mailed second notice of the rank growth and notice of public hearing regarding the abatement to be considered by the City Council via the US Postal Service to the ownei on July 25, 2024; and WHEREAS, the City mailed an updated notice of the city council meeting date via the US Postal Service to the owner on August 2 2024 and WHEREAS, the rank growth remains on the property and requires removal. NOW, THEREFORE BF{ IT RESOLVED that the Lauderdale City Council finds it in the public interest and consistent with City Code to have the rank growth abated. BE IT FURTHER RESOLVED that the City Council directs staff to remove the rank growth via staff 01 by contract and bill the owner of the property for the service. The violation on the property includes the following: • Rank vegetation: weeds, grass, and plants, other than trees, bushes, flowers, and other ornamental plants, growing to a height exceeding 8 inches; and If violations are not removed from the property by August 8, 2024 the City Council will approve a Destruction Order directing staff to remove the violations at their August 13, 2024 city council meeting. At that time, the City Council will authorize for the continued abatement each time the vegetation violates City Code. You have the right to appeal the determination of the violations. Appeals must be received in writing by the City Administrator no later than seven days from the date of this letter. The property owner is liable for all costs of removal, cutting, or destruction of weeds, grasses, and rank vegetation. ANTHONY, a municipal corporation under the laws of the State of Minnesota ("St. Anthony") and the CITY OF LAUDERDALE, a municipal corporation under the laws of the State of Minnesota ("Lauderdale"). The services to be performed under this Agreement will commence January 1, 2020. PURPOSE St. Anthony and Lauderdale have the power within their respective cities to provide for the prevention of crime and for police protection. Under Minnesota Statutes, Section 471.59, the cities may, by agreement provide for the exercise of the police power by one city on behalf of the other city. This Agreement sets forth the terms and conditions under which St. Anthony will provide police services for Lauderdale. St. Anthony will have full authority and responsibility to provide services in accordance with all enabling legislation uncle] the laws of the State of Minnesota and the ordinances of Lauderdale. St. Anthon} will provide feedback to the Lauderdale City Administrator and Cit} Council on a regular and timely basis, and will actively support the creation of a Joint Advisory Committee pursuant to Section IX of this Agreement whose members come from both cities, and whose purpose is to review, monitor, and ensure a successful relationship between the two cities under this Agreement. II. INTERPRETATION This Agreement is entered following the approval by the Lauderdale and St. Anthony City Councils. SERVICES St. Anthony will provide Lauderdale with 24 hour police service, and will physically place a certified officer within the boundaries of Lauderdale 24 hours each day, except in those instances is hen the office] makes an arrest and transports a prisoner during mutual aid situations, when pi oviding 1 backup for another officer, or when called awl}, for a court appearance, booking or similar police matte r. LEVEL OF SERVICES During the term of this Agreement, St. Anthony will provide to Lauderdale the same police service extended to persons and property within St Anthony, which will include, but not be limited to, the following: A. Patrol services, with random patrolling of all residential, business and public property areas during all shifts; B. Northwest Youth and Family Services Youth Diversion Program; Li. Criminal investigations; 1. Reports on police services and activities, including weekly, monthly and annual police reports; Responses to medical emergencies, fires and other emergencies; responses shall include, where appi opriate, securing the scene for fire/rescue personnel, accompanying file/rescue personnel to the hospital upon request of such personnel, and providing follow-up information to fire/ rescue personnel upon request of such personnel; K. Officers will be available at Lauderdale City Hall to answer questions from, and provide information iegirding police activities to Lauderdale residents, business owners and staff on an as -needed basis; L. License inspections, background investigations and license enforcement services as called for under applicable state law or city ordinances; M. Review and comment, upon request, of proposed Lauderdale ordinances affecting police services or enforcement; N. hollow -up on reported crines with the person(s) who reported the crime, including routine notification by telephone or mail as to the status of the investigation; and O. Special event traffic patrol services. PAYMLNT FOR SERVICES In consideration of the services to be provided under this Agreement, Lauderdale will pay SL Anthony an annual lee of $747,071 for the year 2020, for the police service under this Agreement. St. Anthony and Lauderdale shall establish the fee for the services for each subsequent year by each preceding June 15. Vl. LIABILI'T'Y St. Anthony will be responsible for all liability incurred as a result of the actions of its employees, volunteers and agents under this Agreement, and will hold Lauderdale, its officers and employees harmless for any liability resulting from actions of a St. Anthony employ ee, volunteer or agent and shall defend I..auderdale, its officers and employees, against any claim for damages arising out of St. Anthony's perform -ince or failure to perform its obligation under this Agreement. St. Anthony will bear the expense to defend itself itnd Lauderdale in the event of a claim, action or liability including attorney s fees and any deductible amount if the matter is covered by St. Anthony's insurer. This Agreement is a "cooperative activity," rind it is the intent of the parties that they each shall be deemed a '`single governmental unit" for the purposes of liability, as set forth in Minnesota Statutes, Section 471 59, Strbd. 1 a(a); provided further that for put poses of that statute, each party to this Agreement expressly declines responsibility for the acts or omissions of the other party. VI11. ADNIINISTRATIVE RESPONSIBILITY The law enforcement and police services rendered to Lauderdale will be under the sole direction of St. Anthony. The standards of performance, the hiring and discipline of officers assigned, and other matters relating to regulations and policies related to police employment, services and activities, w ill be within the exclusive control of St. Anthony. The parties hereto expressly affirm the impoi tance of work force diversity and St. Anthony agrees to use reasonable efforts, within applicable departmental budgetary limits, to recruit qualified female and minority police officers. IX. JOINT ADVISORY COMMITTEE Both cities will appoint members to a Joint Advisory Committee. The committee will meet at least once a year to ensure that this Agreement and the services performed pursuant to this Agreement are meeting the expectations of both cities. Any recommendations of the committee will be strictly advisory. X. COMMUNICATIONS, EQUIPMENT AND SUPPLIES St. Anthony will furnish all communication equipment and any necessary supplies required to perform the services, which are to be rendered under this Agreement. XI. COOPERATION AND ASSISTANCE AGREEMENTS Lauderdale will be included in all Cooperative Agreements entered into by the St. Anthony Police Department with other police services units. XII, HEADQUARTERS Ileadquarters for services rendered to Lauderd-tle under this Agreement will be located at offices owned or Iersed by St. Anthony. The citizens of Lauderdale may notify headquarters or Ramsey County radio dispatch for police services requested either in person or by some other means of communication. All obligations with regard to workers compensation, PERA, withholding tax, insurance and similar personnel and employment matters will be the obligation of St. Anthony. Lauderdale will not be required to furnish any fringe benefits or assume any other Liability of employment to any officer assigned to duty within Lauderdale. XIV. ENFORCEMENT POLICIES Enforcement policies of St. Anthony will prevail as the enforcement policies within Lauderdale. A written statement of the current enforcement policies of St. Anthony will be provided in writing to Lauderdale. XV. ENFORCEMENT OF ORDINANCES OF THE CITY OF LAUDERDALE St. Anthony officers assigned to duty within Lauderdale will enforce Lauderdale' ordinances to the extent appropriate for enforcement by police officers. XVI. OFFICERS OF LAUDERDALE The officer's assigned duty within Lauderdale will be provided with authority to enforce the laws of the City of Lauderdale by proper action to be taken by the Lauderdale City Council, and while performing services under this Agreement will be considered police officers of Lauderdale. The Chief of Police of St. Anthony will furnish to the Lauderdale City Administrator the names of all St. Anthony police officers assigned to Lauderdale, and all such officers will be appointed officers of the City of Lauderdale. XVII. OFFENSES All offenses within Lauderdale charged by police officers under this Agreement will be charged in accordance with Lauderdale ordinances when possible; otherwise, the charge will be made in accordance with the laws of the State of Minnesota or the laws of the United States of America. XVIII. COMMUNICATIONS St. Anthony agrees to provide the Lauderdale. Administrator with weekly, monthly and annual police reports in a format as is mutually agreed to by the St. Anthony Police Chief and the Lauderdale City Administrator. The St. Anthony Police Chief will regularly communicate with the Lauderdale City Administrator in order to ensure that Lauderdale is knovn ledgeable about any police Activity in the City , and at the request of the Administrator the Police Chief will make presentations b the Lauderdale City C:ommil. XIX. PROSECUTION AND REVENUES Lauderdale will pay all costs of prosecution for all offenses charged within its boundaries or under its Contract Agreement for Police Services Page 5 ordinances. 1,EAA funds and confiscated drug funds will be retained by St. Anthony. CONTINUATION OF AGREEMENT 'Phis Agreement will be effective January 1, 2020 and will continue for a term of five years (until December 31, 2024), or until ter urinated as described in Paragraph XXI below. In consideration for services provided under this Agreement, St. Anthony and Lauderdale shall establish the fee for police services for each subsequent year by each preceding June 15. If such fee reflects an increase of 5 percent (5%) or more from the prior year's fee, then the contract in its entirety may be re -opened for negotiation at the electron of either St. Anthony or Lauderdale. Such election must be made in writing and noticed to the other contracting party by July 15 If such negotiations do not result in a newly entered contract by January I of the subsequent year, then this contract shall terminate effective as of that sante January 1. XXI. 't'ERt'.11NATION OF AGREEMENT Either St. Anthony or Lauderdale may terminate the Agreement by submitting a written notification to terminate to the City Administrator of Lauderdale and the City Manager of St. Anthony by July 15.
