DESCRIPTION OF ISSUE AND PAST COUNCIL ACTION:
Attached is the most recent / final agreement with Ramsey County regarding Eustis Street. The
final issue staff was discussing with them was section 7.3.2. Staff was arguing against this language based on past practice. In reality, the City agreed to take on this responsibility in the 1996 agreement.
Unless there are other items to discuss, the agreement is ready for council consideration.

This Agreement is between the City of Lauderdale, a municipal corporation ("City") and
Ramsey County, a political subdivision of the State of Minnesota ("County").
WHEREAS, The Project Limits are defined as Eustis Street (County Road 127) from 107-
feet South of the Lauderdale – St. Paul Border to Larpenteur Avenue (“Project Limits”)
and are shown on Exhibit A – Project Location Map; and
WHEREAS, in the area affected by construction, Eustis Street is designated County Road
127 and is located in the City; and
WHEREAS, all or part of Eustis Street is in the City rights-of-way; and
WHEREAS, the City and County desire to resurface Eustis Street from the Lauderdale –
St. Paul Border to Larpenteur Avenue within the Project Limits (“Project”) as; and
WHEREAS, The Project is identified in Ramsey County’s 2024-2028 Transportation
Improvement Program for Roadway Construction Improvements; and
NOW, THEREFORE, BE IT MUTUALLY AGREED AS FOLLOWS:

1. Responsibility for Design Engineering
1.1. Plans, specifications, and proposals will be prepared in accordance with Mn/DOT
State Aid requirements.
1.2. The County will prepare plans, specifications, and proposals for the Project, which
will include, among other things, the proposed reconstruction, alignment, profiles,
grades, cross sections, paving, concrete curb and gutter, storm sewer, storm water
treatment, pedestrian curb ramps, sidewalk, turf establishment, traffic signals,
accessible pedestrian signals, and utility replacement and adjustments.
1.3. Plans for the Project showing proposed construction will be presented to the City
and will be on file at Ramsey County Public Works Department.
1.4. Any costs associated with Project revisions after the completion of plans and
specifications will be paid for by the party requesting the revisions. Revisions are
subject to approval by both parties.
2. Responsibility for the Right of Way Plan and Acquisition
2.1. Right-of-Way being acquired for the Project will be obtained by the County.
3. Procurement and Award of Contract
3.1. The County will take bids in accordance with state law and County procedures.
3.2. The County will prepare an abstract of bids and a cost participation summary
based on the lowest responsible bidder’s proposal and will provide the same to the
City.
3.3. The County will award a contract to the lowest responsible bidder.
4. Responsibility for Construction Engineering
4.1. The County shall perform or contract the performance of the construction
engineering for all elements of the Project.
5. Project Costs
5.1. Except as provided herein, the County and City will participate in the costs of
construction in accordance with the Ramsey County Cost Participation Policy as

approved in the 2024 – 2028 Ramsey County Transportation Improvement Plan. If
there is a conflict between the Cost Participation Policy and this Agreement, this
Agreement shall prevail.
5.2. The City will not be responsible for Right-of-Way obtained for the Project. The
County will be responsible for 100% of the Right-of-Way costs.
5.3. The City will not be responsible for concrete curb & gutter installed for the Project.
The County will be responsible for 100% of the curb & gutter costs.
5.4. The City will be responsible for and shall pay a flat sum of $185,000.00 for the
Project, as identified in Exhibit D – Lauderdale City Council Meeting Minutes. This
amount was based on the total estimated cost of the construction pay items as
shown in Exhibit B – Engineer’s Estimate. Quantities and unit prices shown in
Exhibit B are estimates. Any differences in the actual costs based on the contract
unit prices and the quantities constructed, determined after Project completion, will
not increase or decrease the amount of t he City’s flat sum contribution.
5.5. Design Engineering Costs
5.5.1. The City’s design engineering fee is based on 12% of the City’s share of the
construction pay items identified in Exhibit B. This amount has been included
in the City’s flat sum contribution of $185,000.00.
5.6. Construction Engineering Costs
5.6.1. The City’s construction engineering fee is based on 12% of the City’s share
of the construction pay items identified in Exhibit B. This amount has been

6. Payment Schedule
6.1. The County will invoice the City for $92,500.00 (one-half of the City’s flat sum
contribution) at the time of contract award.
6.2. The County will invoice the City for $92,500.00 (one-half of the City’s flat sum
contribution) following Project close-out after January 1st, 2026.
6.3. Invoices must include documentation of the charges, fees, and costs as
reasonably required by the other party.
6.4. Payment will be made within 35 days of receipt of an invoice.
7. Ownership and Maintenance Responsibility for Project Elements
7.1. Ownership and Maintenance Responsibility of the Roadway.
7.1.1. The County will own and maintain the roadway and associated roadway
elements located within the County Right of Way, except as detailed below.
7.2. Ownership and Maintenance Responsibility of the Storm Sewer (catch basins and
leads, main, infiltration systems, ponding, water treatment)
7.2.1. The City shall own the following components of the storm sewer system:
i. Trunk line
ii. Trunk line manholes
iii. Surface drains located outside of the County Road right-of-way and
associated leads, if anyTrunk line outfalls
7.2.2. The County shall own the following components of the storm sewer system:
v. Catch basins
vi. Catch basin leads
vii. Cross-culverts
viii. Surface drains located within the County Road right-of-way
ix. BMP(s)

7.2.3. The City and County shall each maintain the components of the storm sewer
system under their respective ownership, as shown in Exhibit C – Storm
Sewer Ownership Map.
7.3. Ownership and Maintenance Responsibility of the Sidewalk and Trail.
7.3.1. The County will own the sidewalk and trail, and is responsible for future
overlay, or reconstruction improvements.

7.3.2. The City will maintain the sidewalk and trail, including snow and ice removal,
sweeping, crack sealing, debris removal, vegetation control, panel
replacement, settlement adjustments, etc.
8. The City grants the County temporary construction easements over all City owned
right-of-way and property within the limits of the Project for use during construction at
no cost to the County.
9. Each party is responsible for its own acts and omissions and the results thereof to the
extent authorized by law and will not be responsible for the acts and omissions of any
others and the results thereof.
10. The City and County shall indemnify, defend, and hold each other harmless against
any and all liability, losses, costs, damages, expenses, claims, or actions, including
attorney’s fees, which the indemnified party, its officials, agents, or employees may
hereafter sustain, incur, or be required to pay, arising out of or by reason of any act or
omission of the indemnifying party, its officials, agents, or employees, in the execution,
performance, or failure to adequately perform the indemnifying party’s obligation
pursuant to this Agreement. Nothing in this Agreement shall constitute a waiver by the
County or the City of any statutory or common law immunities, limits, or exceptions on
liability.
11. COUNTERPARTS: The parties may sign this Agreement in counterparts, each of
which constitutes an original, but all of which together constitute one instrument.
11.1. ELECTRONIC SIGNATURES: The parties agree that the electronic
signature of a party to this Agreement shall be as valid as an original signature of
such party and shall be effective to bind such party to this Agreement. The parties
further agree that any document(including this Agreement and any attachments or
exhibits to this Agreement) containing, or to which there is affixed, an electronic
signature shall be deemed (i) to be “written” or “in writing”, (ii) to have been signed
and (iii) to constitute a record established and maintained in the ordinary course of
business and an original written record when printed from electronic files. For
purposes hereof, “electronic signature” also means a manually signed original
signature that is then transmitted by any electronic means, including without
limitation a faxed version of an original signature or an electronically scanned and
transmitted version (e.g., via PDF) of an original signature. Any party’s failure to
produce the original signature of any electronically transmitted signature shall not
affect the enforceability of this Agreement.

12. This Agreement shall remain in full force and effect until terminated by mutual
agreement of the parties.

Call to Order
Mayor Gaasch called the Regular City Council meeting to order at 7:01 p.m.
Roll Call
Councilors present: Evan Sayre, Jeff Dains, Sharon Kelly, Duane Pulford, and Mayor Mary Gaasch.
Councilors absent: None.
Staff present: Heather Butkowski, City Administrator; Jim Bownik, Assistant to the City
Administrator; and Miles Cline, Deputy City Cleric
Approvals
Mayor Gaasch asked if there were any additions to the meeting agenda. There being none, Councilor
Dains moved and seconded by Councilor Kelly to approve the agenda as presented. Motion carried
unanimously.
Mayor Gaasch asked if there were corrections to the minutes of the October 22, 2024, City Council
meeting. There being none, Councilor Pulford moved and seconded by Councilor Sayre to approve
the October 22, 2024, City Council meeting minutes. Motion carried unanimously.
Mayor Gaasch asked if there were any questions on the claims. There being none, Councilor Kelly
moved and seconded by Councilor Sayre to approve the claims totaling $163,908.71. Motion carried
unanimously.
Consent
Councilor Kelly moved and seconded by Councilor Pulford to approve the Consent Agenda thereby
approving the Abdo Financial Solutions Proposal for Audit Preparation Services; sale of the Ford F-
350 to Boyer Trucks; the Larpenteur Avenue Snow Removal Contract with 8th Day Landscaping;
and the joint powers agreement for recycling funding with Ramsey County.
Discussion/ Action Item
A. Resolution No. 111224A Certifying the Election Returns of the November 5, 2024, General
Municipal Election
Per Minnesota Statutes section 205.185, the governing body of a city acts as the canvassing
board, canvasses the election returns, and declares the results of the election within three to ten
days after a general election. Ramsey County elections staff prepared the abstract and resolution.
Councilor Kelly made a motion to adopt Resolution No. 111224A-A Resolution Certifying the
Election Returns of the November 5, 2024, General Municipal Election. This was seconded by
Councilor Sayre and carried unanimously.

B. 2025-2034 Capital Improvement Plan (CIP)
Staff drafted the CIP to include the typical items we keep on the radar along with the anticipated
costs of repaving the City streets in the next one to three years. Council members expressed
interest in budging for park and City Hall improvements. Based on the discussion staff allocated
$10,000 in the CIP to engage an architect to discuss accessibility improvements and $10,000 for
incidental park improvements.
C. 2025 Sanitary Sewer, Storm Sewer, and Recycling Utility Rate Study
Annually, the City Council discusses the sewer and recycling funds and whether rate increases
are necessary. Staff recommended increasing the sanitary sewer rates by 6.7% or $16.74 per
household annually in anticipation of the manhole casting repair project prior to the mill and
overlay project. Staff recommended increasing the storm sewer rates by 13.6% or $11.64 per
household annually also in anticipation of the future mill and overlay project. Staff
recommended increasing the recycling rates by 7.5% or $9.00 per household annually in
response to the new recycling contract and the need to replenish cash reserves. A resolution
adopting these rates will be brought to the next meeting.
D. 2025 Special Revenue, Capital, and Enterprise Fund Budgets
Included in the packet were the 2025 Special Revenue, Capital, and Enterprise Fund budgets.
The budgets included the various CIP expenditures already planned for and the utility rate
revenue already presented. Staff will bring final drafts to the next meeting for the Truth-in-
Taxation public hearing. Adoption is expected on December 10.
E. Eustis Street Cost Share with Ramsey County
Previously, the City Council sent letters to the Ramsey County Commissioners regarding the
anticipated cost share for Eustis Street. Public Works staff responded with an updated proposal
reducing the cost share items the City was expected to contribute to. City staff asked that they
calculate the actual cost. John Mazzitello, Deputy Director of Ramsey County Public Works,
responded with an estimate of $183,789 or a flat amount of$185,000.
As the City owns one leg of the Eustis Street/Larpenteur Avenue intersection, the City's cost
share for the intersection is $140,000. The new proposal asks the City to cover $45,000 toward
sidewalk improvements and engineering costs. If the Council agrees to the flat rate, the burden
of cost overruns will be paid by Ramsey County.
Staff noted that this was a significant reduction from the County's cost share policy which put
the cost share over $600,000. If the Council agreed, the City would pay the $185,000 from Fund
403 - Street Improvements. The current balance of that fund is $567,000. The Council expressed
frustration with the negation process but determined the $185,000 was agreeable.

The on-going goal of the Council is to get county and state officials to support changing
municipal state aid laws so that cities under 5,000 in population, like Lauderdale, receive a
proportional allocation. People who live in cities under 5,000 population should not carry a
greater burden for transportation improvements.
F. Resolution No. 111224B Levying Special Assessments
Each year, the City must submit a resolution to Ramsey County certifying special assessments
for the year. This year, the City has special assessment that were negotiated via petition and waiver
agreements. The resolution is a formality as the petitio n and waiver agreements eliminate the need
for a public hearing and the owners have forgone the right to appeal.
Councilor Sayre made a motion to adopt Resolution No. 111224B Resolution Levying Special
Assessments. This was seconded by Councilor Pulford and carried unanimously.
G. Sanitary Sewer Cleaning and Televising Quotes
Sanitary sewer cleanings are on a three-year schedule. This is scheduled for 2024 and 2025. The
City is split into two halves for the work. The 2024 cleaning may end up carrying over into 2025.
The 2025 cleaning will be in the fall. City staff worked with the city engineer to produce specs
and quote the work. Six sewer cleaning and televising companies responded with quotes.
The pricing varied significantly between contractors. The best pricing was provided by Visu-
Sewer. The sewer televising/cleaning cost was $65,332.25 without the cost to adjust a buried
manhole compared to $66,886.25 provided by Pipe Services. If the missing manhole needs to be
raised, Visu-Sewer provided the best price for that as well. Visu-Sewer completed the last round
of televising and cleaning when they did the sewer lining for the City.
Councilor Kelly made a motion to approve the Contract between the City of Lauderdale and
Visu-Sewer, Inc. This was seconded by Councilor Sayre and carried unanimously.
Set Agenda for Next Meeting
Butkowski stated that the November 26 Council meeting might include the 2025 Capital and
Enterprise Fund Budgets, a Resolution Establishing 2025 Utility Rates, the Catholic Eldercare
Conduit Bond Project, a Truth-in-Taxation Public Hearing, a Draft of Cannabis Regulations, and the
City Administrator Performance Review.

Call to Order
Mayor Gaasch called the Regular City Council meeting to order at 7:01 p.m.
Roll Call
Councilors present: Evan Sayre, Jeff Dains, Sharon Kelly, Duane Pulford, and Mayor Mary Gaasch.

Approvals
Mayor Gaasch asked if there were any additions to the meeting agenda. There being none, Councilor
Dains moved and seconded by Councilor Kelly to approve the agenda as presented. Motion carried
unanimously.
Mayor Gaasch asked ifthere were corrections to the minutes of the October 22, 2024, City Council
meeting. There being none, Councilor Pulford moved and seconded by Councilor Sayre to approve
the October 22, 2024, City Council meeting minutes. Motion carried unanimously.
Mayor Gaasch asked ifthere were any questions on the claims. There being none, Councilor Kelly
moved and seconded by Councilor Sayre to approve the claims totaling $163,908.71. Motion carried
unanimously.
Consent
Councilor Kelly moved and seconded by Councilor Pulford to approve the Consent Agenda thereby
approving the Abdo Financial Solutions Proposal for Audit Preparation Services; sale of the Ford F-
350 to Boyer Trucks; the Larpenteur Avenue Snow Removal Contract with 8th Day Landscaping;
and the joint powers agreement for recycling funding with Ramsey County.
Discussion/ Action Item
A. Resolution No. l 11224A- Certifying the Election Returns of the November 5, 2024, General
Municipal Election
Per Minnesota Statutes section 205.185, the governing body of a city acts as the canvassing
board, canvasses the election returns, and declares the results of the election within three to ten
days after a general election. Ramsey County elections staff prepared the abstract and resolution.
Councilor Kelly made a motion to adopt Resolution No. 111224A-A Resolution Certifying the
Election Returns of the November 5, 2024, General Municipal Election. This was seconded by
Councilor Sayre and carried unanimously.

B. 2025-2034 Capital Improvement Plan (CIP)
Staff drafted the CIP to include the typical items we keep on the radar along with the anticipated
costs of repaving the City streets in the next one to tlu·ee years. Council members expressed
interest in budging for park and City Hall improvements. Based on the discussion staff allocated
$10,000 in the CIP to engage an architect to discuss accessibility improvements and $10,000 for
incidental park improvements.
C. 2025 Sanitary Sewer, Storm Sewer, and Recycling Utility Rate Study
Annually, the City Council discusses the sewer and recycling funds and whether rate increases
are necessary. Staff recommended increasing the sanitary sewer rates by 6.7% or $16.74 per
household annually in anticipation of the manhole casting repair project prior to the mill and
overlay project. Staff recommended increasing the storm sewer rates by 13.6% or $11.64 per
household annually also in anticipation of the future mill and overlay project. Staff
recommended increasing the recycling rates by 7.5% or $9.00 per household annually in
response to the new recycling contract and the need to replenish cash reserves. A resolution
adopting these rates will be brought to the next meeting.
D. 2025 Special Revenue, Capital, and Enterprise Fund Budgets
Included in the packet were the 2025 Special Revenue, Capital, and Enterprise Fund budgets.
The budgets included the various CIP expenditures already planned for and the utility rate
revenue already presented. Staff will bring final drafts to the next meeting for the Truth-in-
Taxation public hearing. Adoption is expected on December 10.

E. Eustis Street Cost Share with Ramsey County
Previously, the City Council sent letters to the Ramsey County Commissioners regarding the
anticipated cost share for Eustis Street. Public Works staff responded with an updated proposal
reducing the cost share items the City was expected to contribute to. City staff asked that they
calculate the actual cost. John Mazzitello, Deputy Director of Ramsey County Public Works,
responded with an estimate of $183,789 or a flat amount of $185,000.
As the City owns one leg of the Eustis Street/Larpenteur Avenue intersection, the City's cost
share for the intersection is $140,000. The new proposal asks the City to cover $45,000 toward
sidewalk improvements and engineering costs. If the Council agrees to the flat rate, the burden
of cost overruns will be paid by Ramsey County.
Staff noted that this was a significant reduction from the County's cost share policy which put
the cost share over $600,000. If the Council agreed, the City would pay the $185,000 from Fund
403 - Street Improvements. The current balance of that fund is $567,000. The Council expressed
frustration with the negation process but determined the $185,000 was agreeable.

The on-going goal of the Council is to get county and state officials to support changing
municipal state aid laws so that cities under 5,000 in population, like Lauderdale, receive a
proportional allocation. People who live in cities under 5,000 population should not carry a
greater burden for transportation improvements.
F. Resolution No. 111224B-Levying Special Assessments
Each year, the City must submit a resolution to Ramsey County certifying special assessments for
the year. This year, the City has special assessment that were negotiated via petition and waiver
agreements. The resolution is a formality as the petition and waiver agreements eliminate the need
for a public hearing and the owners have forgone the right to appeal.
Councilor Sayre made a motion to adopt Resolution No. 111224B -A Resolution Levying
Special Assessments. This was seconded by Councilor Pulford and carried unanimously.
G. Sanitary Sewer Cleaning and Televising Quotes
Sanitary sewer cleanings are on a three-year schedule. This is scheduled for 2024 and 2025. The
City is split into two halves for the work. The 2024 cleaning may end up carrying over into 2025.
The 2025 cleaning will be in the fall. City staff worked with the city engineei- to produce specs
and quote the work. Six sewer cleaning and televising companies responded with quotes.
The pricing varied significantly between contractors. The best pricing was provided by Visu-
Sewer. The sewer televising/cleaning cost was $65,332.25 without the cost to adjust a buried
manhole compared to $66,886.25 provided by Pipe Services. If the missing manhole needs to be
raised, Visu-Sewer provided the best price for that as well. Visu-Sewer completed the last round
of televising and cleaning when they did the sewer lining for the City.
Councilor Kelly made a motion to approve the Contract between the City of Lauderdale and
Visu-Sewer, Inc. This was seconded by Councilor Sayre and canied unanimously.
Set Agenda for Next Meeting
Butkowski stated that the November 26 Council meeting might include the 2025 Capital and
Enterprise Fund Budgets, a Resolution Establishing 2025 Utility Rates, the Catholic Eldercare
Conduit Bond Project, a Truth-in-Taxation Public Hearing, a Draft of Cannabis Regulations, and the
City Administrator Performance Review.
