TUESDAY, APRIL 14, 2015 LAUDERDALE CITY HALL, 1891 WALNUT STREET The City Council is meeting as a legislative body to conduct the business of the City according to Robert's Rules of Order and the Standing Rules of Order and Business of the City Council. Unless so ordered by the Mayor, citizen participation is limited to the times indicated and always within the prescribed rules of conduct for public input at meetings. 1. CALL THE MEETING TO ORDER 2. Opportunity for the Public to Address the City Council Any member of the public may speak at this time on any item not on the agenda. In consideration for the public attending the meeting, this portion of the meeting will be limited to fifteen (15) minutes. Individuals are requested to limit their comments to four (4) minutes or less. If the majority of the Council determines that additional time on a specific issue is warranted, then discussion on that issue shall be continued at the end of the agenda. Before addressing the City Council, members of the public are asked to step up to the microphone, give their name, address, and state the subject to be discussed. All remarks shall be addressed to the Council as a whole and not to any member thereof. No person other than members of the Council and the person having the floor shall be permitted to enter any discussion without permission of the presiding officer. ADJOURNMENT LAUDERDALE CITY COUNCIL MEETING MINUTES Lauderdale City Hall 1891 Walnut Street Lauderdale, MN 55113 Pagel of 3 March 24, 2015 Mayor Dains called the City Council meeting to order at 7:31 p.m. Councilors present: Mary Gaasch, Roxanne Grove, Lara Mac Lean, and Mayor Jeff Dains. Councilors Absent: Denise Hawkinson. Staff present: Heather Butkowski, City Administrator; Jim Bownik, Assistant City Administrator; Dave Hinrichs, Public Works Coordinator; and Kevin Kelly, Deputy City Clerk. Mayor Dains asked for changes to the meeting agenda. There being none, Councilor Gaasch moved to approve the agenda. Councilor Mac Lean seconded the motion and it passed unanimously. Councilor Grove moved to approve the March 10, 2015, City Council meeting minutes. Councilor Gaasch seconded the motion and it passed unanimously. Councilor Gaasch moved approval of the claims totaling $20,625.44. Councilor Mac Lean seconded the motion and it passed unanimously. Mayor Dains asked if any Councilors wished to remove items from the Consent Agenda. There being none, Councilor Grove moved to acknowledge the February Financial Report and PCIC minutes; approve of the sale of miscellaneous items; and select Mike McPhillips, Inc. as the 2015 street sweeping contractor. Councilor Gaasch seconded the motion and it passed unanimously. Informational Presentations: Audit Presentation, Andy Berg, Abdo, Eick and Meyers Berg gave the City a qualified or clean opinion regarding the 2014 Audit. The only deficiency Berg is that Abdo, Eick and Meyers prepares the City's financial statements as the staff are unable to do so. Berg stated that the City's financial position is strong. The City expenditures were under budget for 2014 with revenue up slightly. When the General Fund balance at year end exceeds 60% of the next year's operating expenses, the City transfers the excess to capital improvement funds. This year, $25,018 was deposited into Fund 402. Berg also pointed out that the City made the final bond payment for the 2000-2004 street improvement projects. The agenda for the next meeting will include the Legislative Update with Senator John Marty and Representative Alice Hausman and a resident request for a permit to keep more than 12 hen chickens. LAUDERDALE CITY COUNCIL MEETING MINUTES Lauderdale City Hall 1891 Walnut Street Lauderdale, MN 55113 Page 2 of 3 March 24, 2015 Work Session: Mayor Dains explained that the Council was moving into the Work Session. Work Sessions are a continuation of the meeting but not aired on community television. Mayor Dains asked if anyone wished to address the Council. No one came forward. Discussion with David Lawrence regarding 2430 Larpenteur Avenue Lawrence presented his ideas on building a coffee shop at 2430 Laipenteur (city -owned site). Lawrence owned a coffee shop in Falcon Heights for 12 years and stated he has done research on the Lauderdale area and believes it would support a coffee shop. Lawrence's idea was to house the coffee shop in a yurt. City Council members asked questions related to how yurts are constructed and whether he was looking to purchase the property. They thanked him for coming to the meeting. Mayor Dains called for a break at 8:24 p.m. The Council meeting resumed at 8:30 p.m. Hazardous Buildings Ordinance, Discussion with City Attorney Ron Batty Butkowski presented to the Council a presentation of properties that are looking "tired" or are very small by modern standards as a follow up to the previous meeting's discussion of nuisance code issues related to building maintenance. City Attorney Batty described the Hazardous Building statute found in state law. He said the City can issue repair orders for properties that are a significant fire or safety hazard. When owners don't comply, the City can get permission from the courts to repair or tear down structures. Batty looked at the presentation and stated he didn't believe the properties shown met the standards for hazardous buildings. He then explained that some cities purchase properties similar to those shown. For example, he discussed the City of Robbinsdale which has a long-standing program to purchase distressed properties with TIF funds. Mayor Dains called for a break at 9:30. The meeting resumed at 9:31. Planning for Staffing Changes Butkowski stated the public works maintenance job description was updated and is ready for Council approval. She also presented the Council with a timeline for the hiring process. Councilors Gaasch and Mac Lean volunteered to help interview candidates. Councilor Gaasch moved to approve the updated public works maintenance job description. Councilor Grove seconded the motion and it passed unanimously. 2015 Capital Inprovement Projects Update Butkowski said the Council budgeted for the seal coating project in 2015. Based on a variety of factors, including the condition of the road, staff suggested the City wait on the seal coating LAUDERDALE CITY COUNCIL MEETING MINUTES Lauderdale City Hall 1891 Walnut Street Lauderdale, MN 551.13 Page 3 of 3 March 24, 2015 project until 2016 but continue with plans for alley repairs and improving the two Community Park parking lots in 2015. The Council expressed no objections to this plan. Butkowski said the City occasionally gets requests from residents who would like unimproved alleys to be paved. As the City will be contracting for paving work in 2015 and 2016, it would be the time to consider alley improvements. If the Council was interested, staff could ask residents adjacent to unimproved alleys if they would like to see them improved. There are three partially paved alleys in the City which the City could connect for through traffic. The Councilors said they would take it into consideration. Community Development Update The Council discussed the 2430 Larpenteur property and concluded they will continue to hold it for the right opportunity. They also will have a subcommittee of the Council meet with interested parties in the future. There being no further business on the council agenda, Councilor Gaasch moved to adjourn the meeting. Councilor Grove seconded the motion and it carried. Mark realizes this needs to be done and wants to comply with City Code. As such, he is making application for a chicken permit. As he is requesting to keep more than 12 hens, he needs to receive Council approval. Mark supplied the following information by email. He would like to keep the 22 hens he has and he is requesting the City allow him to keep his roosters until they die, which would likely be another two to five years. OPTIONS: Mark plans to attend the Council meeting. You will be able to ask him any remaining ques- tions you have before making a decision. Here is the info for the 4/14 city council meeting regarding the chickens. I will be back in Minnesota for the meeting. Please let me know if I have forgotten anything. Hopefully this can be resolved soon. Thank you, Marls Salovich 2337 Summer St 651 235 6844 Number of Hens: 22 The chickens are kept in an insulated, draft free coup that provides them plenty of room. There is a fan, window and vents that allow air circulation during the summer months to keep them cool. The coup is also located near a tree, which provides shade from the sun. In the winter, the coup is kept above freezing by warmth from a small heater as needed. There are also south facing windows which provide solar heat on sunny winter days. The chickens are only let out of their coup when I am home to keep them safe and prevent them from escaping or being a nuisance. They are under constant supervision. The coup is cleaned regularly to avoid any negligible odors. I have three roosters which hatched from the original clutch I incubated in April 2012. Since then, it has been brought to my attention that male chickens are not allowed. I believe the ordinance changed in 2013. Since then I have tried unsuccessfully to find a new home for them once I learned that Lauderdale does not recognize "Grandfathering". Adult male chickens are nearly impossible to integrate into an existing flock and are considered to "old" to eat after one or two years of age. I am sickened by the thought of destroying them since they are pets and part of my original chicken "family" that I've enjoyed since 2012. 1 am asking that the City Council allow them to live out their life with me which is typically 5-8 years. It is 10x10 and does not currently have a run. It is located in the NE quadrant of my backyard. Thanks, Mark Salovich LAUDERDALE COUNCIL ACTION FORM Action Requested Consent Public Hearing Discussion Action Resolution Work Session X Meeting Date April 14, 2015 ITEM NUMBER Building Acquisition STAFF INITIAL k APPROVED BY ADMINISTRATOR DESCRIPTION OF ISSUE AND PAST COUNCIL ACTION: At the last meeting, City attorney Ron Batty explained the hazardous building statute and why some cities prefer property acquisition to "condemnation" (the issuing of raze or repair orders). There was a lot of good discussion but time ran short and I am sure you wanted to give it more thought. I sensed that the Council would like to make in roads to address some of the housing shortfalls of the City. By that I mean the lack of senior -friendly housing and the lack of step up or family -friendly housing. The last discussion highlighted two types of property that cities get involved with: the small homes and the "tired" homes. With regard to the tired homes, I think there were a few the Council agreed upon, namely 1768 Eustis St. and 1825 Eustis St. There are a few others that I might throw out there but those are the primary two. I received a listing of the homes in Lauderdale by livable square footage. You will see on the attached spreadsheet that four homes are less than 500 square feet, another ten are less than 600 square feet, and 12 that are less than 700 square feet. Dave said that for a while the building code did not allow permits to be issued for homes of less than 700 square feet but many of these homes were built before those codes were adopted or enforced. Many of these homes are in good condition, some are rented. Two are owned by women who recent- ly passed away. Some are on more attractive lots than others. Two are on Larpenteur Ave- nue. The goal in acquiring these would be to make way for bigger homes with more attrac- tive features that currently don't exist in the City. If the Council wanted begin acquiring properties, the two noted in green might be a good place to start. They are both very small homes and the owners recently passed away. It is better to catch family before they put money into fixing them up or start working with a realtor. The properties in yellow are primarily rental property. With the Council's blessing, I would contact them to find out what their plans are. I would let them know of the City's interest and ask them to contact me when they are interested in selling. Finally, I think there are a couple of properties worth keeping on the watch list because they don't blend in with the neighborhood. First are the two adjacent 6-plexes on Walnut. One is well managed and the other seems to be less well cared for. The other is the 4-plex on Pleasant St. These properties were built on lots platted for -single family homes so they tend to be unable to accommodate the parking of those who live there and generate activity in the neighborhood that a single family home would not. These properties will be more expensive to acquire I am guessing they generate pretty good income for the owners. Another property to consider is 2439 Larpenteur Avenue. It is the home located between the Wellness Center and the BP Station. Much like the service station the city purchased, it is a lot that should be attached to one of the adjacent parcels and used for a commercial purchase.
