LAUDERDALE CITY COUNCIL MEETING AGENDA 7:30 P.M. TUESDAY, APRIL 26, 2011 LAUDERDALE CITY HALL, 1891 WALNUT STREET The City Council is meeting as a legislative body to -conduct the business of the City according to Robert's Rules of Order and the Standing Rules of Order and Business of the City Council. Unless so ordered by the Mayor, citizen participation is limited to the times indicated and always within the prescribed rules of conduct for public input at meetings. 1. CALL THE MEETING TO ORDER 2. Opportunity for the Public to Address the City Council Any member of the public may speak at this time on any item not on the agenda. In consideration for the public attending the meeting for specific items on the agenda, this portion of the meeting will be limited to fifteen (15) minutes. Individuals are requested to limit their comments to four (4) minutes or less. If the majority of the Council determines that additional time on a specific issue is warranted, then discussion on that issue shall be continued at the end of the agenda. Before addressing the City Council, members of the public are asked to step up to the microphone, give their name, address, and state the subject to be discussed. All remarks shall be addressed to the Council as a whole and not to any member thereof. No person other than members of the Council and the person having the floor shall be permitted to enter any discussion without permission of the presiding officer. Your participation, as prescribed by the Robert's Rules of Order and the standing rules of order and business of the City Council, is welcomed and your cooperation is greatly appreciated. 13. ADJOURNMENT LAUDERDALE CITY COUNCIL MEETING MINUTES Lauderdale City Hall 1891 Walnut Street Lauderdale, MN 55113 Page 1 of 3 April 12, 2011 Mayor Dains called the City Council meeting to order at 7:30 p.m. Councilors present: Mary Gaasch, Roxanne Grove, Denise Hawkinson, and Mayor Jeff Dains. Councilor absent: Lara Mac Lean. Staff present: Heather Butkowski, City Administrator; Jim Bownik, Assistant to the City Administrator. Mayor Dains asked for changes to the meeting agenda. There being none, Councilor Hawkinson moved to approve the agenda. Councilor Grove seconded the motion and it passed unanimously. Councilor Grove moved to approve the March 22, 2011, City Council meeting minutes. Councilor Hawkinson seconded the motion and it passed unanimously. Councilor Hawkinson moved approval of the claims totaling $80,948.63. Councilor Gaasch seconded the motion and it passed unanimously. Mayor Dains asked if councilors wished to remove items from the consent agenda. There being no one, Councilor Gaasch moved the consent agenda items: 2011 HVAC and rental housing licenses and the PCIC minutes. Councilor Grove seconded the motion and it passed unanimously. City auditor Andrew Berg of Abdo, Eick, and Meyers addressed the Council. He reviewed the City's year-end financials. The City received an unqualified opinion, which means there were no issues found through the course of the audit. The City continues to receive one finding, as the auditor also prepares the financial statements. He indicated this is the norm in most small cities that do not have a dedicated finance department. Councilor Hawkinson moved to accept the 2010 audit findings and financial statements as prepared by Abdo, Eick, and Meyers. Councilor Gaasch seconded the motion and it passed unanimously. Paul Bilotta from Bonestroo reviewed the municipal liquor store market research with the City Council. He said the area showed a lot of promise due to positive traffic eounts and little competition in the immediate area. Overall, he expected a store of 4,000-6,000 square feet would be both viable in a market sense and in relation to space that might be available for a new retail store in Lauderdale. LAUDERDALE CITY COUNCIL MEETING MINUTES Lauderdale City Hall 1891 Walnut Street Lauderdale, MN 55113 Page 2 of 3 Councilor Mac Lean arrived at 8:05 p.m. Mayor Dains asked about the profitability of a liquor store. Paul said the state auditor's report of municipal liquor stores showed profit margins were up in 2009 over 2008 at 8.1 % of sales. Using this number, the size of liquor store being discussed could generate $150,000 in profit a year. The Council also asked about start up costs. Bilotta said in a lease situation, the start up costs would run about $200,000 for the coolers, shelving, security system, and initial inventory. A lease arrangement minimizes risk. The price to purchase property and construct a store has greater unknowns at this point. The Council discussed hosting a community meeting. after the legislative session but before setting the levy in September. The meeting would address the options (liquor store, taxes, consolidation) the Council is weighing to improve the long-term financial health of the City considering the volatility of state aids and credits. A date will be set at a future meeting. State representatives Sarah Anderson and Mary Murphy asked for feedback on the upcoming state-wide redistricting. Staff drafted the response highlighting some reasons why the City would like to remain in a legislative district with Roseville versus Minneapolis or St. Paul. The Council agreed with the arguments; staff will mail the letter shortly. Butkowski reviewed the preliminary agenda for the next meeting, which included the annual SWPPP presentation, Ione/Walnut Park signage, bike parking program, and March finances and investments. Mayor Dains explained the Council was moving into the work session. Work sessions are a continuation of the meetings but not aired on community television. Mayor Dains asked if anyone in attendance wished to address the Council. No one present wished to do so. Butkowski said there was little new 2012 budget information to present as the legislature is still grappling with their budget. Until the state budget is adopted, there is some uncertainty about what level of police service the City will be able to afford the next two years. The current contract says either city must notify the other city if it does not intend to renew the contract by April 15 otherwise a new agreement must be reached by June 15. As the April 15 termination date draws near, and much remains unknown, Falcon Heights and Lauderdale staff talked about asking St. Anthony to extend the April 15 deadline to June 15. The letter presented to the Council makes the request but reserves the right to terminate the agreement if the April 15 deadline is not extended. The Council said the situation is unfortunate but they saw the need to send the letter to keep the City's options open. Councilor Grove seconded the motion and it passed unanimously. There being no further business on the council agenda, Councilor Hawkinson moved to adjourn the meeting. COUNCIL ACTION: City of Lauderdale First Quarter Investment Report April 26, 2011 The quarter ended with a general fund balance of $415,137.27 and cash and investments totaling $2,609,142.04. That is the total of all fund balances including the 601 and 602 sewer enterprise funds. Since the City pools the fund balances for investment purposes, at quarter end $2,464,119.78 was invested. $1,077,159.46 was invested in money market funds and $1,386,960.32 in certificates of deposit (CDs). The City purchased two CDs this quarter. BMW Bank of North America (UT) at 1.15% for 24 months. GE Capital Finance (UT) at 1.35% for 36 months. No banks failed this quarter that the City owns CDs through. The FCIC is still closing banks weekly. The money market rates remain terrible. The month by month rates for the money market accounts follow. The maturation of a CD earning 4.17% accounted for $11, 665.18 of this quarter's interest. The City no longer owns any CDs paying this high of rate. Additionally, the checkbook earned $428.57. The checkbook interest is deposited into the general fund and is not distributed among the other funds. This brings 2011 investment interest earnings to $15,941.49. The City earned $54,673.60 in interest in 2010. Table 2 shows how the interest was divided between the funds and compares interest earned to the adopted budget. The funds with the largest balances get the greatest interest distributions. Staff provides Councilors the investment spreadsheet as an internal control procedure required by the auditor. As always, staff is available to answer questions and provide the Council with research related to the City's investments. This is our night to do. that. I will give a brief presentation on such things as: why Lauderdale has to have a MS4 permit, what is in the City's SWPPP, compliance with mandates, appropriateness of best management practices (BMPs), and progress in achieving BMP goals. Attached is the 2009 SWPPP report for your review. The 2010 report is due by the end of June 2011. The City's SWPPP is about 75 pages long. I did not include a copy in your packet. If you would like to have a copy, let me know. It is also available on the City's website. The City did a lot in 2008 and 2009 to meet stormwater best management practices (BMPs) including adopting stormwater management and illicit discharge ordinances and preparing an Impaired Waters Review. This year the City continued its efforts to meet the educational requirements and the rest of the BMPs. Also this year, the City installed the "clean up after your pet signs" around the City as that was one of the last BMPs left to address. As I have mentioned before, some of the BMPs the City committed to a number of years ago aren't feasible or possible. The MS4 permit is up for renewal over the course of the next year so staff will work to make the permit requirements applicable to the City. We measured the field to see if it would accommodate 1 1-13 year olds. They. thought it would with some changes. They talked about replacing/improving the backstop and adding dugouts (like in the attached photos) and expanding the infield to accommodate 75' between bases. They would honor our request to not have a permanent pitchers mound (it would interfere with other uses including the skating rink). The improvements would cost about $20,000. The Association would fund the improvements along with any other sponsors they could find. As for ongoing maintenance, Dave and Joe would still drag the field periodically, but the baseball players would do most of the field work. They would put up a little shed/container to house the rakes, bases, etc. In exchange for the improvements, they want first dibs on scheduling for the field for years to come. Practices start in mid-April with games from mid-May thru July. They would want the field from about 5:00 to 8:00 pm Sunday thru Thursday. They would like to know if the Council is interested in working with them. Improvements would happen in the fall and they would start using the field in 2012. Staff would work out any conflicts there would be with Roseville Summer Rec. They haven't done formal agree- ment with Roseville in the past but I think it would be good to draft something so everyone is one the same page and we can cover any liability concerns the League might have. I asked the apartment managers if they saw a need near them. City Gables suggested installing bike racks near the bus stops on Larpenteur Avenue. The County was agreeable to this but in the end it doesn't work well within the parameters of the grant because the City would be get- ting a grant to put something in county right-of-way. TLC is considering funding for coun- ties because they realize the issues involved. Staff talked about places that might benefit by a bike rack. We still haven't come up with exact locations because there is some ambiguity as to what surfaces they can be attached to. Overall, I was thinking I bike rack at City Hall, two in Community Park on the more eastern end, and two in the "new" park. The bike rack options are included in the packet. The grant pays for the racks but not installation costs. Those costs will vary based on whether public works would have to lay cement for them. Basis of the Bike Parking Program TLC has worked with the City of Minneapolis, MnDOT and the FHWA to develop a streamlined federal funding process with much of the administrative work being completed by TLC in advance of program enrollment. Participating communities will need to enroll in the program by subscription including entering into a community agreement with the city of Minneapolis who has been named the award recipient for the program and will be contracting directly with the approved vendor for purchase and delivery of bike parking to each community. Additionally, the agreement will specify the agency's responsibility for meeting program guidelines including all relevant state and federal requirements for use of federal aid highway funds. WITNESSETH: WHEREAS, the CITY OF LAUDERDALE desires to locate and construct new bicycle parking facilities, State Project 141-091-028 ("Project") within its boundaries and has been determined to be eligible for Federal Non -Motorized Transportation Pilot Project funds (hereby known as the "NTP"); and WHEREAS, the CITY OF LAUDERDALE recognizes and is relying on the CITY OF MINNEAPOLIS to act as the financial agent for the receipt of NTP federal grant funds for this Project to streamline the reporting requirements on behalf of the CITY OF LAUDERDALE. WHEREAS, the CITY OF LAUDERDALE is aware of and understands the Project Memorandum dated August 16, 2010 that was created for this Project and shall follow its provisions; WHEREAS, the CITY OF MINNEAPOLIS has agreed to act as the financial agent to receive approximately $75,000 in NTP federal grant funds (MnDOT Agreement No. 97553) to procure and furnish bike parking facilities on behalf of cities and counties that are eligible to receive NTP grant funds; and WHEREAS, the CITY OF LAUDERDALE understands that the federal grant funds will be used to the procure and furnish the bicycle parking facilities but will not be used for the installation, operation or maintenance of said facilities; WHEREAS, the CITY OF LAUDERDALE shall install and assume ownership, operation and maintenance of the bike parking facilities at its own cost according to the federal NTP grant provisions and this Agreement; NOW THEREFORE, in consideration of the mutual promises and mutual obligations of the Cities contained herein, each of them does hereby represent, covenant and agree with the other as follows. Minneapolis Obligations. Minneapolis through its Director of Public Works or his/her designee shall carry out its fiscal agent and Agreement responsibilities for the Project in all participating cities and counties. Minneapolis will expect Transit for Livable Communities (TLC) and each participating City/County to perform their due diligence and responsibilities to complete the Project. Minneapolis will advertise a bid to contract with a vendor to furnish (purchase and delivery) of specified bicycle parking facilities to each participating City/County. Minneapolis will be responsible for maintaining financial records consistent with federal grant requirements to keep track of all federal expenses related to these funds. Minneapolis shall reimburse the approved vendor in a timely manner for any and all eligible federal costs, and submit documentation for reimbursement to MnDOT when project documentation is completed. 2. City/County Eligibility. Each City/County agrees to perform the following at their own cost prior to becoming eligible: a. Submission of candidate locations for possible placement of bike parking facilities to TLC. b. Provide the proper Certificate of Stand Alone Right of Way for installation locations, or obtain necessary easements to use private property to locate and grant public access to the respective bike parking facilities. Provide any environmental information on all proposed locations for a possible bike parking facility required by the Cultural Resources Unit of the Minnesota Department of Transportation to assure compliance with all applicable State and Federal environmental requirements. d. Agree to provide suitable locations and install the bike parking facilities including the construction of a foundation where necessary. Agree to operate and maintain the bike parking facility for its useful life which for purposes of this Agreement is a minimum of five (5) years. The end date shall be December 31 following the fifth year anniversary of the installation. Given a 2011 installation, the end date of the useful life shall be December 31, 2016; a 2012 installation and end date of December 31, 2017; etc. Said operation and maintenance includes, but is not limited to, repair or replacement of the bicycle parking facilities due to graffiti or damage by others. City/County Obligations. Subject to the provisions of this Agreement and in conformance with the NTP federal grant and appropriate provisions of MnDOT Agreement 97553, each participating City/County after approval of eligibility agrees to perform the following activities at their own cost: a. Submit a site plan for each site(s) providing detailed information identified by the NTP Bike Parking Request template provided by TLC. b. Obtain written approval of the bike parking facilities site plan(s) by TLC and MnDOT Office of Cultural Resources and State Aid prior to Minneapolis furnishing said facilities. c. Request bike parking facilities to be furnished through the bid process administered by Minneapolis. The costs to furnish the bike parking facilities will be funded by a Federal grant awarded to Minneapolis. Minneapolis will furnish the bike parking facilities to each City/County upon the following conditions: i. Use its own local resources (staff and funds) to identify, prepare and install one or more sites for the placement of bike parking facilities within its boundaries. Said local resources are not reimbursable by the federal NTP grant funds. ii. Install all bike parking facilities no later than 30 days from receipt of bike parking facilities delivered $•om the vendor. iii. Provide to TLC and Minneapolis proper documentation of the installation of bike parking facilities in accordance with the approved site plan(s). Each City/County will submit to TLC proper written and photo documentation after the bike parking facility has been purchased, delivered and installed. The installation and its financial documentation must be retained at the each participating City/County for a sufficient length of time to allow for proper audit and close out of the Project. 4. Removal of Bike Parking Facilities by City/County. If a City/County elects to move or remove a bike parking facility prior to the end of its useful life, the following procedures shall be followed. A City/County may elect to move or remove the bike parking facility by declaring a greater public purpose or reasons related to protecting the public health, safety and welfare. Said removal will not be granted based on lack of proper operation and maintenance duties required by each City/County. If said move or removal is for temporary purposes related_ to adjacent construction or development purposes defined as less than one year and will be reinstalled at the same location then no further action is needed. If said move or removal will be greater than one year than thirty (3 0) days prior to its removal, the City/County must notify Minneapolis (OR TLC, ATTN: Tony Hull) of its intent to remove the bike parking facility. If the said bike parking facility will be moved to another location, then a relocation request and site plan shall be submitted to Minneapolis. Minneapolis will coordinate with TLC, if the NTP program still exists. Minneapolis shall either approve a new location within the City/County for the bike parking facility or request that the bike parking facility be returned to Minneapolis for installation elsewhere in the Twin Cities eligible NTP area. Minneapolis will respond to the removal notification within the thirty (30) day notification period and notify the participating City/County in writing of its decision. Each City/County will be responsible for the removal and delivery cost of the bike parking facility to Minneapolis, but will not be responsible for repayment of any NTP federal grant due to the removal of the bike parking facility. The above removal provisions will no longer be in effect after the five (5) minimum useful life as described in Section 2e. The political wrangling should pick up after the Easter break. The last couple of weeks, the Council has talked about the impact of tax increases on resi- dents and business owners. Attached are the property tax records of Lauderdale's 9 biggest tax payers. The biggest is Xcel. Thankfully, I don't see them going anywhere anytime soon. They pay about 9.7% of the City's levy. A couple of the apartments are in the mix along with Hamline Autobody, Boyer, and Bolger. All totaled, these 9 businesses will pay $126,250 in city taxes this year. That is about 26.9% of the city's levy. The number is a little skewed as City Gable's tax dollars come to the City as tax increment. When the TIF district ends, the City will receive about $20,000 a year in the general tax pool instead of $85,000 in the TIF Fund. OPTIONS: Let me know if you have any questions. I just wanted to provide some background as this had been talked about.
