Lauderdale City Hall, 1891 Walnut Street Mayor Dains called the meeting to order at 7:31 p.m. and asked Administrator Heck to take the roll. Council members present: Denise Hawkinson, Karen Doherty, and Clay Christensen and Mayor Dains. Also present were staff members Jim Bownik, Assistant to the City Administrator, and Heather Butkowski, Deputy City Clerk. Mayor Dains asked if there were any additions or deletions to the agenda. Council member Christensen moved to approve the agenda. Motion seconded by council member Hawkinson and carried. Mayor Dains asked if there were any additions or corrections to the September 11, 2007, City Council minutes. There being no amendments to the minutes, council member Doherty moved approval. Council member Hawkinson seconded the motion and it carried. Mayor Dains asked if there were any questions on the claims. Council member Hawkinson moved to approve the claims in the amount of $23,103.85. Council member Christensen seconded the motion and it carried. Mayor Dains asked if anyone present wished to address the Council on issues not on the agenda. No residents were present to address the Council. Mayor Dains asked if the Council wished to add or remove items from the consent agenda. Council member Christensen moved approval of the consent agenda consisting of the following: a) approving step increase for Heather Butkowski, Deputy City Clerk, and b) approving the installation of "no parking" signs along the west side of Fulham Street on Saturday, September 29. Heck provided the Council with a brief update on the status of TH280. Heck spoke to Mn/DOT about the stop signs on Roselawn and Walnut and it sounded like Mn/DOT will remove the signs. Heck also said Xcel Energy is doing soil borings in preparation of moving transmission poles. Council member Christensen asked about the directional signs to TH280. He said a few old signs still direct people to Broadway. Council member Hawkinson asked about the yield sign on the ramp accessing south bound TH280. She said vehicles stop on the ramp. Bownik provided an update on the preparations for the annual Halloween Party at City Hall. The Council set the agenda for the next meeting: 1) Inflow and Infiltration Discussion 2) Rental Housing Licenses - 1 - 3) Halloween Party Bob Milligan and Heather Butkowski discussed with the Council the status of the Comprehensive Plan Steering Committee's work. Discussion focused on potential redevelopment along the Larpenteur Avenue corridor. Mr. Milligan stated the committee's discussions over the past several months focused on what type of zoning designations would best fit the desired outcome. He said the vision of the committee is more about service oriented businesses such as tax preparation, financial services, etc. with a residential component. The discussions moved away from destination retail as it did not seem feasible. He also said the first area of consideration is along Larpenteur Avenue from-TH280 to Eustis Street on the south and TH280 to Carl Street on the north. Butkowski and Milligan then walked the Council through the staging plan developed by the steering committee. The Council endorsed the direction the steering committee is taking and thanked them for their work. Heck reviewed the background and history of the Metropolitan Council Environmental Services (MCES) surcharge program. Lauderdale experienced significant excess flow into the sanitary sewer system during two storm events. As a result, MCES assessed the City with a five-year surcharge of just over $108,000. Heck told the Council that staff submitted a plan to MCES outlining the steps and dollars the City will commit over the next two years to reduce or eliminate III. Heck went over the report for 2007 and discussed plans for 2008. He said staff is in the process of revising the sewer ordinance and would like the Council to provide direction on an incentive program to encourage the disconnection of improper drain tile or sump -pump connections and who should be conducting household inspections. Following additional discussion, the consensus of the Council was to develop an incentive program and to seek an outside contractor to conduct the inspections. Heck addressed performance evaluations with the Council. He provided a brief background on the current methodology in staff evaluations and asked if the Council would like to consider an alternative to this process that includes using a personnel committee consisting of two council members and the administrator. It was the consensus of the Council to keep the current evaluation system The Council recessed for five minutes from 8:55 p.m. to 9:00 p.m. Mayor Dains asked council member Christensen to read Resolution 092507-A, A Resolution of Commendation for Council Member Karen Gill -Gerbig. Council member Hawkinson seconded the motion made by council member Christensen. The Council thanked Karen Gi11-Gerbig for her years of service and commitment to the community. Council member Christensen read Resolution 092507-B, A Resolution of Commendation for PCIC Member Michelle Krug. Council member Doherty seconded the motion made by council -2- member Christensen and the Council thanked Ms. Krug for her work and dedication to the City and the community. Ms. Krug was not able to attend the council meeting. There being no further items for consideration, council member Christensen moved to adjourn. Election judges must be appointed by the City Council. Many of these election judges have faithfully perfornied their election judge duties for many years and there are some new residents on the list. Juliane Kvalbein will be the. Head Election Judge again this year. Returning Judges Bowe, Donna Doherty, Karen Gorden, Eleanor James, Ginny Kruger, Regina Kvalbein, Juliane Matheny, Virginia Schmidt, Mae Wisen, Crystal Ruschmeyer, Gloria Sventek, Mary Jane New Judges Craft, Patricia Mangan, Gayle Smith, Marilyn Tanamachi, Jeanne Vereide, Jim Judges must declare a major party affiliation (Republican, Democratic -Farmer -Labor, or In- dependence). In 2007, Lauderdale received $4,378 to help cover expenses related to the City's recycling pro- gram such as administration, promotion, equipment, and collection. The plan calls for the wall to extend from just north of the ramp north to the south edge of the golf course. Roselawn and Walnut would be closed due to the sound wall. (Ord. 33, 5-1-1969) 8-2-1-2: APPLICATION: Any person desiring the installation of a sanitary sewer service connection to serve his property shall make written application to the City Administrator. (Ord. 33, 5-1-1969) 8-2-1-3: DEPOSITS, FEES AND CHARGES: 1. M.S.A. § 412.221, subds. 6 and 31. LA605 A. Deposit: 8-2 (2) 1. Initial Deposit: A deposit as determined from time to time by the City Council shall be made by the applicant at the time of application, to be applied to the cost of installing such service connection from the lateral sewer line to the property line; provided that if application is made for the construction of such service connection after November 1 or before April 15 of any year, an additional deposit as determined from time to time by the City Council shall be made. 2. Additional Cost: The applicant shall agree in writing that in the event that such deposit or deposits are insufficient to pay the actual cost of construction of such service connection, he will make payment of the balance of the construction cost to the City within thirty (30) days after written demand therefore by the City Administrator. 3. Nonpayment Of Additional Costs: In the event that the amount so demanded is not paid as hereinbefore provided, the Council may levy a special assessment for said amount against the property served by said connection, together with interest thereon from the date of completion of said connection (Ord. 33, 5-1-1969; 1996 Code) B. Connection Fees: 1. Required When No Special Assessment Levied: No person connecting any drainage, waste disposal, or plumbing facilities with a City sewer service connection from property served by such service connection shall make such connection without first paying the connection fee as hereinafter set forth; provided, that this Section shall be applicable only to those cases where such service connection has been installed by the City, paid for from City funds, and where no special assessment has been levied against the property to be served for the cost of installing such service connection. 2. Sewer Service Availability Charge: 1. Imposition Of Charge: There is imposed on each new building constructed within the City and upon each building hereafter LA605 8-2 (3) connected to the sewer system of the City a sewer service availability charge. This charge is imposed to assist the City in meeting its obligations to the Metropolitan Sewer Beard Council Environmental Services, hereafter referred to as MCES, pursuant to Minnesota Statutes, chapter 4q-34;-473. All funds collected under this subsection shall be used by the City for that purpose. 2. Amount Of Charge: The amount of the sewer service availability charge shall be fixed from time to time by resolution of the City Council. The charge shall be equal to the sewer service availability charge established by the Metrepelitan SewerBeard MCES and shall be used as a basis for payments made to the Bend MCES by the City. 3. Administration; Building Permits: An applicant for a permit for building construction or for the connection of an existing building to the City's sewer system shall pay the sewer service availability charge to the City together with other fees required for the issuance of any such permit. The Building Inspector shall not issue a building permit for any new building to be connected to the sanitary sewer system or for any existing building to be connected to such system unless the charge is paid. (Ord. 60, 1-9-1973) 8-2-1-4: CRITERIA FOR APPROVAL: A. Lateral Sewer Line: No such application for the installation of a service connection shall be granted unless the property being served abuts upon a street or alley in which a lateral sewer line has been laid. B. Separate Service Connection: Unless special permission in writing from the City Council is first obtained, every lot, piece or parcel of land served by the City sanitary sewer system shall have a separate service connection. C. Special Assessments: No application for the installation of.a service connection to serve any property shall be made by the owner thereof unless all sanitary sewer special assessments upon such property then due and payable have been paid. (Ord. 33, 5-1-1969) 8-2-1-5: GRANT OF APPLICATION: When the applicant has complied with the terms of this Section 8-2-1,.the application may be granted by the City Administrator, who may thereupon order the installation of the service connection. (Ord. 32, 12-21-1971) 8-2-2-2: CONNECTION REQUIRED: Notwithstanding any other provision in this Section 8-2-2, the use of all private sewage disposal facilities shall be discontinued on or before July 1, 1966, and thereafter all sanitary sewage facilities in use in this City on any residential, commercial, manufacturing or industrial property shall be connected to the City sanitary sewer system. (Ord. 32, 12-21-1971) 8-2-2-3: PERMIT REQUIRED: No person shall connect any private sanitary sewage disposal facilities with the sanitary sewer system of the City, or discharge any sanitary sewage into the City sanitary sewer system without first obtaining a permit therefore. (Ord. 32, 12-21-1971) 8-2-2-4: IMPLIED CONSENT: Every customer or person receiving sanitary sewage disposal service through the City sanitary sewage system shall be deemed to consent to all the rules, regulations and rates contained in the ordinances of the City and to all modifications thereof and all new rules, regulations or rates adopted by the City. (Ord. 32, 12-21-1971) 8-2-2-5: APPLICATION FOR SERVICE; DEPOSIT: Before any sanitary sewage is discharged into the City system from any premises, the owner or his authorized agent shall apply to the City Administrator for sanitary sewage service and shall Comment [hb2]: unless � special permission from city Engineer? If such payment has already been paid as a water deposit, no sewer rental deposit is required, but application for sewage disposal service shall nevertheless be made. (Ord. 32, 12-21-1971) 8-2-2-6: SEWER ACCOUNTS: Sewer accounts shall be carried in the name of the owner of the property, or in the name of the person designated by the owner in writing. Sewer service rates, charges or rentals shall be a charge against the owner, lessee or occupant of the premises, or against any or all of them; and any such claim for unpaid rates, charges or rentals which have been properly billed to the occupant of the premises may be collected in a civil action in any court of competent jurisdiction, or, in the discretion of the City Council, may be certified to the County Auditor with the taxes against such property serviced and shall be collected as other taxes are collected. Payments of delinquent sewer service rates, charges or rentals shall be credited to the same fund as current collections for that purpose are, deducting therefrom any cost of collection accruing to the City. (Ord. 32, 12-21-1971) 8-2-2-7: SEWER SERVICE CHARGES: A. Charges Established By Resolution: For the purpose of providing funds for the sewer system of the City and for the providing of sewage disposal service, the Council shall, from time to time, establish the sewer service charges which are to be paid. Any such action taken by the Council shall be by resolution. B. Based On Water Consumed: Such resolution may provide for basing the service charge upon the volume of water consumed upon the premises served by the City sanitary sewer system. C. Discount For Prompt Payment: Such service charges may include a discount for prompt payment. D. Water And Sewer Statements: Water and sewer statements may be submitted on a single bill in those cases where the premises are served by both the Cly regional water authority and City sewer systems. LA605 8-2 (6) 8-2-2-8: COMMERCIAL, MANUFACTURING AND INDUSTRIAL DISCHARGE: No.sanitary sewage consisting of liquid wastes from any commercial, manufacturing or industrial process shall be discharged into the sanitary system of the City without first securing the consent and approval of the Citi- Cepil. (Gr -d. 32, 12 21 971+ Metropolitan Council Environmental Services and other agencies with jurisdiction. 8-2-2-9: DISCHARGE OF SURFACE WATER PROHIBITED: Except as otherwise expressly authorized in this subdivision, no water from any roof, surface, sump pump, footing tile or drains, swimming pool, any other natural precipitation or groundwater, cooling water, or industrial process shall be discharged into the sanitary sewer system. Dwellings and other buildings and structures which require, because of the infiltration of water into basements, crawl spaces and the like, a sump pump discharge system shall have a permanently installed discharge line which shall not at any time discharge water into the sanitary sewer system. A permanent installation shall be one which provides for year-round discharge capability to either the outside of the dwelling, building or structure, or is connected to a City storm sewer or draintile. It shall consist of a rigid discharge line without valving or quick connections for altering the path of discharge or a system otherwise approved by the Public Works Coordinator or City Engineer. Any person, firm, or corporation having a roof, surface, sump pump, footing tile or drains, swimming pool, cooling water or unpolluted industrial process water now connected and/or discharging into the sanitary sewer system shall disconnect or remove the same. Any disconnects or openings in the sanitary sewer system shall be closed or repaired in an effective, workmanlike manner with the proper permits and inspected by a representative or agent of the City. If a City draintile or storm sewer system is available to the 2roperty, these discharges maybe connected to it. If a public system is not utilized, these discharges must be accommodated on the owner's property. Any property owner or consumer applying for a building permit or plumbing permit (excluding permits for water heaters), variance, minor subdivision, or other action from the City, shall agree to an inspection of the structure's sump pump, footing or foundation drain discharge for compliance with this code. Variances, minor subdivision, and other requested actions shall not be forwarded LA605 8-2 (7) discharges are in full compliance with this section of City Code. 8-2-2-10: INSPECTION: Every person owning improved real estate that discharges into the City's sanitary sewer system shall allow an employee of the City or their designated representative to inspect the buildings to confirm that there is no sump pump or other prohibited discharge into the sanitary sewer system. Any person refusing to allow their property to be inspected by a City employee(s) or their designated representatives shall immediately become subject to the surcharge hereinafter provided for. Charges will accrue until the property is inspected and found to be without an illegal discharge by a representative or agent of the City. Property owners that refuse an inspection are not eligible for financial assistance for corrective action as provided for below. New Home Inspections: All new homes shall be required to have their sump pump system inspected before a certificate of occupancy is issued. Financial Assistance for Corrective Action: The owner of an �ropertM that has an existing illegal connection, who submits to an inspection by a city agent or representative within 14 days of initial notice of inspection, may apply once for City financial assistance based upon the following incentive system: $300 for voluntary compliance in 2008; Iand� $150 for voluntary compliance in 2009. Financial Assistance Process: to qualify a resident must: 1. Request a City inspector verify the illegal connection before beginning corrective action; 2. Correct the illegal connection per the provisions of this ordinance, which includes securing all necessary building or plumbing ermits; ----------------------------------------------------------------------------------------- Comment [hb4]: DIinnetonka allows residents that incur` big expenses to assess the cost ;to their property. It is an interesting idea as someone may not be able to secure a bank loan to fix a', $31000 illegal sanitary sewer connection. Thoughts? I'can see residents asking why the Cityr;is giving,a grant but then 'asks for permit fees. LA605 8-2 (8) 3. Request a second inspection with the City representative or agent to confirm the disconnection has been satisfactorily completed; and 4. Submit receipt (s) for labor and/or materials within 30 days of final inspection. Upon verification of the corrective action and costs, the City will remit reimbursement for qualifying receipts to the propert owner after City Council approval. This financial assistance is limited to a one time reimbursement per dwelling, building or structure. The City will reimburse for labor, from a licensed plumber only, and materials excluding sump pumps. Penalty: A surcharge of one hundred dollars ($100.00) per month is hereby imposed and added to every sewer billing to residential property owners who are not in compliance with this Chapter. The surcharge shall be added every quarter until the property is in compliance with this Chapter. A surcharge of three hundred dollars ($300.00) per month is hereby imposed and added to every sewer billing to commercial or industrial property owners who are not in compliance with this Chapter. The surcharge shall be added every quarter until the property is in compliance with this l`hantor 8-2-2-11: DISCONTINUANCE OF SERVICE: The City reserves the right to discontinue service of the sanitary sewer system without notice when the same is necessary in the repair of the system or any part thereof, or for nonpayment of bills-, or for any cause when required by the City of Minneapolis or the Minneapolis -Saint Paul Sanitary District. (Ord. 32, 12-21-1971) 8-2-2-12: CONNECTION PRIOR TO APPLICATION: In any case where private sanitary sewage facilities are connected with the sanitary sewer system of the City without first making application for and receiving all necessary permits therefore, the City Council may elect to charge for sewage disposal service to the premises so connected, from the time that a sanitary sewer main was first available for use by such premises or from the time that a structure which could use such sewer main was first constructed on such premises, whichever is later. Any such charges may include charges for delinquency in paying for sewage disposal service when due. E. Establishment Of Tax Lien: 1. Certification To County Auditor: As provided by Minnesota Statutes, section 444.075, subdivision 3; it is hereby approved, adopted and established that if payment of the strength charge established by subsection B hereof is not paid before the sixtieth day next succeeding the date of billing thereof to the industrial user by or on behalf of the City, said delinquent sewer strength charge, plus accrued interest established pursuant to subsection D hereof, shall be deemed to be a charge against the owner, lessee and occupant of the property served, and the City or its agent shall certify such unpaid delinquent balance to the County Auditor with taxes against the property served for collection as other taxes are collected. 2. Additional Remedies: Provided, however, that such certification shall not preclude the City or its agent from recovery of such delinquent sewer strength charge and interest thereon under any other available remedy. F. Severability: In the event any provision of this Section shall be held invalid or unenforceable by any court of competent Jurisdiction, such holding shall not invalidate or render unenforceable any other provision hereof.
