The City Council is meeting as a legislative body to conduct the business of the City according to ROBERT'S RULES OF ORDER AND THE STANDING RULES OF ORDER AND BUSINESS OF THE CITY COUNCIL. Unless so ordered by the Mayor, citizen participation is limited to the times indicated and always within the prescribed rules of conduct for public input at meetings. 1. CALL MEETING TO ORDER AT 7:00 P. M. 2. RECESS MEETING FOR THE PURPOSE OF CONDUCTING INTERVIEWS WITH CANDIDATES FOR THE VACANT COUNCIL SEAT. 3. OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE COUNCIL ON ITEMS NOT ON THE AGENDA Any member of the public may speak at this time on any item NOT on the agenda. In consideration of the public attending the meeting for specific items on the agenda, this portion of the meeting will be limited to fifteen (15) minutes. Individuals are requested to limit their comments to four (4) minutes or less. If the majority of the Council determines that additional time on a specific issue is warranted, then discussion on that issue shall be continued under Additional Items at the end of the agenda. Before addressing the City Council, members of the public are asked to step up to the microphone, give their name, address and state the subject to be discussed. All remarks shall be addressed to the Council as a whole and not to any member thereof. No person other than members of the Council and the person having the floor shall be permitted to enter any discussion without permission of the presiding officer. ADJOURNMENT \\Rvfsl\Lauderdale\CityAdmin\Agendas\2005Uuly 12.doe Lauderdale City Council Meeting Minutes June 28, 2005 The Mayor called the meeting to order at 7:02 p.m. 2. The Mayor requested the Administrator to call the roll. Councilmember present: Christensen, Gill -Gerbig, Giannetti, and Mayor Dains Staff Present: Administrator Bakken -Heck 3. INTERVIEW CANDIDATES FOR COUNCIL VACANCY The Mayor stated the Council is conducting interviews with two candidates for the council seat left open by Jeff McCloskey who resigned his seat last month because he moved to New Brighton. The Mayor stated two residents submitted letters of interest and the Council will ask the candidates questions. Following the interview of both candidates, Ms. Karen Doherty and Ms. Denise Hawkinson, the Council discussed the merits and qualifications of the two candidates. Council member Christensen moved to appoint Karen Doherty to fill out the remaining term, second by Council member Gill -Gerbig. Motion carried on a roll -call vote with all voting yes. Administrator Bakken -Heck administered the Oath of Office to Karen Doherty. 4. APPROVAL OF AGENDA Motion by Giannetti, second by Gill -Gerbig to approve the Agenda and carrired. 5. APPROVALS 1. Minutes: Christensen moved the approval of the minutes with the addition of consent items approved second by Gill -Gerbig and carried. 2. Claims: Giannetti moved approval of the claims totaling $53,456.64, second by Gill -Gerbig and carried. 6. CONSENT City Council Minutes June 28, 2005 Page 2 Councilmember Gill -Gerbig moved and Christensen seconded the consent items authorizing the administrators attendance at the 2005 ICMA National Conference held in Minneapolis September 24 -28 at a cost of $440 plus usual and customary expenses and the purchase of office furniture for the Administrators office at a cost not to exceed $1,200. Motion carried. 7. DISCUSSION ITEM A. Driveway and Parking ordinances': the Administrator introduced the item and described the few changes suggested by the Council at the meeting on June 14, 2005. Council member Christensen moved to adopt the Driveway Requirements ordinance, Chapter 10, Section 9, and Parking Restrictions, Chapter 1, Section 6 as amended. Motion second by Council member Gill -Gerbig and carried on a roll -call vote with council members Christensen, Giannetti, Gill -Gerbig, and Mayor Dains voting yes, Council member Doherty abstaining as she is new and is unfamiliar with the issue. 8. WORK SESSION Administrator Bakken -Heck will attempt to arrange visits by Commissioner Parker, the St. Anthony Police Department and Elhers and Associates for next meeting. Rental Property: several residents were present to discuss with the council the issues experienced in the neighborhood from persons in a particular rental building. Kari Goodmanson stated she owned a duplex across the street and stated there is plenty of activity at the building in the form of police calls, noise, and other undesirable behavior. Michelle Upham who lives a few houses down from the property in question stated last year one of the tenants chased her into her home while he was naked. This same person attempted to enter her home. She also described loud fights, drinking, and loud music. She stated there are others on in the area who are considering selling due to the behavior of the tenants in the building. All are asking the Council to find a way to address this issue by making the owner of the building more responsible. City Council Minutes June 28, 2005 Page 3 Mayor Dains asked the group if they would be willing to meet with representatives of the police department to discuss what can be done and improve communications between the residents, the city, and the police department. The mayor also suggested getting the landlord out to meet with the council and neighbors about the issue. Council member Gill -Gerbig discussed the potential for creating an ordinance on the regulation of rental property similar to what other cities in the area have. Following additional discussion, the neighborhood meeting was scheduled for Thursday, July 7, 2005 at 7:00 p.m. in the Social room at City Hall. The Administrator was directed to make arrangements and get the notice out to the area home owners. Camp/recreational fires : the mayor indicated that he and the former Administrator discussed this issue and did not arrive at any conclusion. He did state that at times there is an odor coming from back yard fires that is disturbing. Administrator Bakken -Heck stated several cities have regulations regarding backyard fires. The regulations concern when a resident can burn, what they can burn, the location of the fire pit, and restricts burning under certain conditions such as burning bans and air quality warnings. He stated he is drafting an ordinance amendment that includes these issues. Following further discussion, the administrator was directed to continue to work on the ordinance amendments and bring it back to the council at the next meeting. There being no further business to discuss, the meeting adjourned at 8:40 p.m. on a motion by Christensen and a second by Gill -Gerbig. His final day in the office was July 8, 2005. We plan to post the position with an initial application deadline of July, 22. OPTIONS: ATTACHMENTS: CITY OF LAUDERDALE COUNCIL ACTION FORM MEETING DATE: July 12, 2003 ITEM: Discussion — Radio Tower DESCRIPTION: representatives from Nextel are considering installing a radio tower on the NewMech property near the existing tower. This is an industrial zoned area and towers are permitted as a conditional use. The existing tower is not suitable nor does it have the proper space available to meet Nextel's needs. Representatives are here to provide a description of what they want to do and answer questions the Council may have regarding this proposed project. OPTIONS: this is discussion at this time. If Nextel desires to move forward, an application for Conditional Use is required. At a previous work session, this issue was discussed in general terms. A draft ordinance is attached regarding this issue. Law Enforcement reviewed it and commented. Further, the ordinance was sent to the civil attorney and the Falcon Heights Fire chief. We are awaiting comments from these parties. OPTIONS: Provide staff with further direction.
