ROBERT'S RULES OF ORDER AND THE STANDING RULES OF ORDER AND
BUSINESS OF THE CITY COUNCIL. Unless so ordered by the Mayor, citizen participation is
limited to the times indicated and always within the prescribed rules of conduct for public input at

consideration of the public attending the meeting for specific items on the agenda, this portion of
the meeting will be limited to fifteen (15) minutes. Individuals are requested to limit their

time on a specific issue is warranted, then discussion on that issue shall be continued under

APPROVAL
A. Approval of Minutes. Motion by Christensen, second by Giannetti to
approve the minutes of the April 13, 2004 City Council meeting. Motion carried
unanimously.
B. Approval of Claims totaling $44,800.38. Motion by Giannetti, second by
McCloskey to approve the claims totaling $44,800.38. Motion carried
unanimously.
C. Approval of Pay Request #8 for the 2003 Street and Utility Improvements
for S.M. Hentges and Sons in the amount of $27,184.16. Motion by McCloskey,
second by Christensen to approve Pay Request #8 for the 2003 Street and Utility
Improvements in the amount of $27,184.16. Motion carried unanimously.

ACTION
A. Consideration of a front yard fence permit at 1743 Pleasant Street. City
Administrator Getschow stated that Michael and Melissa Passeretti, 1743 Pleasant
Street, are requesting City Council approval to construct a fence in the front
setback area at their residence. According to Lauderdale's City Code, City
Council approval is required for the portion of the fence that is proposed for the
front setback area.
A new white picket fence would be constructed ten feet from the front property
line at a height of 2 feet, 10 inches. The fence would then follow along the side
property lines to the house. Since the house is situated towards the back of the
lot by the alley, almost any fence placed on the property would be a front -yard
fence.
Council member Christensen stated that he had visited with the homeowner and
discussed the property to the south (23 11 Ione), which has an encroaching deck
that would be above the fence.
Mayor Dains and Administrator Getschow provided some history on the property
which included the fact that both 1743 Pleasant and 2311 Ione were once one
property with two single-family homes.
Motion by Christensen, second by McCloskey to approve that portion of fence
construction proposed to be located in the front setback area at 1743 Pleasant
Street per the site plan. Roll: Yes: all. Motion carried.
B. Consideration of a front yard fence permit at 1766 Malvern Street.
Getschow stated that Paul and Anna Hallen, 1766 Malvern Street, are also
requesting City Council approval to construct a fence in the front setback area at
their residence.
A new cedar wood fence would be constructed one foot from the front property
line. The height of the fence is proposed to be 4 feet tall across the front of the
property, as well as the western 18 feet along the side property line. The
remaining portions of the fence are proposed to be at a height of 6 feet.

Similar to 1743 Pleasant Street, this house is also situated towards the back of the
lot by the alley.
Council member Christensen asked if the fence was to be a privacy fence. Due to
the fact that the yard is quite a bit higher than the street, even a short privacy
fence in the front yard could block out the entire yard.
Administrator Getschow stated that he is unsure if the wood fence was to be
constructed as a privacy fence, but the Council could condition their motion to not
allow a privacy fence in the front yard.
The Council agreed that there should be some discussion during the draft zoning
ordinance discussion regarding putting in place some guidelines for approving
front yard fences.
Motion by Giannetti, second by McCloskey to approve that portion of fence
construction proposed to be located in the front setback area at 1766 Malvern
Street per the site plan. Roll: Yes: all. Motion carried.
C. Approval of the I sr Quarter 2004 Financial and Investment Report.
Motion by McCloskey, second by Christensen to approve the 2004 1" Quarter
Financial and Investment Report. Roll: Yes: all. Motion carried.
D. Change the start time of the May 25, 2004 City Council meeting.
Getschow stated that a work session with Ehlers and Associates regarding the
redevelopment of Larpenteur Avenue was to be set up for the May 25 meeting.
Based upon other commitments, Ehlers officials could only meet with the City
Council on the evening of May 25 between 5:00 p.m. and 7:00 p.m.
Motion by McCloskey, second by Giannetti to approve moving the start time of
the May 25, 2004 City Council meeting from 7:00 p.m. to 5:00 p.m. to conduct a
City Council work session. Roll: Yes: all. Motion carried.
