<br />. <br /> <br />RESOLUTION NO. 94-EDA17 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION APPROVING CONSTRUCTION PLANS FOR SILVER <br />LAKE POINTE PROJECT <br /> <br />WHEREAS, the Board of Commissioners (the "Board") of the <br />Mounds View Economic Development Authority (the "Authority") entered <br />into the Development Assistance agreement with Heartland - Mounds <br />View Common Bond, LLC (the "Developer") approved on May 23, 1994 <br />per Resolution No. 94-EDA 7, and <br /> <br />WHEREAS, the Silver Lake Pointe Project (the "Project") consists <br />of an 83-unit apartment community, 3-story elevatored building, located <br />on a 2.7 acre parcel on County Road I and Mounds View Drive just south <br />of Highway 10 in the City, and <br /> <br />. <br /> <br />WHEREAS, under Section 3.3, Construction Plans, "the Authority <br />shall approve the Construction Plans if it determines that they conform to <br />the applicable provisions of this Agreement; provided, however, that any <br />such approval of the Construction Plans pursuant to this Section 3.3 shall <br />constitute approval for the purposes of this Agreement only and shall not <br />be deemed to constitute approval or waiver by the Authority with respect <br />to any building, zoning or other ordinance or regulation, and shall not be <br />deemed to be sufficient plans to serve as the basis for the issuance of a <br />building permit if the Construction Plan are not as detailed or complete as <br />the plan otherwise required for the issuance of a building permit. Such <br />Construction Plans must be rejected in writing by the Authority within 10 <br />working days of submission or shall be deemed to have been approved by <br />the Authority.", and <br /> <br />WHEREAS, the Developer submitted Construction Plans to the <br />City of Mounds View Building and Engineering Department on October <br />31, 1994, and <br /> <br />WHEREAS, the Authority has reviewed the Construction Plans for <br />the Project, and <br /> <br />WHEREAS, the Construction Plans conform to the applicable <br />provisions of the Development Assistance Agreement by and between the <br />Authority and the Developer. <br /> <br />. <br />
