<br /> <br />,'0' .. <br /> <br />1..'..:.10"" <br /> <br />!~..., <br />.. ., <br /> <br />ORDINANCE NO. 301, <br /> <br />..~ <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />, I '\' ~:, <br /> <br />AN ORDINANCE PROHIBITING ~EVELOPMENT Of: <br />PRIVATE WETLANDS ON AN INTERIM Bll,SISc <br /> <br />Th~ Connell 0f the Cit~' 0f M0'.l~ds 'lic':.' d~c~ ~~r-:::!:~/ ~=G~i::: <br /> <br />1.01 Purpose and Interpr~tation <br /> <br />(1) The City of Mounds View is presently undertaking. an <br />update of the Comprehensive Plan for the City including wetlands <br />control. <br /> <br />The City has received n draft Wetlands Ordinance entitled, <br />ItChapter 48, Wetlandslt, a wetlands inventory entitled, ItWet1ands <br />Resources or the City of Mounds View" and a Phosphorus Budget <br />showing the need for further consideration of the control of <br />wetlands in the City of Mounds View. <br /> <br />The City anticipates land use applications concerning: land '~. <br />development \.,;rhich could have a significant impact.on.the.City"s.' ,.:"": <br />Long Range Plan with regard to zoning and wetland pr~serv~tiori;. ": <br />,: - The City Council has det.ermined that a wetlands management study <br />is desii: ~ble in crder to evaluate the development and control of <br />private wetlands. <br /> <br />(2) Dev210pment in wetlands during this interim period <br />could be detrirn<:!ntal and contrary to the \.;etlands management.. <br />study and ordinances now being considered. <br /> <br />1.02 Restrictions on the Development of Defined Wetlands <br /> <br />Pursuant to M. S, 462.355, Subd. 4, and to protect the '. <br />planning procesa and the health, safety and w~lfare ~f the citizens" <br />of the City. no rezoning, conditional or special use permits, <br />variances, plats, or subdivisions of private ldnds, or other <br />authority for n~~ or additional building development in the areas <br />described in 2.01 shall be permitted during the interim period. <br /> <br />2.01 Restricted Area of Interim Moratorium <br /> <br />Those portions of the City of Mounds View as shown on <br />exhibit A attached hereto and incorporated by reference in this <br />ordinance are hereby defined as the wetlands controlled herein. <br /> <br />2.02 Duration of Interim Moratorium <br /> <br />This ordinance shall be in.forcefor one year from its <br />.effective date, unless renewed or repe~l~d._~' <br /> <br />". . <br />'. ...... ...'- <br />
