<br />. <br /> <br />. <br /> <br />. <br /> <br />I <br /> <br />CHAPTER 49 <br /> <br />FLOOD PLAIN ZONING ORDINANCE <br /> <br />49. 01. STATUTORY AUTHORI ZATION. FINDINGS OF FACT AND PURPOSE. <br /> <br />Subdivision 1. Statutory Authorization. The Legislature of <br />the State of Minnesota has, in Minnesota Statutes, Chapter 104, and <br />in the Mounds View Municipal Code, Chapter 40, delegated the <br />responsibility to local governmental units to adopt regulations <br />designed to minimize flood losses. Therefore, the City Council of <br />Mounds View, Minnesota, does ordain as follows: <br /> <br />Subdivision 2. Findinqs of Fact. <br /> <br />(a) The flood hazard areas of Mounds View, Minnesota, are <br />subject to periodic inundation which results in potential <br />loss of life, loss of property, heal th and safety <br />hazards, disruption of commerce and governmental <br />services, extraordinary public expenditures for flood <br />protection and relief, and impairment of the tax base, <br />all of which adversely affect the public health, safety, <br />and general welfare. <br /> <br />(b) Methods Used to Analyze Flood Hazards. This Ordinance is <br />based upon a reasonable method of analyzing flood hazards <br />which is consistent with the standards established by the <br />Minnesota Department of Natural Resources. <br /> <br />Subdivision 3. Statement of Purpose. It is the purpose of <br />this Ordinance to promote the public health, safety, and general <br />welfare and to minimize those losses described in Subdivision 2, <br />section (a), by provisions contained herein. <br /> <br />49.02. GENERAL PROVISIONS. <br /> <br />Subdivision 1. Lands to Which Chapter Applies. This Chapter <br />shall apply to all lands within the jurisdiction of Mounds View <br />shown on the Flood Plan Zoning Map as being located within the 100- <br />year flood boundary. These lands are delineated as flood insurance <br />zones A-1, A-2, A-3, A-4, A-6, A-7 or A-H. <br /> <br />Subdivision 2. Establishment of Flood Plain Zoninq Map. The <br />Flood Plain Zoning Map together with all materials attached thereto <br />is hereby adopted by reference and declared to be a part of this <br />ordinance. The attached material shall include the Flood Insurance <br />Study for the City of Mounds View prepared by the Federal Insurance <br />Administration dated March 3, 1983, and the Flood Boundary and <br />Floodway Maps and Flood Insurance Rate Maps therein. The Official <br />zoning Map shall be on file in the office of the Clerk- <br />Administrator. <br /> <br />Subdivision 3. Requlatorv Flood Protection Elevation. The <br />Regulatory Flood Protection Elevation shall be an elevation no <br />lower than one foot above the elevation of the regional flood. <br /> <br />Subdivision 4.
