<br />. <br /> <br />. <br /> <br />. <br /> <br />ORDINANCE NO. 533 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />AN ORDINANCE ESTABLISHING A MORATORIUM ON NEW <br />OR USED CAR LOTS AND MOTOR VEHICLE SALES <br />BUSINESSES WITHIN THE CITY OF MOUNDS VIEW <br /> <br />The Council of the City of Mounds View ,does hereby ordain: <br /> <br />SECTION I. PURPOSE At the direction of the City Council, the <br />Mounds View Planning Commission is in the process of reviewing the <br />requirements for establishment of new or used car lots and motor <br />vehicle sales businesses within the city. The Planning Commission <br />has reviewed Chapters 40, 59 and 109 of the City Code and has <br />determined that there is a need for further review and possible <br />amendment of the existing regulations pertaining to the operation <br />of such businesses within the city. The Planning commission <br />recognizes that groups that have been formed as a part of the FOCUS <br />2000 project are studying issues that might affect the regulation <br />of such businesses. The findings of these study groups might <br />provide direction for both the Planning commission and the City <br />council on issues of land use wi thin the city. The Planning <br />commission wishes to incorporate those findings in their review of <br />this subject. The Planning commission is therefore recommending <br />that a moratorium be placed on the creation of any additional new <br />or used car lots and motor vehicle sales businesses wi thin the <br />city. Minnesota Statutes, Section 462.355, subdivision 4, permits <br />the adoption of an interim ordinance for a period not to exceed one <br />year, which may be extended if the City council deems it <br />appropriate, for a total additional period of 18 months. <br /> <br />SECTION II. MORATORIUM A moratorium on the development of new <br />or used car lots and motor vehicle sales businesses is established. <br />No license, conditional use permit or building permit may be issued <br />for such uses during the moratorium period no~ may any rezoning, <br />platting or replatting of land be granted by the City for such uses <br />during the moratorium period. This moratorium does not affect the <br />continuance or expansion of currently licensed new or used car lots <br />or motor vehicle sales businesses within the city. <br /> <br />SECTION III. EXPIRATION The moratorium shall expire on February <br />10, 1995 or such earlier date as may be further adopted by <br />resolution of the city Council. The moratorium may be extended for <br />a reasonable period of time that may be necessary to complete the <br />study and adoption of any necessary amendments to the City Code, <br />provided that any such extension shall not exceed an additional 18- <br />month period. <br />
