SP-074-99 <br />THE COUNCIL OF MOUNDS VIEW ORDAINS: <br />SE:CTION 1. Title 1100, Chapter 1104 of the Mounds View Municipal Code pertain- <br />ing to general zoning provisions iihall be amended by the addition of the italicized a,?d <br />double-underlined language and. the deletion of the 6lri8k8R tlHe\jsll language In <br />Section 1104.01, Subdivision 4 to read as follows: <br />Subd. 4. Minimum Setbacks for Accessory Buildings, Driveways and Parking Areas: <br />a. Accessory Buildings (detached from a principal building): <br />(Ord. 590, 11-25-96) <br />(1)R-1, R-2, R-3, R-4, R-5 and R-O: <br />(a) front: no accessory building shall be located between the front of the <br />principal building and the front lot line. (Ord. 590, 11-25-96) <br />(b), side: five feet (5') except the minimum setback shall be thirty feet (30') <br />from any lot line-abutting a pUblic street. Driveways: <br />(1) Driveways shall have a minimum setback of five feet (5') from any lo~ <br />line, except as permitted in Section 1104.01, Subd. 4b ~ and ~ <br />- 1121.15, Subd. 2 of this Title. Driveways shall be permitted to cross a <br />required setback aresin order toestablish access between ,the lot and a <br />public street. Where a driveway would encroach int~ an easement, the . <br />property owner shall obtain an encroachment permit If reqUired by the City <br />prior to construction of the driveway. Drive aisles and driveways which are <br />within the boundaries of a parking area shall conform to the setbacks <br />required for parking areas. Title 1100, Chapter 1107 of the Mounds View Municipal Code pertain- <br />ing to zero lot line subdivisions shall be amended by the addition of the italicized and <br />double-underlined language and the dele.lion of the Sln81(eR tl:lr81ls1:1 language In <br />Section 1107.07, Subdivision 3 to read as foilows: <br />0'" Subd 3. Specific ReqUirements for Resulting Dwelling Units: _ <br />a. Area Requirements: Six thousand two hundred fifty (6,250) square feet. <br />b. Lot Width: Fifty feet (50') per dwelling unit. <br />c. Setback Requirements: <br />:"(1) Front Yard: Thirty feet (30'). <br />(2) Rear Yard: Thirty feet (30'). <br />(3) Side Yard (where applicable): <br />(a) Ten feet (10'). <br />(b) Thirty feet (30') on street side of corner lot. . , .. <br />d. Drivewav Widths: The width of the drtveway servlcmg one dwellmg umt <br />shall not exceed the width of that dwelling unit's garage unless garages <br />are situated side-by-side then not to exceed the combined width of the <br />garages. provided that the affected prooerty owners have filed ~ right of <br />wav and maintenance agreement with Ramsev Countv. accordma to the <br />provisions of Section 1121. 15. Subd 2 of this Title pertaining to ioint <br />driveways. <br />e. Curb Cut Width: The width of a curb cut servicing one dwelling unit shall <br />not exceed twenty feet (20'). In the event of a common or ioint driveway <br />servicing both units. the width of the curb cut shall not exceedthirtv-six <br />feet (36'). <br />SECTION 3. Title 1100, Chapter 1121 of the Mounds View Municipal Code pertain- <br />ing to olfStreet parking requirements shall be amended by the addition of the i1a1i:. <br />cized and Gouble-underlined language and the deletion of the ~tn8h9R tt;lFellsll lan- <br />guage in Se.ction 1121.09, to read as follows: . <br />1121.09: STALL, AISLE AND DRIVEWAY DESIGN: <br />S\lbd. 1. Dimensions: <br />.it. Parking Space Size: Each parking space shall not be less than nine feet <br />(9') wide and eighteen feet (18') in length exclusive of access ~isles, and <br />each space shall be served adequately by access aisles. <br />Soaces desianed as curbside parallel oarking shall be twen(v-two feet <br />l22.') in length.' . <br />Q. Within Structures: The off-street parking requirements may be <br />furnished by providing a space so designed within the principal building <br />or one attached thereto; however, unless provisions are made, no <br />building permit shall be issued to convert said space into a dwelling unit <br />or living area until other adequate provisions are made to comply. with the <br />required off -street parking provisions of this Title. <br />Subd. 3. Circulation: Except in the case of single-family, two-family and <br />townhouse dwellings, parking areas shall be designed so that circulation <br />between parking bays or aisles occurs within the designated parking lot <br />and does not depend upon a public street or alley. Except in the case of <br />single-family, two-family and townhouse dwellings, parking area design <br />which requires backing into the pUblic street is prohibited. <br />Subd. 4. Lighting: Any lighting used <br />to illuminate an off-street parking area <br />shall be so arranged so to reflect the <br />light away from adjoining property, <br />abutting residential uses .and publiC <br />rights' of way and be In compliance <br />with Section 1103.09 of this Title.. <br />Subd. 10. Signs: No sign shall be so <br />located as to restrict the sight lines <br />and orderly operation and traffic move- <br />ment within any parking lot. All signing' <br />must conform to the Mounds View <br />Sign Code. 2 . <br />Subd. 11.
