<br />515.01: FINDINGS, PURPOSE AND
<br />INTENT: The purpose of this section is to
<br />regulate the business of tattOOing, body
<br />piercing, body branding, body scarring or
<br />body painting in order to protect the health
<br />and welfare of the general public.. The
<br />City Council finds that the experience of
<br />other cities indicates that there is a con-
<br />nectien between tattooing and hepatitis
<br />and other health problems. The City
<br />Council findS that stringent regulations
<br />governing tattooing can m.inimize the
<br />hepatitis and disease risk and therefore
<br />protect the general health and welfare of
<br />the community.
<br />515.02: DEFINITIONS: The following
<br />definitions apply in this Chapter of thiS
<br />. Code. References hereafter to "sections"
<br />are, unless etherwise specified, refer-
<br />ences io sections in this Chapter. Defined
<br />terms remain defined terms whether or not
<br />capitalized.
<br />"Bcdy piercing" means any method of
<br />puncturing the skin of a persen by the aid
<br />of needles or other instrume'nt designed or
<br />used to puncture the skin for the purpo,se
<br />of inserting jewelry or other objects in or
<br />through the human body. "Body piercing"
<br />. shall not refer to any medical procedure
<br />performed by a licensed physician or med~
<br />ical specialist.
<br />"Body' branding" means impressing or
<br />burning a mark er figure on the skin of a
<br />person with a hot ebject or flame.
<br />"Body painting" means applying co,lor,
<br />pigment or paint to an area of the skin that
<br />exceeds three square inches.
<br />"Body scarificatioJl or scarring" means
<br />any method by which a scar is applied to
<br />or left upen a bedy.
<br />"Clean" means the absence ef dirt,
<br />grease, rubbish, garbage, oder and ether
<br />effensive, unsightly, er extraneeus matter.
<br />"Geed repair" means free ef cerresien,
<br />breaks, cracks, chips, pitting, excessive
<br />wear and tear, leaks, obstructions, and
<br />similar defects so, as to censtitutea geed
<br />and seund cendition,
<br />"Enfercement efficer" means the .Chief
<br />ef Pelice er designee.
<br />"Operate" means to, ewn, manage er
<br />cenduct, er to, have centrel, charge er cus-
<br />tedy ever.
<br />"Specialist" means that persen perform-
<br />ing the. tatteeing, piercing, branding er
<br />painting within a licensed tattee and bedy
<br />piercing enterprise.
<br />"Tattee and bedy piercing enterprise"
<br />means a place ef business where all er
<br />seme ef the fellewing services are previd-
<br />ed to, the public fer censideratien:tattoo-
<br />ing, bedy piercing, bedy branding, body
<br />scarring or bedy painting.
<br />"Tattooing" me.ans the marking of the
<br />skin ef a person by insertion of permanent
<br />colors by introducing them through punc-
<br />ture of the skin.
<br />515.03: LICENSE REQUIRED:

<br />Establishment License: It is unlawful to,
<br />eperate, effer, engage in or carry on tat-
<br />teeing, body piercing, bedy scarring, bedy

<br />Specialist License: It is unlawful to, prac'-
<br />tice, administer or provide tattoo, bedy
<br />piercing, bedy scarring er bedy branding
<br />services in the City witheut a tattee and/er

<br />515.13: SUSPENSION; REVOCATION:
<br />Subd. 1. The City Council may reveke
<br />the license er suspend the. license if the
<br />licensee submit.ted fals'e information or
<br />emitted material informatien in the license
<br />process required. The City Ceuncil may
<br />by resolution suspend or revoke a license
<br />for the violation of any prevision or cendi-
<br />.lien ef this sectienor any' ether lecallaw
<br />geverning the same. activity during the
<br />.license period er any criminal law during
<br />the license peried which adversely affects
<br />the ability to honestly, safely, er laWfully
<br />cenduct a tatteoing, bedy piercing, bedy
<br />scarring, bedybranding. er bedy painting
<br />business.
<br />Subd. 2. A revecatien or suspension
<br />shall be preceded by written notice to the
<br />licensee and a public hearing befere the
<br />City council. The netice shall give at least
<br />ten days notice ef the time an<! place of
<br />the hearing and' shall state the nature of
<br />the charges against the licensee. The
<br />netice shall be mailed to the licensee at
<br />the most recenf address listed. on the.

<br />14. TEMPORARY TATTOOfNG, BODY
<br />PIERCING, BODY BRANDING, BODY
<br />SCARRING OR BODY PAINTING EVENT
<br />LICENSE. .
<br />Subd: .1. The Clerk-Administrater
<br />may issue a temperary tattee,- piercing,
<br />branding, scarring and bedy painting
<br />event license as previded in thissubsec-
<br />tion. ..
<br />Subd. 2. A temporary tattee, piercing,
<br />branding, scarring and body painting spe-
<br />cialist .license may be issued to, a person
<br />who,:
<br />a'.. Is qualified to hold a tattee and pierc-
<br />ing specialist license under this Sectien;
<br />b. Has completed the required applica-
<br />tien and paid the license fee at least sev-
<br />en (7) days prior to the effective date ef
<br />the license.
<br />Subd.' 3. A temperary license is
<br />effective for feur (4) censecutive days; A
<br />, persen may' net be issued more than three
<br />(3) temporary licenses in any period of
<br />
