<br />COUNTY OF RAMSEY
<br />STATE OF MINNESOTA
<br />AN ORDINANCE VACATING AN
<br />UNUSED AND PREVIOUSLY TRAVELED
<br />PORTION OF EDGEWOOD DRIVE IN
<br />THE CITY OF MOUNDS VIEW.
<br />WHERE;AS, the right-of-way for
<br />Edgewood Drive has been physically
<br />reconstructed and realigned, with such,
<br />realigned right-of-way for Edgewood Drive
<br />to be dedicated to the public pursuant to
<br />the plat of Mounds View City liall
<br />Additicin; _
<br />WHEREAS, the fonner right-of-way for
<br />Edgewood Drive, as legally described pn
<br />Exhibit A, is no longer needed for a public
<br />purpose; ,
<br />WHEREAS,any person, corporatIOn or
<br />City owning or controlling utility ease-
<br />ments contained upon the property vacat-
<br />ed reserves the right to continue maintain-
<br />ing the same or to enter upon such way or
<br />portion thereof vacated to maintain, repair,
<br />replace, remove or otherwise attend there-
<br />to; and
<br />WHEREAS, it is intended that any per-
<br />son, corporation or city owning or control-
<br />ling utility easements contained upon the
<br />property vacated shallrealigo th~ same
<br />with the realigned right-of-way for
<br />Edgewood Drive to be dedicated to ~he
<br />public pursuant to the plat of Mounds View
<br />City Hall Addition.
<br />NOW THEREFORE,
<br />THE CITY OF 'MOUNDS VIEW
<br />ORDAINS: ,
<br />SECTION 1. The City of Mounds View
<br />Municipal C::ode Appendix 0 is hereby
<br />amended to include reference to the fol-
<br />lowing Spl!cial Ordinance No. 666.
<br />Subdivision 1. The City has made a
<br />determination that the land constituting
<br />me public roadway easement of the previ-
<br />ously traveled Edgewood Drive is no
<br />longer needed for a public purpose, and
<br />as such, it is in the public interest to
<br />vacate such portion of the previously,trav-
<br />eled Edgewood Drive roadway easement
<br />described as follows:
<br />See Exhibit A.
<br />Subd. 2. The public utilities or facilities
<br />located in the portion of the Edgewood
<br />Drive roadway easement area to be vacat-
<br />ed described in Exhibit A of this ordinance,
<br />are intended to be relocated to the'
<br />realigned right-of-way for Edgewood Drive
<br />to be dedicated to the public pursuant to
<br />.the plat of Mounds View City Hall
<br />'Addition. The proposed vacation of the
<br />portion of the Edgewood Drive roadway
<br />easement therefore will not adversely
<br />affect the ability of the City or other tltility
<br />to maintain, repair, or replace public utili-
<br />ties. , '
<br />Subd. 3. The Council finds that there is
<br />no longer a public need for: that portion of'
<br />the Edgewood DriVe roadway easement to'
<br />be vacated, as described in Exhibit A of
<br />this ordinance.
<br />Subd. 4. The portion of the roadway
<br />easement, as described in Exhibit A of
<br />this ordinance, is hereby vacated.
<br />SECTION 2.. This ordinance takes
<br />"effect30 days after its publication.
