A business that has a guard dog shall file with the City a release authorizing the <br />Police or Fire Department to shoot the dog in an emergencv situation, if necessary, <br />in order to allow a police officer or firefighter to gain admittance to the premises in <br />the perfonnance of his/her duties. <br /> <br />&ttbd. 15. Ke1mels: <br /> <br />a. Conformance with Provisions: <br /> <br />(1) Residential: Any premises v;here more than two (2) dogs but not more than fDur (1) dogs over <br />six (6) months of age are ovmod, boarded, bred or offered for sale \ <br /> <br />(2) Commercial: Any premises \yhere more than four (4) dogs over six (6) months of age ure <br />owned, boarded, bred or offered for sale. <br /> <br />Subd. 8. <br /> <br />Kennels: <br /> <br />(a) Licensing requirements: All dog kennels must first obtain a special use permit as <br />required in Title 1100 of this Code. The zoning classifications as required under Chapter <br />1103 and Section 1104.02 of this Code must be conformed with. Regardless of any <br />provision in Title 1100 of this Code, the owner of a proposed dog kennel shall present a <br />petition to the Council signed by more than fifty percent (50%) of all registered <br />landowners or those occupying land within five hundred feet (500') of the proposed <br />kennel who agree to the establishment ofthe kennel. Upon the receipt ofthe petition the <br />council will then set a hearing for a special use pemlit as provided for in Title 1100 of <br />this <br />Code. The petition shall contain, among other items of infomlation, how many dogs the <br />petitioner intends to keep on the premises. <br /> <br />(b) License fee: The annual license fee for dog kennels shall be established by resolution of <br />the City Council. The license fees are due September 1 of each year. <br /> <br />b. Licensing Requirements: All dog kennels, residential or commercial, as defined in subdivision 1 of <br />this Section, must be established by a special use permit as required in Title 1100 ofthia Code.
