<br />Subd. 3. <br /> <br />LIABILITY FOR PETS. No owner who is exercisin,g due care by adequately restraining or <br />confining an animal, shall be held liable under this ordinance for any harm the animal causes to <br />IDlY other animal if harmed animal is at large and the hamled animal has entered the area or <br /> <br /> <br />. <br /> <br />+4+,05: <br /> <br />RAISINC OF AJ.~IMAL8: <br /> <br />&thd. 1. Definitions: .i\s used in this Section, the following words and tenus shall have the meanings ascribed <br />to them-iR-tBts-subdivision: <br /> <br />a. /\NIMAL: Any mammal of the rodent family, including but not necessarily limited to rabbits, hares <br />and hamsters, and any fav'!l, including but not necessarily limited to chickens, pigeons, ducks or geese. <br /> <br />b. KEEPING: Providing food, '.vater and sholter for any animal defined horein. <br /> <br />c. PRIVATE PROPERTY: All premises ov;ned by private individuals, including all structures located <br />thereon, front yards, side yards and back yards. <br /> <br />d. RAISING: The maintaining and breeding as a hobby or as a commercial enterpl1se any animal defined <br />herein. (Ord. 460, 4 24 89) <br />701.06: RAISING I KEEPING DOMESTIC OR FARlYI ANIMALS: <br /> <br />Subd. 2. Restrictions: It shall be lawful to keei' or raise not more than two (2) animals, as heroin defined, on the <br />pri'.'ate property of the a'1me{' of said animals, except \vhere such animals shall constitute a public <br />ITmsanco. <br /> <br />Abel. 3. In','estigation of Complaints: It shall be the duty of the Police Department to investigate aU complaints <br />submitted to the Council, and if, afte-r investigation, there appears to be a ','iolation of this Chapter, the <br />im'ostigating officer shall sign a complaint. Nuisance Declared: It is hereby declared to be unlawful and a public nuisance affecting <br />the public peace, safety, and welfare for an ovvner within the city to keep or raise any <br />farm animal unless the animal is cun"ently being kept or raised on the date of <br />the enactment of the ordinance. <br /> <br />Subd. <br /> <br />2. Restrictions: It is unlawful for a dog owner to keep or raise more than two (2) dogs <br />except as allowed under 701.04 (h) "Kelmels." It is unlawful to keep or raise a domestic <br />or farm animal if it creates a public nuisance and adversely affects the public health <br />and welfare. <br /> <br />Subd. <br /> <br />3. Investigation of Complaints: It shall be the duty of the Community Service Officer and <br />the Police Department to investigate all complaints submitted to the Council regarding <br />domestic or faml animals.
