SECTION VI. Appeal Provisions. The City Council shall have the power to vary or modify the application of any provisions of this ordinance upon its determination in its absolute legislative discretion that such variance or modification is necessary to alleviate an undue hardwhip, and will not effect the integrity of the comprehensive plan, the City's planning or zoning ordinance, or the Interim Ordinance District, and is consistent with the letter and intent of this ordinance and not the health, safety and general welfare of the City. Upon receiving any application for such variance or modification of this ordinance, the City Council shall refer such application to the Planning Commission with respect to the effect of the prospective variance of modification of the planning process and comprehensive plan. Such report shall be returned by the '. Planning Co~mission to the City Council within sixty (60) days followlng such reference and shall be placed upon the next agenda of the Cit Cou SECTION VII. Length of Time. This ordinance shall remain effective for one year from the date of its enactment or until such time as said ordinance shall be revoked or erwise amended. SECTION VIII. Penalties. Any person, firm, entity or corporation who violates any provisions of this ordinance shall be guilty of a misdemeanor as defined by state law. SECTION IX. Validity. The validity of any word, sentence, section, clause, paragraph, part or provision of this ordinance shall not affect the validity of any other part of this ordinance which can be given effect without such invalid part or parts. SECTION X. This ordinance shall take effect thirty days after the date of its publication. Read by the Council of the City of Mounds View on this 10 of April, 1989. .
