( a) A particular hardship to the owner would result if <br /> the strict letter of regulations were carried out; <br /> (b) The condition upon which the application for a <br /> variance is based are unique to the parcel of land <br /> of the use thereof for which the variance is <br /> sought and are not common, generally, to other <br /> property or uses thereof within the same zoning <br /> classification; <br /> . (c) The granting of the variance will. not be <br /> . detrimental to the public. welfare or injurious to <br />. other property or improvements in the <br /> neighborhood. <br /> Variances will not be considered unless the <br /> appellant has paid to the City the plan check fee <br /> as established by Chapter 59 of the Municipal <br /> Code. <br /> Subdivision 4. Board of Appeals. In order to <br /> determine the SUitability of alternate materials and type of <br />. construction and to provide for reasonable interpretations <br /> of the provisions of this Code, there shall be and hereby is <br /> created a Board of Appeals. The City Council shall serve as <br /> such a Board of Appeals. The bUilding inspector shall be an <br /> ex officio member of such Board. The Board shall hear and <br /> determined all appeals from decisions of the Building <br /> Inspector with respect to any of the provisions of this Code <br /> and shall render all of its decisions in writing to the <br /> Building Inspector and to the Applicant.} - <br /> {63.11 PENALTIES. <br /> Subdivision 1. Misdemeanor. Any person, firm, or <br /> corporation which shall violate any provisions of this <br /> chapter shall be guilty of a misdemeanor. The imposition of <br /> one penalty for any violation shall not excuse the violation <br /> or permit it to continue; and all such persons shall be <br /> required to correct or remedy such violations or defects <br /> within a reasonable time; and when not otherwise specified <br /> each ten days that prohibited conditions are maintained <br /> shall constitute a separate offense. The application of the <br /> above penalty shall not be held to prevent the enforced <br /> removal of prohibited conditions. <br /> Subdivision 2. Orders Establishing Fire Lanes. The <br /> Bureau of Fire Prevention is hereby authorized to order the <br />. establishment of fire lanes on public or private property as <br /> may not be necessary in order that the travel of fire <br /> equipment may not be interfered with, and that access to <br /> fire hydrants or buildings may not be blocked off.
