• ~- <br />ORDINANCE NO.777 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />AN E AUTHORIt1Nt3 A <br />P TIIWd OF A DRAINAOB <br />8A8EMENT <br />Wf'fH THE HIDDEN <br />HOLLOW MAJOR SUBDIVISION' <br />WHEREAS, the City of Mounds View <br />was granted a drainage'and utility ease- <br />ment for stormwater management <br />pur-poses In 2004 within and associated <br />with the HIDDEN HOLLOW plat; and, <br />WHEREAS, Dave Regal Construction <br />(DRC) has submitted e1n application to <br />vacate part of the drainage and utilty <br />easement on the following legally <br />described parcel: <br />Lot 8; HIt7OEN HOLLOW <br />Ramsey County, Mlrtnesota <br />WHEREAS, ,the''easement area to be <br />vacated from LotlS, HIDDEN HOLLOW is <br />legally described as follows: <br />That part. of .Lot 5, Block i, HIDDEN <br />HOLLOW, Ramsey County, Minnesota, <br />according to the' recorded plat Uiereof, <br />dedicated as drainage and utility ease- <br />ment on said plat, described as folows: <br />Commencing at the southwest comer of <br />said Lot 5; thence North 01 degrees 40 <br />minutes 10 seconds West (assumed <br />bearing) 70.23 feet along the west line of <br />said Lot 5 to the drainage and utlity <br />easement reference line as shown on <br />said plat; thence South 71 degrees 47 <br />minutes 20 seconds East along said <br />reference line 30.49 feet to the point of <br />beginning of the land to be described; <br />thence North 80 degrees 34 minutes 32 <br />seconds East along said reference line <br />6921 feet; thence North 57 degrees 51 <br />minutes 23 seconds East along said <br />reference line 14.90 feet; thence Soutli <br />04 degrees 42 minutes 19 seconds West <br />10.44 feet; thence South 48 degrees' 18 <br />minutes 38 seconds West 30.56 feet; <br />thence South 59 degrees 09 minutes 00 <br />seconds West 15:53 feet; thence South <br />82 degrees 02 minutes 15 seconds West <br />26.33 feet; thence North 37 degrees 36 <br />minutes 26 seconds West 29.15 feet to <br />the point of beginning. <br />NOW THEREFORE, <br />THE CITY OF MOUNDS VIEW <br />ORDAINS: <br />SECTION 1. The City of Mounds View <br />Municipal Code Appendix D le hereby <br />amended to Include reference to the !ol- <br />Iowing Special Ordinance No. 777. <br />Subd. t. The City has made a determin- <br />ation that -the drainage and utility <br />ease-meat area as described herein and <br />Illustret®d on Exhibit A does not serve a <br />public purpose, and ae such, k Is In the <br />public Interest to vacate saki easement <br />area. <br />Subd. 2. The CRy Council of the CRy of <br />Mounds Vlew Nnda that there la no publb <br />Interest or purpose served In retaining the ' - <br />®aeemeM area described and proposed <br />to bs vacated. - <br />Sutid. 3. That described part of the <br />drainage and utility easement as shown ~; <br />on Exhibit A Is hereby vacated. n <br />SECTION 2.
