Resalcrtiai~ 7`426 <br />Page 2 <br />WHEREAS, the proposed final plat dated stamped March 17, 2009 for the Mermaid 2"d <br />Addition is consistent with approved preliminary plat; and, <br />WHEREAS, the Mounds View City Council has reviewed the following documents <br />about this requests: <br />1. Staff Report 4. Aerial View <br />2. Preliminary Plat dated 1-21-09 5. Site Plan <br />3. Zoning Map 6. Final Plat dated March 17, 2009 <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council, having <br />already approved the preliminary plat, approves the Mermaid 2"d Addition Final Plat date <br />stamped March 17, 2009 as submitted by Charlie and Dan Hall subject to the following <br />conditions: <br />1. The applicant shall satisfy all requirements made by the City Attorney as stated in the plat <br />opinion. <br />2. The applicants shall pay off the outstanding bond debt from the tax-increment financing <br />(TIF) if they sell the hotel. The owners of the hotel (the Halls) should make this payment at <br />the time of a closing on the sale of the hotel property. <br />3. The applicant shall either meet the fire code requirements in regards to no openings <br />between buildings along common property lines, or sign a "Hold Harmless Agreement" that <br />will be recorded as part of the property records with Ramsey County. The City shall <br />approve this agreement before recording. <br />4. The applicant shall pay all City costs, including those of the City Attorney. <br />5. Upon filing of the final plat with Ramsey County, the applicant shall vacate the underlying <br />CIC and Mermaid Addition plats. <br />6. The applicant shall satisfy all the requirements of Ramsey County, including dedicating on <br />the final plat the 15-foot-wide roadway and utility easement along the north side of County <br />Road H. <br />7. The property owners shall furnish the City with an electronic copy and a mylar copy of the <br />final plat showing evidence of recording with Ramsey County. <br />NOW, THEREFORE, BE IT FINALLY RESOLVED that City approval of this final plat is <br />subject to approval by and recording with Ramsey County, which shall occur within one hundred <br />twenty (120) days of City Council approval of this resolution. Failure to do so within said timeframe <br />will make the City approval of the final plat null and void. <br />
