Resalcrtiai~ 7`426 Page 2 WHEREAS, the proposed final plat dated stamped March 17, 2009 for the Mermaid 2"d Addition is consistent with approved preliminary plat; and, WHEREAS, the Mounds View City Council has reviewed the following documents about this requests: 1. Staff Report 4. Aerial View 2. Preliminary Plat dated 1-21-09 5. Site Plan 3. Zoning Map 6. Final Plat dated March 17, 2009 NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council, having already approved the preliminary plat, approves the Mermaid 2"d Addition Final Plat date stamped March 17, 2009 as submitted by Charlie and Dan Hall subject to the following conditions: 1. The applicant shall satisfy all requirements made by the City Attorney as stated in the plat opinion. 2. The applicants shall pay off the outstanding bond debt from the tax-increment financing (TIF) if they sell the hotel. The owners of the hotel (the Halls) should make this payment at the time of a closing on the sale of the hotel property. 3. The applicant shall either meet the fire code requirements in regards to no openings between buildings along common property lines, or sign a "Hold Harmless Agreement" that will be recorded as part of the property records with Ramsey County. The City shall approve this agreement before recording. 4. The applicant shall pay all City costs, including those of the City Attorney. 5. Upon filing of the final plat with Ramsey County, the applicant shall vacate the underlying CIC and Mermaid Addition plats. 6. The applicant shall satisfy all the requirements of Ramsey County, including dedicating on the final plat the 15-foot-wide roadway and utility easement along the north side of County Road H. 7. The property owners shall furnish the City with an electronic copy and a mylar copy of the final plat showing evidence of recording with Ramsey County. NOW, THEREFORE, BE IT FINALLY RESOLVED that City approval of this final plat is subject to approval by and recording with Ramsey County, which shall occur within one hundred twenty (120) days of City Council approval of this resolution. Failure to do so within said timeframe will make the City approval of the final plat null and void.
