Findings of Fact: <br />1 April 29, 2010 <br />ORDINANCE NO: 842 <br />CITY OF MOUNDS VIEW <br />RAMSEY COUNTY <br />STATE OF MINNESOTA <br />AN ORDINANCE AMENDING TITLE 1300 OF THE MOUNDS VIEW CITY CODE BY <br />REPEALING ALL OF EXISTING CHAPTER 1301 (FLOOD PLAIN ZONING) AND <br />ADDING A NEW CHAPTER 1301 (FLOOD PLAIN MANAGEMENT TO THE CITY <br />CODE <br />THE CITY OF MOUNDS VIEW, MINNESOTA, ORDAINS: <br />SECTION 1. The Mounds View City Council hereby repeals Chapter 1301 (Flood Plain Zoning) <br />of the Mounds View City Code. <br />SECTION 2. The Mounds View City Council hereby adds a new Chapter 1301 (Flood Plain <br />Management) to the Mounds View City Code as follows: <br />CHAPTER 1301— FLOOD PLAIN MANAGEMENT <br />1301.01: STATUTORY AUTHORIZATION, FINDINGS OF FACT AND PURPOSE <br />Subd. 1. Statutory Authorization: The Legislature of the State of Minnesota has, in Minnesota <br />Statutes Chapter 103F and Chapter 462, delegated to local government units the responsibility to adopt <br />regulations designed to minimize flood losses. Therefore, the Mounds View City Council does ordain as <br />follows in this Chapter: <br />a. The flood hazard areas in the City are subject to periodic inundation that results in potential <br />loss of life, loss of property, health and safety hazards, disruption of commerce and <br />governmental services, extraordinary public expenditures for flood protection and relief, and <br />impairment of the tax base, all of which adversely affect the public health, safety, and general <br />welfare. <br />b. Methods Used to Analyze Flood Hazards. The City bases this Chapter on a reasonable <br />method of analyzing flood hazards that is consistent with the standards set by the Minnesota <br />Department of Natural Resources "(DNR) <br />c. National Flood Insurance Program Compliance. The City adopts this Chapter to meet the <br />rules and regulations of the National Flood Insurance Program codified as 44 Code of Federal <br />Regulations Parts 59 -78, as amended, so as to maintain the City's eligibility in the National <br />Flood Insurance Program. <br />Subd. 3. Statement of Purpose: It is the purpose of this Chapter to promote the public health, safety, <br />and general welfare and to minimize the losses described above in Section 1301.01, Subd. 2 a by the <br />provisions contained herein. <br />
