With the alterations made to the front of his yard, he was not able to maintain <br />the deep hole that the City has created and he requested the City to maintain the right-of-way. <br />6. SPECIAL ORDER OF BUSINES5 <br />A. Resolution 7609, Proclaiming Apri130, 2010, as "Arbor Day:' <br />Mayor Flaherty read in full a resolution proclaiming April 30, 2010, as "Arbor Day." He noted <br />Mounds View has been recognized as a Tree City USA Community for 28 consecutive years. <br />MOTION/SECOND: Gunn/Mueller. To Adopt Resolution 7609, Proclaiming Apri130, 2010, as <br />"Arbor Day." <br />Ayes — 5 Nays — 0 Motion carried. <br />B. Proclamation — Building Safety Month — May 2010. <br />Clerk-Administrator Ericson explained Building Safety Month is celebrated nationally in the <br />month of May to raise awareness of the need for building safety along with fire prevention codes. <br />Mayor Flaherty read in full a proclamation declaring May, 2010, as "Building Safety Month." <br />MOTION/SECOND: Mueller/Stigney. To Approve a Proclamation Declaring May, 2010, as <br />"Building Safety Month." <br />Ayes — 5 Nays — 0 Motion carried. <br />7. COUNCIL BUSINESS <br />A. 7:05 p.m. Public Hearing to Consider Resolution 7606, Approving an Interim <br />Use Permit for the Temporary Tent at The Mermaid, 2200 Highway 10. <br />Community Development Director Roberts explained that after the completion of the AmericInn <br />Hotel construction and renovation of the existing facility, The Mermaid erected a temporary <br />outdoor membrane structure for banquets and other events. At the time it was first erected, there <br />were no zoning regulations to address such a structure. In 2004, the City adopted new provisions <br />for temporary tent structures in business zoned districts and created an Interim Use Permit (NP). <br />In March of 2005, the City approved a 5-year NP for The Mermaid's tent. The Mermaid has <br />applied for a new ICTP in order to continue using the tent. <br />Community Development Director Roberts presented the City Code requirements for <br />consideration of an NP, noting it is the same as the process to consider a Conditional Use Permit <br />(CUP). He noted the City code has eleven different conditions the NP must meet to be <br />approved. The Mermaid's tent does meet all conditions at this time and Staff recommends <br />approval for an indefinite period so long as the owner gets the necessary annual pernuts from the <br />City. <br />
