Mounds View City Council October 8, 2007 <br />Regular Meeting Page 3 <br />• <br />Finance Director Beer indicated this item too was to adopt a special assessment, and this would <br />be far charges relaring to the abatement of nuisance conditions at specific properties. <br />Acting Mayor Stigney opened the public hearing at 7:18 p.m. <br />Margaret Leutboushouof 2263 County Road H2 indicated that they recently bought this property <br />and were unaware of these charges, and she has talked to Staff about this to see if there is any <br />way to get this resolved. She then said that they bought the property and were told that there <br />were no outstanding issues, and they have had to pay for garbage and delinquent utilities and now <br />this. <br />Hearing no further public comments, Acting Mayor Stigney closed the public hearing at 7:20 <br />p.m. <br />Interim Administrator Ericson explained that this has happened before and the recourse was for <br />the buyer to take action against the previous property owner. In the past, the City has not reduced <br />or waived the assessments. <br />Council Member Flaherty said that this surprises him, and he wonders how that previous <br />property owner could get away with this. <br />. Council Member Flaherty indicated that he would like Staff to contact the title company <br />regarding this. <br />A member of the audience recommended that the property owner check with her title insurance <br />company as, if she purchased title insurance, they should pay this amount. <br />Ms. Labanshio indicated that she did call the title company, and they told her that they cailed the <br />City and were told that nothing was pending. <br />Council Member Mueller asked her when she purchased the property. <br />Ms. Labanshio indicated that the property was purchased in May. <br />MOTION/SECOND: Mueller/Hu1L To Waive the Reading and Approve Resolution 7168, <br />Adopting a Special Assessment Levy for Charges Abating a Nuisance Condition. <br />MOTION/SECOND: Flaherty/Mueller. To Amend to Not Include Ms. Labanshio Until Further <br />Information is Received on This Property. <br />Acting Mayor Stigney explained that this is a private matter between this owner and the previous <br />owner and should not be a City problem. <br />• Ayes - 2 Nays - 2(Stigney/Hull) Amendment failed. <br />
